Miscellaneous Order ~ Pursuant to section 768.79, Florida Statutes, Appellee moved to recover attorneys' fees incurred during trial. The trial court denied the motion, finding Appellee's Proposal for Settlement ambiguous and unenforceable. The trial court's decision is currently on appeal. Appellee now moves for appellate attorneys' fees pursuant to the same provision. The motion is granted, contingent upon Appellee prevailing on appeal. We remand this matter to the trial court for a determination of the amount of appellate fees to be assessed.
