Subtype Order to File Response re Jurisdiction
Description AA - File Statement for Basis of Jurisdiction ~ ORDERED that, within ten (10) days from the date of this order, appellant shall file in this court a brief statement explaining the basis for this court's subject matter jurisdiction over the order appealed in this case, citing supporting legal authorities. Appellant shall specifically address how the October 13, 2021 order is an appealable final or non-final order, as it appears the order lacks words of finality and appears to not fully dispose of all counts contained in the fourth amended complaint. See Mendez v. W. Flagler Fam. Ass'n, 303 So. 2d 1, 5 (Fla. 1974) ("We adhere to the rule that piecemeal appeals should not be permitted where claims are legally interrelated and in substance involve the same transaction."); Paige v. Am. Sec. Ins. Co., 987 So. 2d 128, 129 (Fla. 4th DCA 2008) (holding that an order is not a final judgment when it lacks words of finality). FurtherAppellee may file a response within ten (10) days of service of that statement.

Subtype Order on Filing Fee
Description ORD-Pay Filing Fee-Civil Appeal ~ The jurisdiction of this court was invoked by filing of a Notice of Appeal in the lower tribunal. The $300.00 filing fee required by the applicable rule of procedure and Section 35.22(2)(a), Florida Statutes, is due and payable REGARDLESS OF WHETHER THE APPEAL IS LATER DISMISSED VOLUNTARILY OR ADVERSELY.ORDERED that appellant shall pay the $300.00 filing fee or file the lower tribunal clerk's determination of indigent status in this court within ten (10) days from the date of this order. The fee may be paid electronically through the Florida Courts E-Filing Portal – see the court’s website for details. Failure to comply within the time prescribed will result in dismissal of this cause and may result in the court sanctioning of any party, or the party's attorney, who has not paid the filing fee. The attorney filing the Notice of Appeal has a duty to tender the filing fee to the appellate court when the appeal is initiated. See In Re Payment of Filing Fees, 744 So. 2d 1025 (Fla. 4th DCA 1997). Failure of the attorney to pay will result in referral to the Department of Financial Services for collection.**NOTE: This order does not toll the time for filing any pleadings necessary to prosecute this appeal and no extensions of time will be entertained. Once the fee is paid, it is not refundable. Except for dismissal, this court will take no action in this appeal until the filing fee is paid or until a lower tribunal clerk's determination of indigent status is filed.

Description Miscellaneous Order ~ ORDERED that, upon consideration of appellant’s November 1, 2021 jurisdictional brief, this appeal shall proceed as to only appellee American Van Lines, Inc. Further, ORDERED that this appeal is dismissed for lack of jurisdiction as to only appellee Anthony DiSorbo. See Fla. R. App. P. 9.110(k). The dismissal of the appeal with respect to the claims against Anthony DiSorbo is without prejudice to appellant seeking appellate review of that portion of the trial court's final judgment upon conclusion of the trial court's adjudication of the remaining claims involving that appellee. Biasetti v. Palm Beach Blood Bank, Inc., 654 So. 2d 237, 238 (Fla. 4th DCA 1995) (“If the claims arise out of the same incident, the order dismissing some, but not all, of the counts will not constitute a final appeal, even if the counts involve separate and severable legal theories.”); Duffy v. Realty Growth Invs., 466 So. 2d 257, 258 (Fla. 5th DCA 1985) (“Piecemeal appeals are not permitted where claims are interrelated, involve the same essential circumstances, and the same parties remain in the suit. . . . if a cause of action is pleaded which is not legally or factually interrelated with other pleaded claims, that distinct claim is immediately appealable if the trial court dismisses it with finality.” (citing S.L.T. Warehouse Co. v. Webb, 304 So. 2d 97 (Fla. 1974; Mendez v. W. Flagler Fam. Ass’n, 303 So. 2d 1 (Fla. 1974)).FORST, KLINGENSMITH and KUNTZ, JJ., concur.

Subtype Order on Filing Fee
Description ORD-Pay Filing Fee-Civil Appeal ~ The jurisdiction of this court was invoked by filing of a Notice of Appeal in the lower tribunal. The $300.00 filing fee, or a circuit court clerk's determination of indigent status, did not accompany the Notice of Appeal as required in Florida Rules of Appellate Procedure 9.110(b) and 9.140(a). The filing fee is due and payable at the time of filing REGARDLESS OF WHETHER THE APPEAL IS LATER DISMISSED VOLUNTARILY OR ADVERSELY.ORDERED that appellant shall pay the $300.00 filing fee or file the circuit court clerk's determination of indigent status in this court within ten (10) days from the date of this order. Except for dismissal, this court will take no action in this appeal until the filing fee is paid or until a circuit court clerk's determination of indigent status is filed.
