ATTENTION XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX This is your FINAL NOTICE regarding your unlawful handling of my credit application dated XX/XX/XXXX, and your violations of multiple federal laws. Your actions, including your illegal demand for income verification and improper use of my credit report, directly contravene the Equal Credit Opportunity Act ( ECOA ), Truth in Lending Act ( TILA ), and Fair Credit Reporting Act ( FCRA ).
I will no longer tolerate your attempts to infringe upon my legally protected rights using internal policies that blatantly disregard federal law.
I. Income Verification Is Unlawful and Unnecessary Under federal law, including 15 U.S.C. 1691 ( ECOA ) and 15 U.S.C. 1601 ( TILA ), a financial institution is bound to assess creditworthiness based solely on the application and supporting information provided therein. Any demand for income verification is an arbitrary and illegal condition.
The application I submitted serves as collateral security under the Federal Reserve Act Section 16 and is legally sufficient for creating credit. XXXX has no legal standing to require proof of income as a condition for approving my application.
XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX : Holds that a promissory note exchanged for credit satisfies all funding requirements. Your insistence on income verification disregards this principle.
XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX : Affirms that lenders must provide lawful and non-discriminatory reasons for denial. Demands for income verification fall outside lawful standards.
XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX : Confirms that lending practices must adhere strictly to federally mandated standards, not arbitrary internal policies.
Your internal bank policies are irrelevant and do not override federal law. You are required to assess the application as submitted, without imposing unauthorized conditions or barriers.
II. Unlawful Denial of Credit Based on Credit Reporting Agencies Your denial letter, which references third-party credit reports, violates 15 U.S.C. 1681a ( i ) ( FCRA ) and 15 U.S.C. 1601 ( TILA ). Under TILA, creditors must base decisions solely on the information in the credit application and not external metrics such as a credit score.
By referencing credit reports and XXXX, despite claiming otherwise, your denial was both contradictory and illegal.

Your actions amount to deceptive business practices in violation of the Federal Trade Commission Act ( 15 U.S.C. 45 ).
Your arbitrary actions infringe upon my constitutionally protected rights, including the right to contract, due process, and equal protection. I am not a minor ; I have the capacity to contract under the law and have provided all necessary documentation to act on behalf of the principal.

I purchased a Chevy HHR for {$8000.00} and financed the vehicle through CIG financial in XXXX of XXXX. I made XXXX payments @ {$260.00} = {$4900.00}. My ex husband took over the car & payments as his name was on it and he could afford it. However, he made no payments. Sometime in XXXX, I started receiving harrassing calls from CIG, which threatened me with criminal action and incarceration for theft, although I was not in possession of the vehicle. The balance CIG claimed was owed on the vehicle was {$5200.00}. they claimed that the I had to pay not only the balance owed, but legal fees since they stated they had initiated legal activities against me and/or my ex-husband. They demanded {$500.00} up front, and monthly payments of {$250.00}. Although I am a single mom, with a child whose medical bills for XXXX totaled {$85000.00}, I took possession of the vehicle, paid the initial {$500.00}. I made XXXX payments @ {$250.00} = {$1700.00}. In XXXX, XXXX, I received a letter from CIG, offering to settle the account for a lesser amount, at lower payments. I immediately contacted them. the representative I had been working with, XXXX XXXX XXXX, tried to threaten and intimidate me into continuing with the original agreement. However, since CIG had offered me this agreement, I stuck to my guns and we changed the contract, so that my monthly amount was now {$160.00}. Although the payment was lowered, the amount owed was not reworked as promised. I made XXXX payments @ {$160.00} = {$340.00}, bringing my total payments to {$2600.00} + XXXX = {$7600.00}. In XXXX of XXXX, the vehicle was totalled in an accident. My insurance company, XXXX paid CIG financial {$2600.00} to settle for the vehicle. This makes the total paid out for the vehicle {$10000.00} I have since recieved letters from CIG Financial threatening me with legal actioin and claiming that I owe a balance of {$2800.00}. They have destroyed my credit, as they refuse to show that any payments have been made on the vehicle, and are showing it as a repossession ( it was never physically repossessed ). They said that even if I paid it off, it would remain so. They have further made XXXX unauthorized hard credit inquiries to my credit report, two within a week of each other. I am frustrated and at the end of my rope ; I do not know what else to do. I have been nothing but cooperative with this company. The payments I made after recovering the vehicle from my ex-husband were made as agreed ; none were ever late. This situation has caused me is XXXX ; I ca n't afford the {$2800.00} and I have no idea what I need to do to put a stop to this.

I XXXX XXXXXXXX purchase a XXXX XXXX XXXX from the AutoNation a XXXX dealership XX/XX/XXXX. XXXX XXXX i was having issues with the vehicle and called autonation and someone advise to take it to XXXX. I took it in for testing. After a few months past the vehicle was Shaking while driving and later on around XXXX or XXXX the vehicle started Smoking! We then took it to XXXX XXXX XXXX in early XXXX. They diagnosis the vehicle and said the XXXX is sludge and needs to be replaced. Advisor XXXX XXXX advise that even though he has warranty they will not cover it due to " Lack or Maintenance '' I then contact XXXX Consumer affairs and they investigate the issue. They pulled up the vehicle history and said XXXX of XXXX the vehicle lack service of 2000 miles and again at 20000 miles. This was before purchasing from autonation. XXXX said they should have never sold that vehicle with and Engine problem. I contact autonation corporate y email and got no response after emailing. I then file a XXXX complaint against the dealership and thats when manager XXXX XXXX contacted me and told me to bring the vehicle in for testing. They also found sludge in the engine. Since XXXX they been researching and the vehicle is still there. My husband has been renting cars totaling {$1300.00} for a full month and now he still does not have any transportation after turning in the rental he also paid the car payment in XXXX XXXX XXXX AutoNation Finance for this car that has and still sitting at autonation with no resolution. My wife spoke to XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX after submitting the oil maintenance receipts of me doing since I got this vehicle back in XX/XX/XXXX. XXXX advised someone will contact us no later than the next day! No response or called! I am still without a vehicle. I need resolution!

I took out an auto loan in XXXX of XXXX, The loan is showing up on other reports as 100 % paid and for id verification, which verifies it is part of public record. The lending company has submitted my documents 3 times to the reporting agencies, with my payment updates but I have yet to see the loan reflected on my reports. I have now paid off my loan and still no reflection on my reports. XXXX, XXXX, XXXX credit agency is under fire for not reporting the report XXXX u please investigate this problem & take matters of making sure this reports please thanks. I have uploaded all the files. By law you must have this report reported on my records. I will include documents showing the account has been paid in full since last XXXX XX/XX/2022 & still not reporting.

The company was notified on, XX/XX/2023, XX/XX/2023 and XX/XX/2023 Via certified and registered mail. regarding notice to provide all documentary evidence from the public and private side from the XXXX per the XXXX accounting principles generally accepted in the XXXX. XXXX has no knowledge of nor has XXXX ever revealed or disclosed to XXXX never intended to agree to or consented to any trust relationship or creation of trust between XXXX and XXXX. CIG Financial is participating in deceptive contracts that DO NOT comply with TILA, BILL OF RIGHTS, BILL OF EXCHANGE ACT OF 1882, 12 USC 5531 ( D ), 15 USC 1962E FALSE OR MISLEADING REPRESENTATIONS, 12 USC 1431, 12 USC1435. According to the regulations set forth by the Federal Communications Commission ( FCC ), I am entitled to request and receive a physical, signed copy of the contract in question.
In accordance with FCC regulations, the specific code or provision that grants me this right is outlined in Title 47 of the Code of Federal Regulations ( CFR ). While I do not have the exact code at hand, it is my understanding that the FCC ensures consumers have access to signed copies of contracts, especially those related to telecommunications and related services.
The lender has failed to comply with all attempts to rectify the situation and has continued to harass and threaten to take the vehicle.
This is a breach of contract and an adverse action for exercising my rights.
