Description Consolidation-130 ~ In case number 6D23-2688 and 6D23-2794, petitioner seeks to compel the lower tribunal to set a trial for certain defendants and to compel ruling on a motion for discovery. In light of the partial final judgments now pending in subsequently filed appeal 6D23-3019, it is not clear what motions that are the subject of the mandamus petitions in these two cases remain pending. Accordingly, the proceedings in 6D23-2688 and 6D23-2794 are consolidated, and petitioner shall show cause within twenty days from the date of this order why the consolidated petition should not be dismissed as moot as to the motions to set trial for particularly named defendants or other pending discovery motions by identifying which motions remain pending in the lower tribunal following the entry of the partial final judgments on appeal in 6D23-3019. The emergency motions to lift stay filed in the subject petitions for writ of mandamus do not contain a copy of any written order imposing a stay for this court’s review and are therefore denied without prejudice to refile a motion with a copy of the lower tribunal’s order entering stay. It is noted that the matters that are the subject of 6D23-2688 and 6D23-2794, as original proceedings filed pursuant to Florida Rule of Appellate Procedure 9.100, do not otherwise preclude the lower tribunal from ruling on any motions that remain pending on the docket and providing this court with a copy of those orders.

Description Consolidation-130 ~ In case number 6D23-2688 and 6D23-2794, petitioner seeks to compel the lower tribunal to set a trial for certain defendants and to compel ruling on a motion for discovery. In light of the partial final judgments now pending in subsequently filed appeal 6D23-3019, it is not clear what motions that are the subject of the mandamus petitions in these two cases remain pending. Accordingly, the proceedings in 6D23-2688 and 6D23-2794 are consolidated, and petitioner shall show cause within twenty days from the date of this order why the consolidated petition should not be dismissed as moot as to the motions to set trial for particularly named defendants or other pending discovery motions by identifying which motions remain pending in the lower tribunal following the entry of the partial final judgments on appeal in 6D23-3019. The emergency motions to lift stay filed in the subject petitions for writ of mandamus do not contain a copy of any written order imposing a stay for this court’s review and are therefore denied without prejudice to refile a motion with a copy of the lower tribunal’s order entering stay. It is noted that the matters that are the subject of 6D23-2688 and 6D23-2794, as original proceedings filed pursuant to Florida Rule of Appellate Procedure 9.100, do not otherwise preclude the lower tribunal from ruling on any motions that remain pending on the docket and providing this court with a copy of those orders.
