ORD-SUA SPONTE ~ In this petition for writ of certiorari, Petitioners Michael Clare, M.D., and Florida Orthopaedic Institute ask this court to quash the trial court's ruling that reinstated the complaint of Respondent Maria Johnson Lynch. The gravamen of the parties' dispute arises from the proper application of the 2013 amendments to section 766.102(5), Florida Statutes, concerning who is qualified to provide a corroborating expert opinion in medical malpractice actions. However, on February 16, 2017, the Florida Supreme Court issued its decision in In re Amendments to the Florida Evidence Code, No. SC16-181 (Fla. Feb. 16, 2017), in which the court specifically declined to adopt the 2013 amendments to section 766.102(5) to the extent that they are procedural. Therefore, within twenty (20) days from the date of this order, Petitioners shall file a supplemental petition with this court explaining the effect, if any, of the decision in In re Amendments to the issues before this court. Respondent shall file a supplemental response within twenty (20) days of the date the Petitioners' supplemental petition is filed. Petitioners may file a supplemental reply within 10 days of the Respondent's supplemental response.
