Order Denying Rehearing Interim Order ~ On May 5, 2023, the Court entered an order treating Appellant’s April 3, 2023 motion for stay as a motion for review and denying the motion. In treating the motion for stay as a motion for review, the Court did not “den[y] a motion for review that [Appellant] did not file.” “A party seeking to stay a final or nonfinal order pending review first shall file a motion in the lower tribunal,” Fla. R. App. P. 9.310(a), and appellate review of an order on a motion to stay is treated as a motion for review. See Fla. R. App. P. 9.310(f); see also Everett v. Everett, 196 So. 3d 483, 484 (Fla. 1st DCA 2016) (“We treat the motion [for emergency stay] as a motion for review of the lower tribunal’s order denying stay”). Consistent with Rule 9.310, in the “motion for stay,” Appellant “respectfully request[ed] that this Court review the trial court’s March 16, 2023 Order Denying JLC’s Motion to Stay Effect of the Judgment.” As requested, this Court reviewed the circuit court’s order denying a stay. ORDERED that appellant’s May 16, 2023 Motion for Rehearing/Reconsideration of this Court’s May 5, 2023 Non-Final Order Denying Motion to Stay is denied.
