Ms. DiSanto advised she was not entering an appearance to present oral argument but was seeking solely to advise this court that the appellant's previously filed bankruptcy proceeding remained pending and that the appellant was awaiting action by the bankruptcy court that would potentially authorize her to serve as counsel on behalf of the appellant in the bankruptcy proceedings. She acknowledged that the appellant has not obtained an order from the bankruptcy court in response to this court's order of March 8, 2023, and that the automatic bankruptcy stay did not apply to this proceeding. However, she requested that the oral argument not proceed due to anticipated action in the bankruptcy court that may impact who has the authority to act on behalf of and to represent the appellant in this matter. Counsel for the appellee, Melissa A. Santalone, was present and prepared to proceed with oral argument. However, Ms. Santalone noted that the appellee did not request oral argument and did not object to the case being disposed of without oral argument. The court determined that the oral argument would not proceed as scheduled.
