My monthly payments of {$410.00} are due on the XXXX of each month. I made a payment of {$500.00} on XX/XX/XXXX. I logged in to the website today that the extra funds I paid are in an unapplied account. They have done this on several occasions, this time I decided to call today ( XX/XX/XXXX ). I asked the representative to apply those fund to principal. He stated that he can not and I have to wait until I make the XX/XX/XXXX payment then they can apply to principle. Which is a lie because it has never happened with my prior payments. In addition, thats an extra 30 days of interest that I am being forced to pay on a larger balance and they are holding my extra money. I explained to him that this is unacceptable. I have a DSI loan, by not applying my extra to principle, more interest accrues daily, I pay more interest over the term of the loan and it takes me longer to pay off the loan. They are forcing customers to pay extra interest. When I informed him this isnt legal and I was reported them to the CFPB. He stated to me " it isn't the end of the world '', which is rude. That violates FDCPA. I need to be able to pay extra on principle to payoff my loan faster. This company forces customers to pay extra interest.

on XX/XX/XXXX of this year I paid {$18000.00} down, and on XX/XX/XXXX another {$500.00}, on a XXXX for XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX the engine blew up. i called the lender and they ended up backing out of the deal a week later, and made the car dealer buy back the truck and cancelled the loan. when i bought this truck from XXXX XXXX XXXX they had purchased a third party warranty for the engine and transmission. so i used XXXX XXXX side assistance and had it towed to the nearest XXXX XXXX in order to activate the warranty and see if they are going to cover the repair. the repair facility couldnt look at the truck for several days because their diesel mechanic was attending XXXX that week. during this time the lender cancelled the loan. I asked XXXX to give my money back but they said i cant have it back, because they think its my fault the trucks engine blew up. this truck had problems before I bought it. This truck is clearly a lemon. the XXXX dealership called me a few days ago and said that XXXX called them and is coming to repossess the truck because I do not own it anymore. the XXXX warranty company told the repair shop to breakdown the truck more to find out the cause for the engine failing. ( TXXXX XXXX XXXXp is very slow because they have work backed up because of their mechanic being gone ).

On XX/XX/XXXX I was instructed by XXXX real to sell my car to XXXX and pay the difference as a secondary option instead of surrendering the vehicle. Receiving the quote from XXXX and filling out documents to sell the car, I was told that the associate of sales at XXXX, by the name of XXXX, was giving the loan company an issue, finalizing the sale. XXXX XXXX then pick up the vehicle and sold it to an auction company only to leave me with the remaining debt and no vehicle.
I have repeatedly called them and received no help in regards to this matter. On XX/XX/XXXX I called and spoke with an associate who took my information and reassured me that I would get a call back from the gentleman who handled the purchasing of the vehicle and selling of the vehicle with XXXX. On XX/XX/XXXX I called back again to gain further information on why this debt is still being reported. I spoke with XXXX in the title department and received a call back from XXXX stating that the car was repossessed because I refused to sign a release form with XXXX, which is completely false. My information was sold to another debt company and and is being reflected falsely on my credit report.

This is an on-going issue with this company. I feel as though I am a victim of predatory lending. I have a DSI loan, where interest accumulates daily. I send extra funds in with my payment to reduce my balance so that I pay less interest over the term of the loan. This company never applies the extra money towards interest although my payments are current and often paid early. I called on XX/XX/XXXX and asked that the extra {$81.00} that was being held be applied to my principal balance. They stated that they would put in a ticket to accounting to have it applied. I got my next statement on XX/XX/XXXX. The {$81.00} was still unapplied and the extra that I paid on XX/XX/XXXX was also not applied leaving me an unapplied balance of {$110.00}. I called again on XX/XX/XXXX to ask why funds were not applied to principal, again, he stated that he would put in a ticket and give them XXXX hours. I called back today to check my balance and this is still unchanged. This company is ripping people off and collecting more interest than they should. I feel helpless, I can only call and take their word for what they promise and they never follow through. This is my second time reporting this company to the CFPB for the same issue. They need to be audited and investigated. This is definitely predatory lending. I have attached the statement that shows the monies not applied to the principal.

My Vehicle was repossessed in XXXX of 2021. I never receive the notice of sale as required by Florida law. I have requested a copy of the notice of sale, and all documents related to the auction ( dates, sales price, sales type, location, etc ... ), as well as why the vehicle was transferred in Illinois according to VIN records on XX/XX/XXXX ( did a private sale occur? ). I have not received those documents, which I am entitled to receive by law. I hereby request that they send the documents via the CFPB portal and/or via email at XXXX.
I have serious concerns as to why there is a deficiency on the loan. I need records of the accounting related to this loan, specifically how they calculated the deficiency of {$5200.00} ( reported to credit bureau ). The vehicle was allegedly sold in XXXX of 2021. The auto market was already red hot by XXXX of 2021, and I believe the vehicle was worth substantially more than what they sold the vehicle for at auction. They had offered to sell the car back to me for substantially less than what they received at auction, as full satisfaction of the loan. They received a higher sales price at auction, so why are they pursuing a deficiency?

Credito Real USA is reporting a debt on my consumer report. I disputed the debt, in which they responded to me advising that the debt is owed. I responded to Credito Real USA conditionally accepting their claim and advising them that I wanted to settle the debt as soon as possible and asked for additional information, however they refused to comply with providing me with my request and they refused to remove the debt from my consumer report damaging me and my credit and my family. I have been in honor and they're acting in dishonor making threats that they will not respond to me any further and advising me that my letters to them are " frivolous '' and " repetitive ''. They claim they have answered me via certified mail and failed to provide any tracking number or anything that supports their claim and the debt continues to damage me and my ability to purchase a home for my family and me. I have done all in my power to attempt to ethically pay this debt.
