| Description | This court has granted the court reporter, Digital Court Reporting, over 100 additional days to file the transcripts. Our October 22, 2024, order provided that the failure to timely file the transcripts may result in a referral to the court administrator and Chief Judge of the lower tribunal. The transcripts have not been filed. The court reporter's failure to timely file the transcripts designated by the appellant has prevented the instant appeal from being perfected. This appeal of a criminal judgment and sentence is subject to reversal unless the transcripts can be obtained. Furthermore, this court has an independent obligation to resolve this appeal in a timely fashion. See Art. I, § 16(b)(10)b., Fla. Const. We therefore relinquish jurisdiction in this case for forty-five days to the Circuit Court for the Sixth Judicial Circuit. The Honorable Shawn Crane, Chief Judge, shall take appropriate measures to ensure that the designated transcripts are filed with the clerk of the circuit court within the forty-five-day period. Judge Crane may delegate responsibility for this matter to another judge of the circuit court as he deems appropriate. By the end of the forty-five-day period, Judge Crane or his designee shall file in this court a status report on transcript preparation and filing. |

| Description | DISP-UPL GR (REFEREE) ~ The uncontested report of the referee is approved and respondent is found guilty of indirect criminal contempt for violating the Cease and Desist Affidavit he signed under oath on February 16, 1999. As a sanction, respondent is placed on probation for twelve months, effective immediately, under the terms and conditions set forth in the report and the plea agreement. As a condition of probation, respondent is sentenced to five months in the Pasco County Jail; however the jail sentence shall be suspended pending respondent's compliance with the terms and conditions set forth in the referee's report and the plea agreement. Miguel A. Perez shall pay restitution in the amount of $4,200.00 to Loretta Jane Wimpelberg and in the amount of $4,759.00 to Joseph Jahelka under the terms and conditions set forth in the report and the plea agreement. Miguel A. Perez shall provide a monthly written report to the UPL Department of The Florida Bar detailing the petitioner to whom restitution has been made and the amounts paid. Further, judgment is ordered for the State of Florida for a civil penalty in the amount of $2,500.00, from Miguel A. Perez, for which sum let execution issue. Respondent shall submit payment of the civil penalty to the UPL Department of The Florida Bar, payable to the Supreme Court of Florida, as provided in Rule Regulating the Florida Bar 10-7.1(f)(2). If Respondent fails to submit payment of the civil penalty within one year from the date of this order, the matter will be turned over to the Florida Department of Financial Services for collection. Respondent shall not engage in the unlicensed practice of law. Further, the Cease and Desist Affidavit, enjoining respondent from engaging in the unlicensed practice of law in Florida, shall continue in its present form. Respondent is further directed to comply with all other terms and conditions set forth in the referee's report and the plea agreement. Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Miguel A. Perez in the amount of $900.00, for which sum let execution issue. Not final until time expires to file motion for rehearing and, if filed, determined. It is so ordered. |

According to The Florida Bar's Petition for Indirect Criminal Contempt, which is under oath and was filed with this court on November 4, 2010, a copy of which is attached hereto and made a part hereof by reference, it has been alleged that you have willfully violated the Cease and Desist Affidavit and that you may be in indirect criminal contempt. THEREFORE, pursuant to Rule 3.840, Florida Rules of Criminal Procedure, you are hereby commanded to appear before the Honorable Wayne L. Cobb (Senior Judge), 38053 Live Oak Avenue, Courtroom C, Dade City, Florida 33523 at 9:30 a.m. on Friday, July 15, 2011, to show cause why you should not be held in indirect criminal contempt of this court and punished accordingly. You are hereby advised that you will be arraigned at the time of the hearing set herein. You have the right to be represented by counsel. If you are indigent and request counsel, an attorney will be appointed to represent you. You are also entitled to have compulsory process for the attendance of witnesses and to testify in your own defense.
