FSC OPINION: Our answer to the certified question is yes: the action permitted by the underage drinker exception in section 768.125 is a negligence action for purposes of the comparative fault statute, section 768.81. We approve the district court's decision to the extent it is consistent with our decision today. We neither approve nor disapprove the district court's conclusions about how fault is to be allocated among the bars and underage patrons involved in this case. It is so ordered.
