TODAYS DATE : XX/XX/XXXX CREDIT COUNSEL INC XXXX Your company have violated FCRA 615 ( f ) ( 15 U.S.C. 1681m ( f ) ) ( f ) Prohibition on sale or transfer of debt caused by identity theft You have not responded to my request to provide me with an investigation report.
I need this resolve, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence ( 1 ) In general No person ( company ) shall sell, transfer for consideration, or place for collection a debt that such person has been notified under section 1681c-2 of this title has resulted from identity theft.
( 2 ) Applicability The prohibitions of this subsection shall apply to all persons collecting a debt described in paragraph ( 1 ) after the date of a notification under paragraph ( 1 ).
( 3 ) Rule of construction Nothing in this subsection shall be construed to prohibit -- ( A ) The repurchase of a debt in any case in which the assignee of the debt requires such repurchase because the debt has resulted from identity theft ; ( B ) the securitization of a debt or the pledging of a portfolio of debt as collateral in connection with a borrowing ; or ( C ) the transfer of debt as a result of a merger, acquisition, purchase and assumption transaction, or transfer of substantially all of the assets of an entity.
A person that furnishes information to any consumer reporting agency shall have in place reasonable procedures to respond to any notification that it receives from a consumer reporting agency under section 1681c-2 of this title relating to information resulting from identity theft, to prevent that person from refurnishing such blocked information.

On XX/XX/2022 at XXXX, I called Credit Counsel Inc XXXX XXXX ) XXXX, a debt collector representing XXXX XXXX XXXX in reference to a collections account in the amount of {$280.00}. I offered to pay the amount owed. The response from the guy was that the amount owed is almost {$700.00}. I asked how is that possible, and he said that administration fees are being charged. I told him that I understand that they are a business and need to make money, but {$700.00} on a {$280.00} debt seems to be a bit overkill. As a business owner myself, I offered to pay them {$350.00}, as I thought that {$65.00} would be a reasonable " administrative '' fee for them. He refused, I then asked if he could break up the amount that he was asking into smaller payments and he refused as well. I then impolitely told him that I guess we will just play the waiting game and wait until it falls off my credit and then no one gets paid. Also keep in mind that this a medical bill, and I was out of work for a significant amount of time, hence the reason this account went to collections.

I underwent XXXX and paid out of pocket. Before the procedure I inquired about the price and was given a price in writing. The morning of the procedure I was asked to pay {$420.00} more than I was told. I paid under duress and told them that I disputed the price difference. They told me to contact the doctor 's office who gave me the price. I contacted them after the XXXX and they said to speak with the XXXX center, who sent me back to the doctor 's office. I disputed the price difference of {$420.00} with my credit card company because I was told the price well in advance and it's not my fault they were wrong. I received the first collection letter from this company dated XX/XX/XXXX and immediately replied in writing asking them to validate the debt and to cease all collection efforts. THEY CONTINUE TO HARASS ME VIA EMAIL in direct violation of my written request for them to cease contacting me in accordance with the FCRA. I have received email correspondence from them as recently as XX/XX/XXXX. In XX/XX/XXXX, the administrator of the doctor 's office who initially gave me the quote sent me proof that the account was zeroed out. In XX/XX/XXXX, I discovered that this company FRAUDULENTLY reported the account as delinquent to XXXX. I initiated a dispute and they removed the item from my credit report. Now, in XX/XX/XXXX, I just learned that FOR THE SECOND TIME, they have reported this account as delinquent to a DIFFERENT reporting agency, this time to XXXX. This company is using FRAUDULENT AND DECEPTIVE collection tactics to collect money which is was never owed. The most recent report to XXXX already resulted in me being denied for a credit card.

He has been sending me letters and calling me trying to collect a debt from " XXXX XXXX XXXX XXXX '' which I do not owe and after speaking to the XXXX XXXX XXXX corporate office they assured me this company does not represent them and that I do not owe them any money. I have attempted to have this XXXX XXXX understand that there is a mistake but all he does is threaten me with reporting to my credit and insult me calling me a liar and a fraud and that i'm going to pay for this. I have emailed him papers showing I don't owe them but he doesn't care. I have no idea who this guy is and i'm tired of him calling and harassing me its been going on since XXXX of this year and he claims I owe {$5000.00}.

On XXXX 2013, a guy approached my husband at the hospital waiting room meanwhile I was at the XXXX room, convinced him of this equipment rental for my XXXX XXXX, got my credit card and personal information from my husband and disappeared. Stressed as my husband was waiting for the outcome of my XXXX, he thought that this guy belonged to the hospital personnel and he was n't we found out later.
The rented Item was never delivered to my house, being an equipment rental, if it would had been delivered to my house, they would have had to pick it up as well. The pickup never happened because the item was never delivered.
Since the item was charged into my credit card by XXXX XXXX, I called XXXX XXXX XXXX XXXX and told them that I never received the item. After a thorough investigation XXXX XXXX removed the charge from my credit card account.
A year later or more, I received a call from a Collection Agency, Credit Counsel , Inc., trying to get money from me that I never owed. According to this Collection Agency, the debt to a XXXX XXXX XXXX. I told Credit Counsel Inc., what happened again, that the item was never delivered to me.
I also expressed to the Collection Agency, that if they had bought a debt that never existed from XXXX XXXX, they were supposed to take it against XXXX XXXX and not harass and yell at me, like they were doing every time I answered the telephone.
I just learned from XXXX and XXXX Credit Report Agencies, the complete name of this Collection Agency that was calling me since I had a hard time trying to get their name because whenever I answered the telephone to them, they were always shouting at me and trying to intimidate me to make me pay for something that I did not owe, and do not owe.
According to the Credit Report Agency XXXX, this Collection Agency has LEGALLY CERTIFIED that the debt belongs to me and that I did not pay it.
My question is, how can a company LEGALLY CERTIFIES something that is not true. Moreover, try to hurt my Credit Record where I have always kept an average score of 800 or more, since I do not like to owe, and I pay all my accounts in time.
Based on what criteria Credit Report Agencies, believe Collections Agency statements over customers statements that have never had a collection, and have never paid late.
Why not asking for trustworthy proof before placing a collection in my account. By not requesting proof or support for their allegations, before publishing something that hurt my name and my records, the Credit Report Agencies become accomplice of these type of unscrupulous Collection Agencies.
The same way that we might have not received approval for a credit card or a loan, based on this false information published, there should be a penalty for the Credit Report Agencies and for these Collection Agencies for giving false information to vendors or providers.
Thank you very much for your prompt attention to this matter, and looking forward to hear from you soon since I consider these false accusations in my credit reports to be damaging my image and my reputation.

I had a repair performed on my vehicle at XXXX XXXX XXXX on XX/XX/18 and had a balance due of {$830.00} for this work. I was not aware of the balance, since I never received an invoice from XXXX. I became aware after receiving a debt collection notice from XXXX XXXX at Credit Counsel Inc. on XX/XX/18for {$920.00}. I spoke to the management at XXXX to let them know that I never received an invoice, which would have alerted me to pay and I was disappointed that they sent the bill to collection without even letting me know. They agreed that an error was made and they were supposed to invoice me but never did so due to an oversight. I promptly paid the outstanding balance due to them, which was {$830.00} in person on XX/XX/18. I was assured by XXXX that I no longer owed them any money and that the debt collector will no longer be contacting me for payment. I received a receipt from XXXX, showing the payment made and that the balance on my account is {$0.00}. However, I have received additional correspondence after payment was made from Credit Counsel on XX/XX/18 requesting payment for {$86.00} even though I do not owe this money, as I already paid my debt and resolved the issue with the creditor.
Further, the balance that Credit Counsel Inc. is stating I owe increases with each notice I receive. The initial notice received on XX/XX/18 is {$910.00} which includes {$83.00} in excess of the balance owed to XXXX. An email received on XX/XX/18 indicates I owe {$920.00} ( {$85.00} in excess of the balance owed ). I paid off the debt on XX/XX/18, and received another notice on XX/XX/18 for a total of {$86.00}. When I inquired why this excess amount is owed from Credit Counsel Inc, an explanation or details supporting the claim could not be provided and they only sent the invoice of {$830.00} from XXXX. I also inquired of XXXX on why the amount being charged by the debt collector is higher than the amount owed and the manager, XXXX XXXX, at the XXXX stated that it is not in accordance with their contract for Credit Counsel to charge more than the {$830.00}, since Credit Counsel receives a fee as revenue from the amount collected from the debt.

I had dental services from XX/XX/2012 to XX/XX/2012. At the time I was covered under XXXX. I paid for the remaining balances with my credit card. I submitted paper work for the dentist to be paid directly from the insurance carrier ( XXXX ). You will note that is what happen on the claim form. The dentist indicated that " XXXX paid patient '' at the bottom of the claim form bill.
I was contact recently and ask to pay a bill that was supposed to be paid by the insurance company back in XX/XX/2012. I have subsequently changed employers and insurance carriers. The insurance company does not keep records back that far.
I have asked for a canceled check from the insurance company to show that I cashed any check. They do not show one being cashed my me and the collection agency can produce any documentation showing that I received payment ( other than the handwritten note at the bottom of the bill page ).
I am being as to pay for a service almost XXXX years later with no indication that the bill was submitted to the insurance carrier ( rejected or paid to me XXXX.
This wrong and unethical. The credit collect agency it threaten to submit this claim to the credit reporting agencies to " damage my credit ''. This is also wrong.
The person that made this " threat '' was XXXX or Credit Counsel, Inc ( XXXX, XXXX, FL XXXX ). Email : XXXX.

In XX/XX/2016 we hired a company to do stainless steel ( the most expensive ) to avoid to get rusty or need maintanance ) railing instalation.

We paid {$4000.00} as you can see the attachment. So even the letters that the collection company sent are incorrect since the Balance due is {$16000.00}.
Also the rails are not up to code and we will need to pay another company to do a new one. The problem is not only the rusty.
Check the architect message attached : The engineer-designer needs to review these and incorporate the ADA requirements. This design does not meet the criteria required by current Florida XXXX XXXX - Accessibility and the ADA.
The company XXXX XXXX XXXX ( rail company ) installed materials that are rusty since the day they installed and have parts broken.
I hired a lawyer, XXXX XXXX, to contact XXXX XXXX XXXX and inform that materials have problems and we need change everything or more payments wont be done.
XXXX XXXX XXXX didintchange the material and hired a collection company, CREDIT COUNSEL INC by XXXX XXXX XXXX to collect the money.
XXXX XXXX XXXX : 1 ) calls frequently even being informed to contact the lawyer XXXX XXXX XXXX.
2 ) Does repetitious phone calls that are intended to annoy, abuse, harass any person answering the phone. 4 persons have been insulted by him already.
3 ) He uses profane language 4 ) He threats and screams every time so we hang up the phone.
5 ) Sometimes he calls, start to talk without telling who is and then he starts to scream and use abusive language.
6 ) He send letters with amounts that are not the correct amount that we have to pay after all is fixed.

I made some arrangements with the company before, they first made me numerous calls, they always said if I dont pay they will take legally actions, they told me what was about, but never send me the receipt or prove of my payments or the balance of the debt. I stopped working, I wasnt able to pay the debt, they started calling me, when I wanted to confirm the company of debt, this guy named XXXX XXXX talked to me very rude, he gets angry very quick and doesnt care about your situation, he asked me to shut up and let him talk. This is one of the voice mail that he left : Yep, my final call for XXXX XXXX XXXX XXXX was unfortunately chosen to ignore your obligations to my client XXXX XXXX. You broke the terms of your payment aquarium and you don't return phone calls you don't respond invoices. Full-time job babysitting you Obviously born XXXX XXXX you should need a babysitter this point this is your obligation you got a resolve for years ago Yeah, we know that So we're moving forward legally I'm done with this game XXXX XXXX hours once I don't hear back from you or your attorney by tomorrow the XXXX He is been calling with private numbers, sending emails and I had a report in my credit with this company

The collection on the credit report has not been erased. This debt was paid since XX/XX/2019, and should have never appeared on the credit report as a collection to start with since it was paid.
I told them I want the mistake removed from the credit report ASAP and provided proof of payment. The company verified that payment was received.
I told them I need a letter that states that they received payment and it will be removed from my account. they never replied to me. I am in the process of getting a loan and this is slowing it down. they said they would delete it and they have not and are violating the fair credit reporting act.

I was attending school and failed out of my XXXX class. However, tutuion options was the loan lender. The school name was XXXX XXXX university. I was trying to get my payment lower then XXXX dollars a mount to XXXX tuituion options said i had to call the school back and settled that with them. Well today, I received a call from XXXX today atXXXX XXXX I didn't get tha name of the rep, he was very rude to me, telling me I need a Job, this is why I'm In this situation, he wouldn't let me speak to no other rep, nor get his supervisior name nor put them on the phone he called from the headquarters of the company in XXXX, fl I was able to retrieve the number from the XXXX, fl locattion is the number I called back I explained my situation to the young lady she called him he came back on the line and stated " oh! you have time to hold on when you need to be working fulltime " Go get a Job " I hang up 3 times he kept calling back. Yes! I called the office back several timepraying I can get someone else to answer apparently they have caller ID so he knew it was me and would answer the phone not given his name nor number. These people are trying to collect a debit but are being very rude and nasty in the process calling harrassing the customer is not fair i really need to take action about this matter

I underwent XXXX and paid out of pocket. Before the procedure I inquired about the price and was given a price ( in writing ). The morning of the procedure I was asked to pay {$420.00} more than I was told. Under duress, I paid, but told them I disputed the difference and they told me to contact my doctor 's office, who had given me the pricing. I contacted them after the XXXX and they said I needed to speak with the XXXX center, who sent me back to my doctor. I disputed the amount of {$420.00} with my credit card company because I was told the procedure pricing well in advance and it's not my fault they were wrong. I've spoken with the person who gave me the original quote in writing and they said they've contacted the XXXX center to remove this debt but that was months ago, and the debt is now on my credit report.

I have been harassed daily by a Credit Council , Inc. bill collector, by the name of XXXX XXXX, after making an agreement ( on XX/XX/XXXX ) of how I was to pay a debt for my company. It was initially about {$30000.00} and he brought it up to {$59000.00} for illogical reasons. XXXX XXXX pretended to be a lawyer and told me he would take me to court if I wasn't going to make some sort of agreement with him. So, I paid a lawyer to figure things out. We settled on me making payments of {$1500.00} a month. I have paid a total of {$31000.00}, my latest payment was on XX/XX/XXXX. He has sent me a message threatening to " have a warrant for my arrest '' to scare me into paying him more money. He calls incessantly to my personal phone and office. He insults my staff, uses profanity and gives out my personal information to workers, claiming that I owe him {$50000.00} and he " doesn't know how I am still able to run a business ''. His calls start at XXXX ( before we open the office ) and continue throughout the day, 3 to 7 times in a row.
I am really hoping you can resolve this issue.

on XXXX I received an email from XXXX XXXX who is an employee of Credit Counsel , Inc. for a dispute I have with my divorce lawyer.
XXXX XXXX included my ex-wife in the email.
I called to tell him this was illegal and he proceeded to tell me that he would do it all day long.
The email had the attached letter below : Claim of : XXXX XXXX XXXX Balance due : {$8500.00} Account No. : XXXX NOTICE OF PENDING CLAIM Apparently you have chosen to ignore your obligation to Credit Counsel , Inc . This letter informs you that unless full payment is made within ten ( 10 ) working days after the date of this letter, Credit Counsel , IncXXXX may choose to proceed with legal action against you or refer the account to an attorney in your jurisdiction for immediate action.

I spoke to their customer support and I was informed that the date of service and date of last activity on this account was XX/XX/2013. That is well past seven years and they are in violation of the Fair Credit Reporting Act. I do not wish to pursue an attorney for this violation of the FDCPA but will have to if they do not oblige my request. This company violated my consumer rights and heavily impacted my credit score. This is considered identity theft where I gave no written consent to anyone to use my information. I am exercising my rights. My position is legal based upon sections of the Fair Credit Reporting Act as well as the Fair Debt Collection Practices Act. These laws are to make sure that a level and fair playing field exist to protect American consumers from abusive reporting procedures on credit reports, as well as illegal and deceptive collection practices. I demand that policy be adhered to by all creditors and respective credit reporting agencies. Amended consumer rights Fair Credit Reporting Act Public Law 15 U.S.C. 1681 Fair Debt Collection Practices Act : https : //www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/fair-debt-collection-practices-act-text On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. I have no knowledge of this and want this removed due to fraudulence. According to the Fair Credit Reporting Act, Section 609 ( a ) ( 1 ) ( A ), " It states an entity, company, person and etc. are required by federal law to verify - through the physical verification of the original signed consumer contract - any and all accounts an entity, company, person and etc. post on a credit report. '' And due to Credit Counsel not being able to verify the account numerous of times nor provide any type of proof I would like this removed.
