29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about December 4, 2019, at 5770 Houchin St, Naples, FL 34109, the employer did not administer a continuing, effective hearing conservation program whenever employee noise exposures equaled or exceeded the 8-hour time-weighted average action level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. The following monitored employees exceeded the action level (all exposure calculations included a zero increment for the time not sampled) ,for an employee who was exposed to continuous noise of 88.2 dBA or the equivalent noise dose of 78% during the 406 minute sampling period. b) On or about December 4, 2019, at 5770 Houchin St, Naples, FL 34109, the employer did not administer a continuing, effective hearing conservation program whenever employee noise exposures equaled or exceeded the 8-hour time-weighted average action level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. The following monitored employees exceeded the action level (all exposure calculations included a zero increment for the time not sampled) ,for an employee who was exposed to continuous noise of 88.6 dBA or the equivalent noise dose of 82.8% during the 358 minute sampling period. c) On or about December 4, 2019, at 5770 Houchin St, Naples, FL 34109, the employer did not administer a continuing, effective hearing conservation program whenever employee noise exposures equaled or exceeded the 8-hour time-weighted average action level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. The following monitored employees exceeded the action level (all exposure calculations included a zero increment for the time not sampled) ,for an employee who was exposed to continuous noise of 95.4 dBA or the equivalent noise dose of 214.3% during the 394 minute sampling period. |

29 CFR 1910.1000(c): An employee(s) was exposed to chemical(s) in excess of the 8-hour time weighted average limits listed in Table Z-3: a) On or about December 4, 2019, at 5770 Houchin St, Naples, FL 34109, the following monitored employees were overexposed to dust containing Silica in excess of the PEL (all calculations assumed zero exposure for the unsampled period of time), for an employee who was exposed to Silica (Mixed Crystalline Respirable Fraction) at an 8-hour time-weighted average of 240 micrograms per meter of air, approximately 4.84 times the PEL of 50 micrograms per meter of air. Sampling was performed for 390 minutes. b) On or about December 4, 2019, at 5770 Houchin St, Naples, FL 34109, the following monitored employees were overexposed to dust containing Silica in excess of the PEL (all calculations assumed zero exposure for the unsampled period of time), for an employee who was exposed to Silica (Mixed Crystalline Respirable Fraction) at an 8-hour time-weighted average of 220 micrograms per meter of air, approximately 4.3 times the PEL of 50 micrograms per meter of air.
