Description | Order ~ By Order of May 2, 2022, this Court ordered Appellant to show cause why we should not dismiss this appeal, as the order appealed did not appear to be a final order or an appealable non-final order. Appellant responded, arguing that, while the part of the appealed order granting Appellee’s motion for attorney’s fees was not appealable because it did not determine a fee amount, the part of the order denying its claim for entitlement to attorney’s fees was an appealable final order. The response, though, indicates that the parties filed competing motions for attorney’s fees, such that the grant of one motion determining which party prevailed was dispositive of the other motion. Accordingly, Appellee is ordered to reply to Appellant’s response, within ten days. Appellee shall address whether the two motions for attorney’s fees should be treated essentially as joint motions for the trial court to determine entitlement to fees, whereby once the trial court renders a fee judgment in favor of Appellee, Appellant will be able to appeal that judgment and argue for reversal and, if successful, a remand with instruction that the trial court determine the amount of fees to be awarded to Appellant. |

Description | Transfer 4th Circuit Case to 5th DCA ~ Beginning January 1, 2023, the Fifth District Court of Appeal will have jurisdiction over matters originating in the Fourth Judicial Circuit. Ch. 22-163, Laws of Fla. By order of the Florida Supreme Court, effective January 1, 2023, the First District shall transfer to the Fifth District Court of Appeal any pending cases originating from the Fourth Judicial Circuit. In re: Implementation of a Sixth District Court of Appeal and Realignment of the Jurisdictional Boundaries of Other Appellate Districts, Fla. Admin. Order No. AOSC22-81 (November 1, 2022).Because the time for briefing this appeal will not conclude before January 1, 2023, the Court notifies all parties and any attorneys of record that this case will transfer to the Fifth District Court of Appeal, on January 1, 2023. No further order will issue to effectuate the transfer. This Court will accept filings in this case until 11:59:59 p.m. on December 31, 2022.
