| Description | ORD-TO FILE RESPONSE ~ Appellant within 6D23-77, 6D23-2670, and 6D23-2859 has notified this court and sought a temporary stay or abatement of no more than ninety days based on the voluntary deployment of J.A.R., an appellee, who is a member of the United States Coast Guard and notified appellant of his voluntary deployment status through July 2024. Pursuant to 50 U.S.C. § 3932, formerly 50 U.S.C. § 522, upon the court’s own motion a stay based on military deployment may be granted and such shall be granted on motion for stay by the deployed party. Deployed appellee has not filed a motion seeking stay in this matter, and this court is not in the position to determine the nature and scope of the deployment for such purposes based on the notice provided by the deployed party to the appellant. Accordingly, within thirty days from the date of this order, the deployed appellee shall respond to the motion and provide any information relevant to this court’s consideration of the necessity of a stay of these appellate proceedings, an anticipated date of the length of such stay, and an indication of whether appellee is able to receive service during deployment or any whether any considerations for the appointment of counsel under the provisions of 50 U.S.C. § 3932 are required. In the interim, appellant’s motions to hold appeals in abeyance based on the deployment status are granted for thirty days from the date of this order.
