Description status report/bankruptcy ~ On March 14, 2023, Attorney Kathleen L. DiSanto appeared before this court at the scheduled oral argument on behalf of the appellant. Ms. DiSanto advised she was not entering an appearance to present oral argument but was seeking solely to advise this court that the appellant's previously filed bankruptcy proceeding remained pending and that the appellant was awaiting action by the bankruptcy court that would potentially authorize her to serve as counsel on behalf of the appellant in the bankruptcy proceedings. She acknowledged that the appellant has not obtained an order from the bankruptcy court in response to this court's order of March 8, 2023, and that the automatic bankruptcy stay did not apply to this proceeding. However, she requested that the oral argument not proceed due to anticipated action in the bankruptcy court that may impact who has the authority to act on behalf of and to represent the appellant in this matter. Counsel for the appellee, Melissa A. Santalone, was present and prepared to proceed with oral argument. However, Ms. Santalone noted that the appellee did not request oral argument and did not object to the case being disposed of without oral argument. The court determined that the oral argument would not proceed as scheduled. The appellant shall file a status report within twenty days addressing the status of the bankruptcy proceeding and any impact it may have on this court's ability to proceed forward to dispose of this case. The parties are notified that this court, in its discretion, may dispense with oral argument and determine the case based on the briefs and record.

Description ORD-SUA SPONTE ~ Appellant has filed a suggestion of bankruptcy. It is this court's preliminary determination that the automatic stay provision of 11 U.S.C. § 362(a) does not apply because the action in lower court case 19-CA-2787 was not against the debtor. See Crowe v. Grp., Inc. v. Garner, 691 So. 2d 1089, 1089 (Fla. 2d DCA 1993) ("[T]he determination of whether a case on appeal is stayed [pursuant to 11 U.S.C. § 362(a)] depends upon its inception, with the stay applying against proceedings originally brought against the debtor . . . ." (emphasis added)); accord In re Kozich, 406 B.R. 949, 953 (Bankr. S.D. Fla. 2009). Accordingly, this appeal will proceed. This order is without prejudice to the parties to obtain an order from the bankruptcy court clarifying whether the automatic stay applies to this proceeding. In light of this court's preliminary determination, the March 14, 2023, oral argument will proceed absent a motion to continue. Any such motion shall contain a certificate that the moving party has consulted with the opposing counsel and that the opposing counsel has no objection or will promptly file an objection.
