29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. Two framing employees working on second story trusses, at elevations of six feet or more above the ground, are not being protected from fall hazards by utilizing fall protection systems: The employer fails to assure effective protection against falls as required by the standard, as demonstrated on October 15, 2021, when two employees conducting framing operations on a new construction residential home located at 58 Ranch Land Circle, Lot 51, in St. Johns, Florida, were exposed to the hazard of a 21-foot fall to the ground, in that they were not utilizing fall protection systems. b. Two framing employees working on second story trusses, at elevations of six feet or more above the ground, are not being protected from fall hazards by utilizing fall protection systems: The employer fails to assure effective protection against falls as required by the standard, as demonstrated on October 15, 2021, when two employees conducting framing operations on a new construction residential home located at 58 Ranch Land Circle, Lot 51, in St. Johns, Florida, were exposed to the hazard of a 9-foot fall to the ground, in that they were not utilizing fall protection systems. c. Three framing employees working on the second-flight of a staircase, at elevations of six feet or more above the ground, are not being protected from fall hazards by utilizing fall protection systems: The employer fails to assure effective protection against falls as required by the standard, as demonstrated on October 15, 2021, when three employees used an open-sided staircase contained within a new construction residential home located at 58 Ranch Land Circle, Lot 51, in St. Johns, Florida, were exposed to the hazard of a 6 to 9-foot fall to the lower staircase flight and/or ground below, in that a guardrail system, or other means of fall protection systems, were not utilized. Darcar Construction, LLC, predecessor company to Florida Construction 2020, Inc., was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1420881, Repeat Serious citation number 02, item number 001, and was affirmed as a final order on August 6, 2019, with respect to a workplace located at 6261 - 6259 Camino Drive, Apollo Beach, Florida. Darcar Construction, LLC, predecessor company to Florida Construction 2020, Inc., was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1398583, Serious citation number 01, item number 001a, and was affirmed as a final order on June 26, 2019, with respect to a workplace located at 743 Sea Breeze Lane, Palm Harbor, Florida. |
