I recently bought a house with Lennar closing date was on XX/XX/XXXX. I have paid all my dues with lennar and first mortgage as of XX/XX/year>. My insurance XXXX XXXX has not received any home insurance payments from Lennar and are about to cancel my policy on XX/XX/XXXX. I have contacted lennar and always talk and get transferred to XXXX XXXX who is handling my case she has stated Lennar has sent XXXX XXXX a ledger check and has been received I told her it has not been received per XXXX XXXX and needs to be resolved and requested documentation that it was sent days and times and signatures she told me it would be sent to my email and uploaded to my lennar portal it has not. Ive contacted my insurance XXXX XXXX as well letting them know I have contacted lennar title multiple times to try and resolve matters that I have paid them and they have sent the ledger check XXXX XXXX has let me know they have put it under investigation at this time and will be up for cancellation XX/XX/XXXX but they have documentation of me telling them Ive contacted lennar and what they have said.
I need assistance because I paid lennar and lennar is not sending my home insurance there money and now they have sold to company XXXX XXXX and I cant move anything over till these payments are resolved Ive done everything I can in the time frame Ive had.

On XX/XX/XXXX we applied for XXXX XXXX through Lennar Mortgage. We received notification on XX/XX/XXXX that we were officially approved through Lennar. On XX/XX/XXXX we gave a down payment of {$13000.00}.
We were advised by the loan processor on XX/XX/XXXX that we were all approved by underwriting and no further actions were needed. We received a closing cost worksheet on XX/XX/XXXX which showed our cash deposit paid of {$13000.00} and a total cash required to close in the amount of {$4900.00}.
On XX/XX/XXXX ( just 38 days away from closing ) we were contacted by Lennar bank and told that our XXXX XXXX was denied by underwriting and that we needed to change our loan program and terms to a conventional mortgage oppose to XXXX We asked for details and explanation as to how that would affect us and we were advised that we needed a higher credit score typically. We advised that there had been no changes since our credit was pulled initially so our credit score would not have increased by XXXX XXXX in XXXX XXXX We were told that the loan processor would get back to us with the new loan terms.
We received a notice via email that the XXXX XXXX was canceled and a new Conventional loan document was ready for signing. We also received new closing statement on XX/XX/XXXX and new loan application/agreement which showed a conventional loan with a different base price for the home ( a higher amount ) and a much higher cash required to close in the amount of {$17000.00}.
We immediately expressed our concern for the significant price difference. Particularly, the amount required to close as well as the base price of the home. We advised that we would not be signing the new loan agreement until weve had the opportunity to speak to someone about why the amounts were significantly different.
We contacted the Lennar loan processor, the Lennar New Home Sales Consultant and the realtor and expressed our written and verbal consent. We were advised that they will be able to explain everything once all the new loan documents signed and reviewed by underwriting. After reviewing the terms of the loan, the base price of the home, the fees required and the additional XXXX XXXX to close, weve come to terms that this was not something that was agreed to when we went under contract originally.
We expressed that we could not financially afford the new terms of this conventional loan and that we do not have the funds available to satisfy the new required cash to close. We asked several times by written email request, text messages and voicemail to have our deposit of {$13000.00} refunded back to us.
On XX/XX/XXXX we were told by the Lennar New Sales Consultant that Lennar corporate will not release our deposit and will hold it for one year.

I'm suppose to close on a pre-construction home some time in XXXX. I signed the contract disclosures on XX/XX/2022 and on XX/XX/2022 I asked my loan officer if I can lock in my interest rate at which time it was 3 %. I was told by the loan officer that I wasn't able to lock in yet, but when I went back to read the Interest Rate Disclosure I noticed that there's no time frame to lock in my rate and on the contrary it states that any time I'm ready I'm suppose to advise my lender when I would like to lock my rate. I was denied that opportunity with no explanation or options given and I feel that the Interest Rate Disclosure has been breached, it contradicts our agreement and breaks it. I tried to explain the situation to my loan officer but was told that there's nothing they can do and I would have to accept todays higher rate. Furthermore, I requested to speak with a supervisor to see if they were able to help in this matter, I was told I would receive a call but haven't heard anything yet.

On XX/XX/XXXX We were conditionally approved for a mortgage with Lennar Mortgage for a home in XXXX XXXX. we were scheduled to close in XX/XX/XXXX me and my wife and our XXXX XXXX XXXX son moved in with our Daughter and Family temporally from XXXX XXXX until the home was done. so my wife had to switch jobs to XXXX the mortgage company said that we needed more pay stubs from her new job so Lennar told us that they couldn't wait for us to close so they sold the house to someone else and they had our {$11000.00} dollars deposit and we had 1 year to use it so we picked another home in XXXX XXXX so we had to stay with our Daughter and family until XXXX which was very stressful on us and our daughter and her family when we finally came to a closing date the mortgage company told us that we had to come up with {$13000.00} more for Points And our Rate because of not being locked in was higher and Lennar had our deposit already and we had another {$13000.00} in the bank for closing there was no way that we could come up with the other Closing cash so we had to cancel our loan and Lennar kept our Deposit of {$11000.00} and we couldn't get our loan they should return our deposit in full and we contacted Lennar several times and spoke to several people at Lennar in various locations and gave them our new address because of having to rent a Home for us and having a argument with our son in law we had to get the first place we could find in XXXX a person at Lennar said that she would send the office our new address and that they should be refunding our money soon its been since XXXX XXXX XXXX since our canceled contract and still did not receive our money or any correspondence from Lennar also we contacted FHA and was told that they had no Knowledge of us ever having a contract with them and they told us because Lennar did our Mortgage they do this all of the time and we should contact you for further Help

In a response provided by the company Eagle Home Mortgage , LLC., regarding a matter in relation to the denial of approval for a Federal Housing Administration loan for which I am continuing to seek further information and clarification, the mortgage lending entity Eagle Home Mortgage details that on XX/XX/2020, " Statement of Denial ... was sent to MrXXXX XXXX current address via U.S. mail. '' As the applicant, who clarified my mailing address in numerous pieces of documentation, I never received such a letter detailing the reasons behind the denial of my mortgage application, neither by mail nor electronic messaging, and have continued seeking this piece of information from the mortgage lender, as it is a crucial piece of evidence in my continued dealings with a home builder in the state of Florida.
I am requesting that Eagle Home Mortgage forward me evidence of the mailing of such a letter, such as a tracking number, a date and time scan from the mailer provided in a paper report, or stamp with the date and time of acceptance to verify the truthfulness of this claim. Additionally, because the matter of my denial pertains to disclosures of my citizenship status in the United States, I would like the lending entity to clarify whether they explained, disclosed, or stressed during the lending process that approval of the loan was contingent to status as a U.S. citizen or permanent resident, and why it is that a discrepancy exists between their copy of in my responses to Section VIII of my initial Uniform Residential Loan Application and my own original version.
The responses I have received from the lender are in contradiction with guidelines established by the Federal Housing Administration, so I am seeking to be in receipt of their lending policy procedures and details of their requirements, in addition to evidence of whether such requirements were disclosed from the beginning of my initial application.

Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against Lennar Mortgage regarding their handling of my mortgage application process. My experience with the company has been fraught with mismanagement, delays, and what I believe to be unfair practices.

XXXX, a large builder of new construction homes in the XXXX XXXX XXXX XXXX Florida also has its own in-house mortgage company, XXXX XXXX XXXX By using XXXX Mortgage to finance a XXXX home, a homebuyer is given various credits to be applied at closing. My wife and I utilized XXXX Mortgage to finance our home located at the following address, which was closed on in XXXX of XXXX : XXXX XXXX XXXX XXXX XXXX, FL XXXX Recently, it became known to me that on new construction homes in Florida, property taxes for the first year will be based on the unimproved lot/land value considering the new build is not present on the lot for the entirety of the first tax year. During the second year of homeownership, property taxes will increase dramatically to take into account the presence of the new build. In XXXX, we paid approximately {$4400.00} in taxes. These taxes were based on the unimproved lot/land value. Our monthly mortgage payment for the first year was approximately {$2700.00}.
It also came to my attention recently that XXXX, when determining whether a buyer will qualify for a mortgage payment in general, calculates one 's estimated monthly taxes for escrow on the value of the unimproved lot/land value as opposed to the appraised value of the home or XXXX of similar build and design in the area. In other words, XXXX calculates whether someone will qualify for a home and be able to afford the monthly mortgage payment under the assumption one will only have to pay taxes on the value of an unimproved lot indefinitely. This was not verbally explained to me or my wife at closing. Instead, we hurriedly were asked to sign a plethora of documents without being given the time to read or fully understand them while being told we barely qualified for the mortgage payment given our incomes.
In XXXX, our taxes increased from around {$4400.00} to just over {$10000.00}, now rendering the home completely unaffordable due to the resultant required increase in the monthly mortgage payment to cover the taxes ( around {$550.00} ). The mortgage will now need to exceed {$3000.00} monthly, so the home will need to be foreclosed on.
XXXX owes a fiduciary duty to its mortgagors and is essentially qualifying people for mortgages, using its own in-house mortgage company, by incorporating an improper measure of taxes ( the unimproved land/lot value ), quickly selling the mortgage within a month or XXXX of closing to a different lender, while knowing full well that the payment on which the initial approval was based will need to increase by, on average, over 20 % once a valid property tax bill is generated during the second year of homeownership. Since the loan is sold immediately after closing, the new lender bears the risk of foreclosure. This is the same type of predatory lending that resulted in the XXXX financial crisis.
There are currently thousands of buyers in the XXXX XXXX area of Florida who now live in Lennar homes they can not afford that are either for sale or will be foreclosed on due to property tax increases not taken into account by Lennar when qualifying these buyers for homes to begin with. In my immediate Lennar home community, there are around a dozen homes for sale for this very reason.
While Lennar may have had its homeowners sign a document at closing indicating that property taxes may increase substantially during the second year of homeownership, it does not fully communicate the potential increase or qualify its buyers for mortgages based on a good faith estimate of what taxes on their homes will be. While one may qualify for a mortgage payment under the assumption taxes will remain at just {$4000.00} annually, Lennar should have asked itself whether the buyer will be able to afford a mortgage payment once standard property tax bills are generated beginning in the second year of ownership ( the majority of the time, the answer is " no '' ).
In sum, mortgages are providers to Lennar by buyers based on misleadingly-low initial monthly payments, because, again, property taxes are not properly taken into account by Lennar when calculating those payments. During year two, homeowners are forced to sell or enter foreclosure once property taxes not previously-considered result in around XXXX XXXX increases to monthly mortgage payments. If that increase was taken into account when determining one 's debt-to-income ratio during the mortgage qualifying period, many buyers would be rightfully rejected ( myself included ). Instead, they are approved and forced to sell within two years. This type of predatory lending behavior warrants investigation.

On XX/XX/ myself ( XXXX XXXX, XXXX ) and XXXX XXXX entered an agreement with Lennar Homes to purchase XXXX XXXX XXXX XXXX, FL XXXX XXXX As part of the agreement we gave a deposit for the property in the amount of {$16000.00} that was refundable if we were not able to obtain a mortgage. The property was under construction with a propose completion date range from XX/XX/2022 to XX/XX/2022, and the builder realtor had a projected date of completion XX/XX/2022 XX/XX/2022. The builder had an incentive of {$12000.00} for buyers to use towards the closing cost, or down payment if they use the builder preferred lender. We agreed to use Lennars financing with Lennar Mortgage, and completed the application jointly by XX/XX/2022. XXXX XXXX was our assigned loan officer to assist with completing the loan application, and getting us approved for the home mortgage. Our first conversation with XXXX we went over our credit history, income, debt and amount of funds available to put down for closing cost. After reviewing all the information with us, XXXX told us the best route for us was to have myself worked with her credit building team. The timeshare with XXXX reported a foreclosure deed in lieu on my credit, and I needed them to change how it is reported on the credit. The goal with working the credit building team was to get my credit high enough to qualify for conventional lending this way we will be able to put less cash down, and not have to pay PMIs. On XX/XX/2022 XXXX ( Lennar Home sale rep ) and XXXX spoke to their XXXX XXXX to sign off to agree to keep the agreement with letting myself work with the credit building team.
I was working with credit building team and completing all assigned tasks, but my credit did not improve within the first month. It was my understanding I was to work with the credit building team until 60 days prior to closing to attain the credit score needed to attain conventional lending. On XX/XX/2022 Lennar Mortgage filed an Adverse Action on the loan application, and denied the loan while I was still trying to build the credit high enough and correct the timeshare mortgage on my credit. I did not realize the loan was denied until XX/XX/2022 when I open the letter in the mail about the Adverse Action. XXXX never commutated to us about the adverse action about the mortgage to us, and we did not receive the letter in the mail until XX/XX/2022. In that time period between then we were working with XXXX to extend the mortgage contingency on XX/XX/2022 that signed in agreement by all parties on XX/XX/2022. XXXX reached to me on XX/XX/2022 to get an update on the credit report ; on XX/XX/2022 I left a voicemail for XXXX letting him knows there was no change on my credit. I reached out to XXXX on XX/XX/2022 to inquire about the adverse action as well made a verbal request to refund back our deposit. She explained to me that I will need to get an approval from them, and then be denied for the loan in order to get back the deposit. I told her that made no sense to us because why would we get approved for the loan then gets denied for a loan. At this time XXXX and Lennar Homes was not acting in good faith on the mortgage contingency that was in placed. We will not hear any further updates about my credit, or get our deposit back from Lennar. Lennar Mortgage in XX/XX/2022 pulled both mine and XXXX credit again without any communication they were still trying to get us approved after the adverse action. I reached out to XXXX again on XX/XX/2022 to with the proposal that XXXX and her sister XXXX go on the mortgage together. On XX/XX/2022 XXXX XXXX completed the credit application for Lennar Mortgage to co-sign with XXXX XXXX XXXX XXXX was always going to move in with us as she works mostly remote and travels for work. She spends limited time at her home and she wanted to relocate to Florida as well. XXXX reached out to XXXX and XXXX a few days later, and explained that she could not link both of their apps together. XXXX had to fill out a new credit app which will lead to XXXX hard inquiries. On XX/XX/2022 after 16 days of going back and forth with XXXX resending and uploading the same documents on their portal, after we were able to the documents verified the loan application was completed for XXXX and XXXX to be the buyers for the property.
On XX/XX/2022 XXXX informed us that the loan was conditional approved. XXXX and XXXX started uploading documents on Lennar Mortgage XXXX right away to satisfy the loan approval. XXXX who is XXXX supervisor reached to let us know he will be assisting on the loan to get it to final approval. As XXXX uploaded documents on the portal, she was receiving emails from XXXX asking her to upload same financial documents over and over again. XXXX of the other conditions was to verify employment ; XXXX sent an email to XXXX job using XXXX name on the email instead of XXXX. XXXX and XXXX will send emails to XXXX to verify that he received all the documents he needed to get the underwriters to approval the loan. The response time to certain emails could take up to a week. Examples of the slow email response from XXXX and XXXX on XX/XX/2022 the first mortgage disclosure was disclosed. The rates were 1.5 points higher than we expected after what XXXX first disclosed the rates could be once we got the approval. We reached to XXXX to ask for assistance with the higher rate that XXXX shared with us. On XX/XX/2022 Lennar Homes increase the $ XXXX incentive to $ XXXX to assist with interest rates going up. The next issue beside the rate was on the disclosure was they never mentioned the conditional approval was for FHA and not conventional. XXXX led XXXX and XXXX to believe the conditional approval was for a conventional loan, when she called them both on phone earlier in the month during the loan application process. XXXX knew the goal was to get a conventional loan because of the better rates and not having to PMI. When XXXX reviewed their credit with them she never mentioned the house in GA that XXXX ex allowed to go into foreclosure will not allow her to qualify for conventional loan. XXXX and XXXX would not confirm the timeline of the foreclosure would disqualify XXXX from conventional lending until early XX/XX/2022. The frustration grew to outrage as the XXXX and XXXX would not respond back to any form of communication in a timely manner, along with their responses not leading to straight forward answers. For example, in early XX/XX/2022 XXXX had a phone conversation with XXXX after verifying closing funds about wiring the closing cost to the title company as soon as possible. XXXX requested XXXX to wire the funds that week with confirming the amount to close, or getting the final approval from the underwriters. XXXX followed the advice the realtor not to give them any more funds until we had a closing date along with final approval from the underwriters.
Lennar homes schedule for the first closing date for XX/XX/2022 as they estimated the home will be completed prior to XXXX. Then the project XXXX reached out that they were running behind construction and needed another week to complete the home. The closing was rescheduled to XX/XX/2022 after XXXX holiday. XXXX and XXXX from XX/XX/2022 have been reaching out to XXXX and XXXX to make sure they were approved for the mortgage, and they had all the documents they needed to close. After completing the final walk through of the home to point out final touches to the project XXXX, Lennar Homes and Lennar Mortgage claimed everything was ready to close on XX/XX/2022.
On XXXX XXXX XXXX reached out to Lennar Title Company to get the final closing cost. They explained to her that the finance company did not submit a final cost for closing cost, but put the file in suspended status. In the late fashion of Lennar Companies they waited to the respond back to us that following Monday to blame the underwriters for not giving the final approval. They denied the loan because they did not want to give XXXX sisters a loan, and did not want a XXXX family to live in their community. We explained over and over how the family was going to use the home, and they wanted a letter from us with everyones name that will live at the home.
Lennar Mortgage and Lennar Homes did not give back the deposit stating it was passed the mortgage contingency agreement. They claim that Lennar Mortgage can deny us for any reason, and we will have to live with their decision. XXXX the realtor representing Lennar Homes said her XXXX will allow us to try to get another mortgage outside Lennar Mortgage, but have to use another lender her XXXX suggest we use to get a loan by end of the year. The other condition will be that we do not inform the new lender about being denied by Lennar Mortgage. They introduce us to XXXX XXXX with loan XXXX XXXX XXXX.
We worked quickly with XXXX XXXX getting the conditional approval for XXXX and XXXX within the first week of the mortgage application. XXXX is a true professional, and she guided us to get the correct information she needed to for the underwriters to get an approval for the mortgage. After XXXX weeks of working with XXXX, we were close to getting a final approval, but we follow the advice from Lennar Homes not telling her about the Lennar Mortgage denying us the month prior. When she went to the HUD on the property with FHA she discover we denied by Lennar Mortgage, and because the claims on the HUD by Lennar Mortgage she will have to take months to get them removed to get us approved for the property. XXXX did tell us if we had disclosed that information to her ahead of time that she could have gotten the approval because she could have worked on getting the HUD cleared up. Lennar Homes cancel the purchase and sales agreement, and kept the deposit as well. XXXX XXXX stated we can use the deposit towards another property with Lennar homes as long as we are under contract within the next XXXX months. We reviewed properties with XXXX, but her XXXX wanted us to put another deposit with them. He stated the first deposit can not be used on a new contract, and no longer our funds because we failed to secure a loan. He went on to state he did not believe we can secure a mortgage due to our credit issues, and we should be thanking him that he will allow a XXXX family to live in his community. We asked for our deposit back because we no longer wanted to purchase a property with them.

Since I arrived at Lennar Homes in May of this year with my wife and daughter, we have been delighted with the houses and we wanted to find out the price of the model house they gave us the approximate price of the house and they told us that the houses are being released every month. a month and what's up, it was that they knew how much the house was worth, but that we could apply with them to see if we qualified to buy one, the next day we already had pre-approval for a value of {$360000.00} and we only had to wait until XXXX To find out what price the house was going to cost, of course, it was {$8000.00} more expensive, but the seller very kindly contacted the mortgage lady and told her that if she could upload the pre-approval of course without my consent, which I accepted for which was also approved.
Later I told them that I could not pay those {$10000.00} of the 3 interest points that they asked me to buy them in the closing costs. They very kindly told me that they could increase them to the price of the house so that I could pay them together with the mortgage of course That adding another XXXX dollars for improvements to the place that was never discussed but that I accepted in the documents because of the illusion of having my new home.
When they sent me the purchase offer it was a XXXX afternoon when I was in a meeting they told me to sign the contract quickly because from the beginning they make it very clear to you that if you don't hurry the houses go up in price Others grab them or interest rates go up is a very elegant way for Lennar to get someone to sign under tremendous pressure.
At the end of 2 months of sending them documentation that they asked for the same things 2 and 3 times and the stress that the whole process entails and changing and raising and lowering the interest several times and going to the house walk to see all the details of the house because in a week it was closing.
Finally, the day of the closing arrives, which was a Monday by the way I begged them to change the date because it was the worst day for us and no one answered me, neither Lennar Homes nor Lennar Mortgage nor Lennart Title, only later they told me that it could not be done. change period.
On the day of the closing, when we had already packed everything, we had the cars loaded, a rented truck told us that the appraisal ( the appraisal 4 days before the closing date Lennar give us 4 days after the closing date ) was made of the house had gone lower and that the closing was going to move by the end of the month.
And yesterday they told me that they would change my house for a smaller one with higher interest and that I was going to pay more and that apart from that they would give it to me until XXXX and that if I did not accept they would cancel the contract and return the money to me in 90 days and I dont know what happened with my money I send to the Lennar Title Company .
And I wonder what you would do after the exhaustion that this whole situation entails and wasting time in these 4, 3 days of work and I don't know how many gallons of gasoline and having my wife and daughter excited about their new house sleeping on its floor at this time.

Hello. I closed on our property on XX/XX/2019. At the time of closing we were charged {$3700.00} dollars for Mortgage Insurance Premium and issued a FHA case No XXXX. We recently tried to do a Streamline Loan and was told that they dont show that we have an FHA loan. I contacted the FHA and they said they never received a payment for the loan. I have made several attempts to contact Eagle Homes who I purchased the property from as well as the closing company Cal-Atlantic and gotten a total run around. No one returns my calls or can provide me any insight as to what happened to the money. In addition, when we closed we choose XXXX for our homeowners insurance and have the documents signed stating a check would be disbursed to XXXX. A month later we were notified by XXXX that they never received the payment. Eagle cancelled the payment to XXXX and assigned insurance to another company of their choosing. We had to pay the premium out of pocket until the other insurance refunded the money. This caused our mortgage payment to increase because we were now at a deficit. I believe Eagle Home Loans has violated fair practice laws and willingly with holding our funds.

I showed both of them a loan I had recently completed on a house I purchased in XXXX and the loan officer XXXX XXXX XXXX XXXX lied again when he said : " We saw this document yesterday and it was explained to me that the difference is how different states operate. The documents you are being asked to sign are what every non-borrowing spouse signs here. Ive been here for nearly 8 years and helped hundreds of people in your same situation and they have all gone smoothly. Get the verification you need from your attorney but this information is accurate. '' This is also a lie, because the lender I worked with with my loan used paperwork specifically for the state of Florida.
This is unethical and unprofessional and is an example of how Lennar employs dishonest employees who will lie to customers in order to close loans before the end of the month. I have all emails and will attach them to this case. Please look into this matter so this does not happen to more unsuspecting customers.

In XX/XX/XXXX I went under contract for a property in XXXX XXXX XXXX XXXX My mortgage was denied within the contingency period which made me eligible for a refund.
On XX/XX/XXXX, I signed up for usps informed delivery. Upon doing so, I realized that a mail from XXXX should have been delivered to me on XX/XX/XXXX. At this point, I had no confirmation that this was in fact the check. I opened a case with the Usps for lost mail. The post office eventually reached out to me and advised that they would be better able to assist me with the tracking number. They advised it would be best if I get the tracking number from the sender.
On XX/XX/XXXX, I proceeded to contact my former sales rep XXXX XXXX being that thats the only contact I had for the builder side of XXXX and my actual contract. I asked if that could have been the check and he advised that more than likely it was. I asked if he could inquire about a tracking number so I could get more information from usps. I also asked if he could see about having the check stopped. He advised he would look into this and call me back. XXXX did not reach back out to me regarding this.
Being that I am still in the market for a home I reached out to XXXX again on XX/XX/XXXX regarding a property. During this call, I asked for an update on the inquiry regarding the check. He advised me that he would need some additional time as well as a reminder from me after the new year being that most people were off.
On XX/XX/XXXX I called and didnt get an answer. I proceeded to send a reminder about the check via text. XXXX returned my call and I verbally asked for an update on the check status i.e. tracking number, stop order or a contact number for the correct XXXX contact to speak to further about this. XXXX told me he would get back to me and did not.
At this point, my realtor was in touch with another XXXX sales agent and I begged my realtor to see if she could get any information even if its just a contact for me to find out more information being that XXXX was not forthcoming. On XX/XX/XXXX, I was sent an image which the agent shared with my realtor, showing that the check was cashed on XX/XX/XXXX. This agent also provided my realtor with an image of the back of the check showing that a person printed my name for endorsement under which another name was printed. Along with this update, provided to me by my realtor, I was also told that XXXX advised that they will not be assisting me any further with this because the check was cashed. I do not quite understand that because I did not receive this check. The check was not signed by me. This check was not cashed by me. The check did not make it my mailbox. I have no idea whose name was written below my name on the image that XXXX shared. I have been desperately trying to get help with this situation for weeks. I struggled to get in touch with someone who could help or cared to help. If I call the XXXX XXXX numbers its for sales reps. When I call the division of XXXX XXXX numbers it directs me to the website if your issue is not that of an existing homeowner, issue for the title office or a homebuyer. I was only able to get your contact by calling a number for the XXXX XXXX and they put me through to XXXX XXXX customer care coordinator XXXX XXXX who was very helpful in providing me with XXXX email addresses. I eventually got a response from the XXXX XXXX vice president of finance who basically told me that I need to reach out to my bank or the bank that cashed the check. My bank has nothing to do with this because I never received a check to present to them. How will I know which bank a thief cashed/deposited a check to. XXXX mailed a check to me because Im contractually obligated to a refund. The check was not delivered to my address. How am I responsible for this? How is XXXX not responsible for getting in touch with their bank to report the fraud that has been committed against their account from which the funds were fraudulently drawn and reissue my refund per the contract? I even went to my local police station and they advised that being that we dont know who stole the check or where the check was stolen from the best recourse is for the sender to report fraud.
XXXX is wrong and heartless in this matter. I went as far as call XXXXXXXX XXXX which is the issuing bank of their check and of course they can not help me because its not my account but when I explained what happened to them they advised that XXXX can open A fraud case with their bank and report the fraud that was committed against their account. XXXX finds it easier to just turn a blind eye than to do the right thing. I paid my deposit via bank transfer. They just to send the refund back via check unsecured and now I am out of {$850.00}. XXXX not an investor. I am someone looking for a home to shelter my child and myself. This is my hard earned money. I have spent hours pleading with these heartless people about. This has set me back tremendously in this process. I need my {$850.00} back.

Complaint What Happened |
When I was in the closing process with Lennar Mortgage, the loan XXXX, XXXX XXXX was the worst loan officer/person I had to deal with during the entire process.
Lennar had a promotion going where they would pay XXXX dollars of closing and that was a selling point for me. It was also a brand new home from Lennar and was not ready in XXXX when I gave my purchase agreement. I knew it would not be ready until XXXX timeframe.
I was informed my closing cost would not be more than XXXX verbally. Multiple times confirming that prior to giving my purchase agreement. Once I signed and gave money down on the purchase agreement, the closing costs jumped up to XXXX dollars. Not once did XXXX call me and explain the changes from purchase agreement to the new loan estimate amount.
I had to call him and confirm why it jumped and gave me a runaround response that he never saw the purchase agreement. I told him to work on getting it lower and once he was able to, to call me back. XXXX weeks go by and received nothing. I called him again and brought up the situation and he had no recollection of that conversation from XXXX weeks prior. He quickly worked on it after the call showing my displeasure and came back with " buying a XXXX percent of the interest rate '' where that was an additional XXXX added back into the closing. He removed XXXX other costs and the number came in roughly the same amount as it was prior. Due to lack of understanding and being really frustrated with him, I did sign and moved on because I really wanted the house. Mind you, the XXXX closing costs were still showing as XXXX dollars on the closing estimate.
Once I signed, multiple times over the next few months, he made changes to the loan estimate and never once tried to call me to explain what changes he was making. We did not speak again until a few weeks before the closing date when everything really unraveled for me.
XXXX weeks prior to closing ( Closed on XX/XX/XXXX ), I receive a final closing disclosure. I reviewed it thoroughly after learning from experienced lenders/officers and knew he was really messing with the numbers.
The new closing disclosure showed my loan estimate dropped by XXXX and closing costs that I would owe dropped to XXXX dollars. I was pretty pleased to see that number until I realized he moved money around to show my closing cost incentive I was receiving was only XXXX instead of my XXXX dollars. Honestly, I signed it because the XXXX dollars I would owe at signing was good enough for me. 4 days later, I get another " final '' disclosure at XXXX XXXX and the closing costs jumped back up to XXXX dollars. Now, I was pretty upset and tried to get a better understanding why it jumped back up and then why my XXXX dollar incentive went from XXXX to XXXX. They moved my money around and gave me more " XXXX '' on where the other money was going towards.
I ended up having XXXX long conversations with XXXX and was a waste of time. Multiple times on the call was unprofessional, laughing and saying he did nothing wrong. He then said he was doing XXXX loans a month and does not remember my loan. Later I called him out on that knowing XXXX a month is impossible.
Furthermore, he kept giving me a runaround on the phone and was not changning anything for me. I asked for his XXXX and he would not provide me their name.
I still did not sign the document at this point and explained to others in their company that I would like to speak to someone other than XXXX from the loan officing team before signing anything. After XXXX attempts of trying to get someone else, they finally gave me someone else to contact the day before closing. I still did not agree with their response, but finally gave me more information than XXXX XXXX did.
The day of closing, the saga continues. XXXX nor anyone on the team from Lennar gave me any indication that my closing would be virtual/remotely. I drove over an hour in the pouring rain to get there and they say it is remote. Very frustrating throughout the entire process.
