Since last XXXX I am getting frequent phone calls from this XXXX XXXX XXXX XXXX. As I do not recognize the number, I will not respond but I will get messages telling me that this is an attempt to collect, I do not have a collector behind my back, my credit is good.
I want for this annoying invasion of privacy and lies to stop and for these people to be exposed and -if the case calls for it- prosecuted.

This actually is in reference to my previous complaint XXXX but apparently you do n't have a way to send additional comments on a complaint. I had n't received a status since last XXXX. Once I submitted to you the documentation that I had already rehabilitated my loan around 2003, XXXX apparently sold my loan & stopped garnishment, I 'm guessing because they were caught in a lie? However, they sold the loan to Van Ru Corporation & now they are threatening garnishment. I have paid twice the principal on this loan, and would now be eligible for forgiveness since I work for a public agency if XXXX had originally negotiated an affordable payment with me in 2003 as they were required to by law.

We contacted Van Ru Credit Corporation after receiving a letter about a XXXX XXXX debt. The letter was issued 4 days after my stepson received his driver 's license. We later received a similar letter from another Debt collector on behalf of XXXX. Except for the inconvenience of getting my stepson ( XXXX XXXX XXXX XXXX and XXXX XXXX XXXX ) to understand why these people insist on talking to him personally about this, it 's easy enough to get dismissed as the social security number they have on file does not match my stepson 's.
The representative at Van Ru advised that they themselves do not track down debtors or look up their addresses. He claimed that they get this from the creditor along with the case. In this case that was XXXX XXXX.
So this is how I am looking at it : XXXX XXXX and XXXX XXXX used exclusively the public availability of an address matching the name of one of their bad customers to assign the debt to that person and pass it to a debt collector. In the case of some foreign name, they enjoy the added benefit of many of them having the same name, many not speaking or understanding English well and most of them fearing any public exposure. Certainly, they might get lucky and find the right person, but in the process falsely accusing other people that happen to have the same name. More likely they rely on that most people will cough up the money even if not owed by them to avoid the things these letters are threatening with.
This is no different than a bank sponsored version of the IRS email/phone scam threatening people with jail etc. if they do n't pay. That scam is estimated to have netted the scammers more than $ 0.5B, so I can see why somebody in a bank thought it would be a good idea. But that does n't make it more acceptable. I hope that it, as in this case targeting minority rarely able to defend themselves, is a coincidence. If not, It just makes the whole thing more despicable This is banks conducting their own flavor of identity theft. I am not sure if this is protected against in FDCPA, as it is not the debt collector actually committing the questionable act - it is the bank acting on incomplete data. With the recent exposure of the business practices of a major bank of loading customers with unnecessary accounts, it is not hard to imagine banks also engaging in this form of scam.
