on XXXX XXXX, my mortgage was discharged but I am being threatened by said company that they want to keep charging me mortgage payments as well as threatening foreclosure. As a documents show my mortgage was released, discharged and reconveyed to the persons legally entitled to. Which is myself and my family. As a natural person, I am to fully enjoy my land without company data mortgage Inc dba Essex mortgage harassing me as they are a debt collector, and have no entitlement to my land. Company has violated FDCPA, with unfair practices titled 15 usc1692c, d, e, f.As documents show i have contacted Essex to cease and desist all communication and stop mailing, and calling, and they did not abide by FDCPA laws. I have a box full of mail from them stating they are debt collectors attempting to collect a debt. According to UCC 9-210 Request for accounting ; Request regarding list of collateral or statement of account. Individual request for accounting form B-210.
( 1 ) " Request '' means a record of a type described in paragraph ( 2 ), ( 3 ), or ( 4 ).
( 2 ) " Request for an accounting '' means a record authenticated by a debtor requesting that the recipient provide an accounting of the unpaid obligations secured by collateral and reasonably identifying the transaction or relationship that is the subject of the request.
( 3 ) " Request regarding a list of collateral '' means a record authenticated by a debtor requesting that the recipient approve or correct a list of what the debtor believes to be the collateral securing an obligation and reasonably identifying the transaction or relationship that is the subject of the request.
( 4 ) " Request regarding a statement of account '' means a record authenticated by a debtor requesting that the recipient approve or correct a statement indicating what the debtor believes to be the aggregate amount of unpaid obligations secured by collateral as of a specified date and reasonably identifying the transaction or relationship that is the subject of the request.
( b ) [ Duty to respond to requests. ] Subject to subsections ( c ), ( d ), ( e ), and ( f ), a secured party, other than a buyer of accounts, chattel paper, payment intangibles, or promissory notes or a consignor, shall comply with a request within 14 days after receipt : ( 1 ) in the case of a request for an accounting, by authenticating and sending to the debtor an accounting; and ( 2 ) in the case of a request regarding a list of collateral or a request regarding a statement of account, by authenticating and sending to the debtor an approval or correction.
Essex has not provided any of this information and strictly sent statements of account.

My loan was transferred to Essex Mortgage shortly after we closed on our home. I have been trying to contact XXXX to get information on my mortgage loan and their phone number is a joke. Every time I call, their auto receptionist asks me of I want to wait on hold or request a callback. Neither option yields any results. When I select the option to wait on hold, I am transferred to a survey to asks about my experience with the rep I just spoke with. The only issue is I never get a chance to speak to a rep. When I select the option to get a callback, the callback never comes. I need answers on my mortage loan and the servicer is no where to be found. This is extremely unprofessional and I don't like having my home in their hands.

As you can see in my previous reports, I have been having difficulty with my mortgage servicer, Essex Mortgage. I will continue reporting them until they approach my problems correctly. I have an FHA loan. I had a previous partial claim established with the last servicer, but once the switch occurred, this company went bonkers. They reported me delinquent and say I have not paid since XX/XX/XXXX, despite the fact I have been paying my mortgage under the agreed reduced amount since XXXX. My credit score dropped back in XXXX, but after working to correct it for several months, it went back up in XXXX -- only to fall by a dismal XXXX points AGAIN in XXXX. I am being reported falsely delinquent and they claim I have missed payments despite me trying to work with them to get my partial claim status back on track. They told me over the phone several times in the beginning of XXXX that I owe a different amount, but I never agreed to this in writing and I have never seen documents stating this. They continue to drag their feet, make my life difficult, and send me the wrong documents. They claim I never completed a partial claim request, but they should have already had my documents. I have receive numerous calls from department managers, telling me they're going to send the documents, but I think it is a ploy to keep me quiet. They send me loan modification documents over and over via email and postage, despite my need for partial claim documents. Until these partial claim documents are filled out, my credit score will suffer. It's like there's two sides to this company. I get someone competent over the phone who submits requests to get these partial claims documents sent, and yet, over email, I receive different documents. The person on the phone with loss mitigation even stated the company went about this all wrong. It feels like they are holding me XXXX. I have worked with HUD to try to fix all of this, and I am doing everything in my power to make this right, but my mortgage servicer is aggressive. There customer service line is terrible. It constantly puts you on hold and then leaves you in a loop. It's impossible to pay online or over the automated system, and so you have to speak with a representative, which is virtually impossible as well due to long holds, conflicting information, and slow callback times. Additionally, the company is telling their employees to ask for positive reviews on XXXX so said employees can enter a XXXX raffle. This is an attempt to move the negative reviews down. This company is awful. I want someone to investigate further, as there are thousands of others who are dealing with this same issue. I do not want a phone call from the department manager. I get conflicting answers from him and his team, only for my issues to not be corrected in a timely manner. I will continue reporting this company until they treat me right.
Also -- they closed my previous mortgage account and opened it under a different name -- XXXX XXXX XXXX or something similar. I can attach a screenshot. They reopened my account under this name, which is why my credit score dropped. I do not know if they're allowed to change their name under my credit report without notifying me first of the change. They are operating under Essex but on my credit report, it says a different name under my mortgage. I have NO missed payments reported on my report, but my credit score dropped anyhow, and the company says I am 275 days late on payments. This is not true. I can provide paperwork that proves I am paying. Lastly, I do not feel the company is applying my payments properly. They're applying my mortgage payments to dates I missed -- XXXX XXXX- XXXX XXXX. They're putting my monthly payment to these past due payments, when FHA is working with them for a partial claim. They are not applying my payments correctly and they continue to send documents with conflicting monthly payment amounts.

I am at the end of my rope with Essex Mortgage. As previously described in previous reports, I was in the middle of forbearance during the servicer switch. The new servicer has tried multiple times to change my loan terms without my written consent, and the reduced payment I have been making since XX/XX/XXXX has continued to be recognized as a partial payment. I never had a problem with that with the old servicer. My funds were applied correctly. On the phone, I have been told I owe {$1200.00} a month, not {$1200.00} a month, but I will not be paying this until I get this loan term in writing. They have told me over the phone I can pay the {$1200.00}, but they fail to follow through based on the statements I have been getting in the mail. I have been promised paperwork laying out these terms for months now, but I continue to receive a loan modification application -- which I do not need to fill out, since the company should have the proper documents from the old servicer.
Additionally, Essex Mortgage has not been honoring my deferment terms set by the old servicer. They have been applying my payments to my past due balance -- which is not how my payments should be applied. Due to the fact that I have an FHA loan, I DO NOT owe the amount deferred during the months of XXXX XXXX to XX/XX/XXXX. My payments should continue being applied to my principal balance -- NOT my past due balance. Payments I have been making have been applied to XXXX XXXX, XXXX XXXX, etc., not the present time. I went under an FHA deferment plan ( verbally over the phone ) back in XXXX of XXXX with the old servicer, where the amount I owed went to the back of the loan at zero percent interest. The new servicer doesn't seem to understand this and continues to send me letters saying I owe the amount of $ XXXX XXXX XXXX XXXX I can not and will not pay this full amount due to the FHA terms.
Essex Mortgage continues to push the legal threshold of what they should be doing as a mortgage servicer. I will continue to report them until someone looks into this properly.

Since Essex Mortgage was moved to a new servicer, I continue to have issues with them.
They will not honor my deferment placed by the previous loan servicer. They continue to drag their feet, saying they will be sending me loan modification paperwork, which I have been hearing about for over a month. In the beginning, they would not honor my trial payments, and I then took action to get this resolved.
Previously, on XXXX XXXX, I was told via email ( and two phone calls with department heads in the loss mitigation department ) that I could continue to pay {$1200.00} every month moving forward, which was the previous trial payment amount as agreed upon with the old servicer.
My monthly statements include an unapplied payment because my payment isn't the in the full amount. However, I never had any issues with this with the past servicer. My payments were recognized as full payments, again, because that was the amount agreed upon. The monthly payment I have been making has been sitting in suspense ( see attached documents. ) I called to inquire why this was occurring, and I was told I owe {$1200.00} each month, not {$1200.00} -- which is a surprise to me. Why was I told I can make a payment of {$1200.00} by several people if that wasn't the case this entire time?
I did NOT approve the payment amount changed. I never asked for it to be changed, and I never signed any paperwork that said this amount would be changing. I was told via email I could continue making the trial payments of {$1200.00}, but then I received another email today saying I owe $ 1268 monthly and $ XXXX to pay off the loan amount. This is not applicable to me -- I have an FHA loan, and when forbearance ends, I do NOT owe this lump sum back. They continue to send me letters saying I owe this amount of $ XXXX by XXXX. I should not have to fill out more loan modification paperwork to get this resolved -- they should have the documents provided by the previous servicer.
Unless I receive otherwise in writing, I am going to continue making the payment of {$1200.00} each month. This confusion should not be happening. I never had a problem until the servicer switched. I would like some clarity on what is actually owed monthly. I would like my deferment terms honored. I will continue to report them until this is resolved. I should not be dealing with this as a first time home buyer who has worked hard to get back on track after XXXX months of unemployment.

XXXXXXXX XXXX sold my mortgage to Essex and never let me know, I was receiving several bills to pay mortgages from several companies so I assumed it was a scam. I called Essex who had sent me a bill and they had no information in the system. It wasnt until after XX/XX/XXXX that my portal was available and I finally called the direct number to essex and my info was in the automated system. The lady told me dont worry I had until XXXX before any late fees would be assessed. At this time i paid {$3000.00} because that is what i was told to pay at closing that is what i received a bill for and I was told that my first and second mortgage were included in one payment. Mind you I have no separate payment stubs in my paperwork for to pay my second mortgage separately. I additionally asked them this at closing and they assured me it was included all in one payment. They showed me the payment stub and said see this is what you send in. I sent it in just like that to XXXX they never check their XXXX XXXX so it just sat there for weeks, so ireceived a final notice via email from essex and thats when i called and found out XXXX sold my mortgage, so i cancelled the check and paid on the online portal the XXXX not knowing they sent over the payment info wrong and Essex separated it and did not tell me also my insurance was almost cancelled because essex deliberately took to long to get my account setup all the while they are telling me dont worry i have until XXXX there would be no fees so dont worry We have plenty of time to correct this.

on XXXX XXXX I put in a complaint for mortgage company Essex mortgage that was responded to, with them saying they sent my request through mail and provided cfpb with a copy and not through the portal for my protection. I have not received any documents for the documents i asked for, of debt validation. According to 15 usc 1692g debt validation, the company has 30 days to respond for the alleged debt. Essex mortgage has not responded with proper documentation or any documentation providing debt validation. Essex mortgage is a debt collector and are also not a financial institution who is able to give loans. There is no proof that this company has loaned me anything. This company violated the Truth in Lending Act by charging a down payment which is against 15 usc 1605.They are violating 15 usc 1692a Fair Debt collection Practices Act. This company is a perfect example of the illegal things these companies are doing by extorting consumers for their hard earned money. I've worked hard to provide for my family. Under 12 cfr 1431 banks aren't allowed to loan money and strictly take me as a fool with their illegal activities. This company has not recorded the deed of warranty and promissory note to county recording office as well which is a violation of federal law as well. I have recordings of no recording at the county recording office as well as a recording of a essex employee telling me they could not find my promissory note for 15 minutes of being on hold they returned with documents with a whole different loan number than mine. This company is in clear violations of laws that pertain to the Truth in Lending Act and shall be penalized as i intend to do with federal litigation. Also I have tried contacted employee named XXXX who did call me on XX/XX/2023 at XXXX to give her call at extension XXXX in which i received no response with messages,4 times as provided on my phone records. I also will be auditing this company.

As of the beginning Essex Mortgage a financials institution that I did not choose to work with ( loan was sold to them ) they have had a miserable conduct to me!
I have called to have a split payment accommodation half of it the first week and second on the third week within the 30 days cycles. They were absolutely mad as soon as I asked that. Not only they refuse to set me up for automatic payments but they were brutally answering to me with no help. They said whatever you pay we don't care we still your monthly payment of XXXX $ at the scheduled date no matter if you pay any portion of it in advance. Due to their technical errors with their wiring system they have been returning my automatic payment back with the excuse of insufficient funds. My Bank statement can verifiy that this is a false reason. However I have had a full fight with them from my XXXX XXXX regarding the XXXX payment. I keep asking to send a wire a same day wire to them they weren't providing me with any info or help. Finally around the end of the month on the XXXX they told me to mail a check to them and I mention to them the long federal holiday ahead ( XXXX ) and that can cause the USPS to delay the check to them, but they told I should be fine. According to my tracking number this has arrived there on the XXXX but their office was closed or maybe the mail man could not find anyone there, I have send them picture of my usps trading number and also my bank statements to verify my ability to pay on time without delay but my calls to them are black listed and they never answer to my Emails. However they pourpesly delay to apply my payment just top report me delinquent late payment to the credit bureaus, that will give them leverage by me being restricted to move over to other mortgage company. I been already denied to refinance my mortgage due to their false reporting to the credit bureaus. That is a false report I was never late.

I had never had a clear information on the payment due date they always gave me misleading info on the due date some were saying is on first some were saying is on XXXX.
Lately there were refusing to take my payment online and asking me to do a manual payment which was me sending a check to them, but they never disclosed any details as far as address or check style. Finally after calling them for the whole month of XXXX begging them to accommodate me with a wire transfer as I was hospitalized they gave me an address on were to mail the payment hoping I was not going to be making it as I keep repeating them Im in the hospital while XXXX of the employe told me that's good for us that way you wont go somewhere else to refinance if you get negative remarks on the credit report.
I gathered my self up violating the doctors orders to stay in hospital and I mailed them a certified mail with a cashier check for next day delivery on the XXXX still being within the 30 days of their due date whether that was on the XXXX or on the XXXX.
However thy decide it to Proces it late and now they put sa negative remark on my credit report. I try to get her from them several time calling writing e-mails disputing with credit bureau but I have no help I have all necessary records on this regard mail receipts and phonically records if needed Credit card companies are reducing me limits or even closing my lines of credit. My new house still under renovation can get financing just because of that, the declining letter from says that .This is affecting my health and my finances very badly.

Recently, I underwent a medical operation which resulted in a significant loss of income, plunging me into a state of financial hardship. In an attempt to mitigate this situation, I reached out to my current servicer, Esssex Mortgage, for assistance. Unfortunately, they informed me that they were unable to provide any help and suggested that I explore options online. Contacted essex mortgage on XXXX and XXXX in regards to my ( HAF ) state provided mortgage payment assistance being applied to my account and all the representatives I've spoken to has advised me no funds were received so I've been in contact with Haf all throughout the month of XXXX and HAF has advised me everytime that the payment was sent on XXXX and is showing received by essex but its not being applied to account now I have accrued late fees and will have my credit impacted due to the payment not being applied my XXXX and XXXX payments were similar showing received on the XXXX of both months and not applied until the XXXX for both months so payments are definitely not being applied once received the last department I spoke with at essex mortgage was the loss mitigation department which the representative i spoke with at first handles the ( HAF ) state payments and was very unhelpful did no research to resolve or escalate problem just looked at the account and provided me with the same information I can see on my end No payment for the month of XXXX
