29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about May 17, 2016, at the above addressed jobsite, employees were found to be over the permissible exposure level and employees were also found to be over the action level: 1) An employee working as a pallet assembler was exposed to a continuous noise at 211% of the permissible daily noise dose (8-hour time weighted average (TWA) sound level of 90 dBA) or and 8-hour TWA sound level of approximately 95.3 dBA during the 431 minute sampling time on May 17, 2016. Exposure calculations include a zero increment for the 49 minutes not sampled. 2) An employee working as a pallet assembler was exposed to a continuous noise at 193% of the permissible daily noise dose (8-hour time weighted average (TWA) sound level of 90 dBA) or and 8-hour TWA sound level of approximately 94.7 dBA during the 436 minute sampling time on May 17, 2016. Exposure calculations include a zero increment for the 44 minutes not sampled. 3) An employee working as a pallet assembler was exposed to a continuous noise at 123% which exceeds the action level of 50% (an 8-hur time weighted average (TWA) sound level of 85 dBA) for instituting a hearing conservation program. The 8-hour TWA sound level was approximately 91.5 dBA during the 434 minute sampling period on May 17, 2016. Exposure calculation included a zero increment for the 46 minutes not sampled. 4) An employee working as a pallet assembler was exposed to a continuous noise at 101% which exceeds the action level of 50% (an 8-hur time weighted average (TWA) sound level of 85 dBA) for instituting a hearing conservation program. The 8-hour TWA sound level was approximately 90.0 dBA during the 397 minute sampling period on May 17, 2016. Exposure calculation included a zero increment for the 83 minutes not sampled. |
