Complaint What Happened |
Good day, I am reporting this account because I was working with this company from the beginning. I bought a car brand new but then it started having troubles right after I bought it. I keep sending it back into the dealership for repairs and such until it became so much work. I traded it in for a new car, so I do not have understanding to why my consumer report is reporting a balance I owe on this account. This account is reporting XXXX different balance along with being charged off why? Why is there active payment reporting on my consumer report and it is supposed to be charged off for whatever reason. This is causing me so much stress and I need answers.
Account name : US AUTO CREDIT Account number : XXXX Amounts : $ XXXX {$6500.00}

In XX/XX/XXXX I was contacted by a company I had no knowledge of stating I was late on my auto payment. Apparently my positive account had been sold without my knowledge to a knew creditor. I advised the company I had just made a payment on my vehicle to the place my contract was with. The company it was originally with agreed that my contract would be paid Bi-weekly as that coordinated with my payment schedule and can be seen with the history of receipts as well as my on time payments recorded in my credit report. This company has contacted family members without my authorization, changed my contract without my consent or agreement and calls me constantly harassing and falsifying information. Today XX/XX/XXXX they demanded payment and threatened a repossession which they do almost every time I call. They never advised or had me sign anything agreeing to go back to a weekly payment schedule so now my account is severely behind and they are trying to put me in a financial bind not including embarrassment and harassment, falsifying information on my credit report and their aggressive conversations. Social is : XXXX | Name : XXXX XXXX, I sent a BBB complaint to them because I never got an updated contract from them and instead of responding through the BBB portal they contacted me directly and per the conversation admitted to alternating the contract without consent.

I financed a car XX/XX/XXXX from XXXX XXXX XXXX, a sub-prime lender. We financed about $ XXXX at a very high interest rate ( 16 % ). We paid on the car until we only owed {$1700.00} in principal. Then my wife had to stop working because she had a baby. We asked for the company to work with us and wait 2 months for payment because we were so close to being finished paying, but they would not and they repossessed the vehicle in XX/XX/XXXX or XX/XX/XXXX ( I can not remember exactly but it was right around XX/XX/XXXX ). They charged off the remaining {$1700.00} In XXXX XXXX. Now, they are reporting new late payments in XX/XX/XXXX and XX/XX/XXXX which is hurting my credit and is not allowed on charged off debts.

US Auto Credit employees are contacting my job, family members, and friends sharing my debt information with everyone. They are showing up to every persons home listed in the contract and letting them know personal information also asking personal information in regards to me. When I call to make payments they do n't allow me authorization for automated pay services. Instead, I must go through their rude customer service agents who constantly argue with me unprofessionally about paying my debt. I see no reason to dispute with me when I 'm actually paying for the automobile. I have been receiving this harassment for months and I am no longer allowing this to happen.

Complaint What Happened |
I purchased a 2009 XXXX XXXX about two years ago. I financed the vehicle with US Auto Credit Corp. I recently began to have mechanical issues with the vehicle. The repair costs made it difficult for me to afford my bi-weekly payments. I reached out to US Auto Credit to inform them of the situation and to find out if there were any options available to help me reduce the financial strain to avoid late payments or defaulting on the loan. The only option presented to me was a forbearance. The forbearance wasnt a good option because it would have extended my loan term. The maintenance is going to be required more frequently in the future. The forbearance only provides temporary relief. At this point Ive made over 50 bi-weekly which totals close to {$10000.00}. The interest rate is 26 %. It would be close to impossible for me to pay the car off before it died. Since US Auto Credit didnt have any other options I had to look into refinance options. Luckily my bank approved the refinance but they would only approve {$6600.00} which is the value of the vehicle. I was told the payoff amount was around {$7700.00}. I would have to pay the difference. I didnt have {$1100.00} but I really needed to do this refinance. It lowered my interest rate, payment, and term by almost 50 %. I went back to US Auto to ask if they would write off a portion or reduce my balance. They sent me a settlement offer for {$7100.00}. The loan wouldnt be reported as paid in full but as paid in full- charge off less than balance. They also said that the would issue a XXXX for the any reduction amount greater than {$600.00}. I finally spoke with a supervisor XXXX XXXX who said there wasnt much more they could do. He advised me to continue paying on the car for another year ( {$4400.00} ) and try to refinance at the end of the year. At the end of our conversation he told me that he would have upper management look at it but he was almost positive that they didnt have any other options available. He said hes never seen them offer any other options for situations like mine in the 4 years of his employment. The companys mission statement says the want to help and treat consumers with fairness and dignity. My experience has been the complete opposite. I feel like this company is taking advantage of people with less than perfect credit. I dont feel like the lending practices are designed for you to successfully pay off a loan. And when you get into a situation like mine which I feel was created by their predatory lending practices ... they dont offer viable options to help. They relentlessly demand money and refuse to offer fair resolutions ... leaving you stuck or putting a person into a worse credit situation. I was young with poor credit and I needed a car. This company took complete advantage of that. The dealer made it seem like this company would be doing me a big favor by approving my loan because my credit score was low but I was actually being lied to and taken advantage of. I can only imagine how many people have gone through this and didnt know what to do.

To whom it may concern, I visited XXXX XXXX XXXX on XX/XX/XXXX on recommendation from a family member. I was helped by a man named XXXX. XXXX was overly pleasant, I am guessing a tactic that he uses to get a sale. I expressed my need for a vehicle and we went and looked at a few. I finally settled on a XXXX XXXX XXXX. I was told the price and told that I would have to have a down payment to get the vehicle because the banking institution was requiring it. I told XXXX XXXX did not have a lot of money and I really could not afford to pay a down payment of the suggested {$3000.00} dollars that he wanted me to pay. Ultimately, we settled on {$1200.00} which is what I had left in my account after I got insurance. But the violation was not the price the violation was the fact the salesman pressured me into making a down payment for the dealership 's financial gain. As stated, in statue XXXX CFR XXXX ( i ) which iterates XXXX credit contract is any instrument which evidences or embodies a debt arising from a XXXX XXXX XXXX transaction or a financial sale as defined in paragraphs ( d ) and ( XXXX ), of this section. '' In lament terms, I was never supposed to pay a down payment on this vehicle and the dealership has violated my consumer rights. They never explained to me about the my finance charge which is legally defined in 12 CFR 1026.4. This dealership used deceptive practices to get me into a loan that I was not comfortable with and because US Auto Credit is the institution that allowed the loan to go through, they are equally at fault.

I received a settlement offer earlier this year from US Auto Credit, I was n't sure why they were offering me a settlement since the debt was XXXX in a chapter XXXX bankruptcy over two years ago. A few weeks ago I tried to obtained credit and was denied so I pulled a copy of my credit report and noticed that this account was reporting as a debt owed and no mention of it being a part of a bankruptcy. I sent a debt validation letter to US Auto credit and that responded stating that the debt was XXXX, however, they still tried to collect on the debt as you can see in the letter I received earlier this year. XXXX XXXX credit has clearly intentionally violated a federal law, as on their letter dated XXXX/XXXX/XXXX they state the debt was XXXX on XXXX/XXXX/XXXX but they still attempted to collect the debt.
