| Description | Miscellaneous Order ~ Buy and Sell DVC, Inc. and DVC-Rental, LLC (collectively, “DVC”) appeal the trial court’s order granting in part and denying in part the motion for summary judgment filed by Beatrice Thaxton (“Thaxton”) and DVC Shop, LLC (“DVC Shop”). Because we lack jurisdiction over this non-final order, we dismiss this appeal.Before her departure to start DVC Shop, Thaxton was DVC’s only licensed real estate broker. DVC, like DVC Shop, sells timeshares for Disney Vacation Club. When Thaxton left, DVC sued her, claiming she had illegally taken its clients with her. After allowing DVC multiple efforts to amend its lawsuit, the trial court ultimately dismissed DVC’s third amended complaint for failure to state a claim. This matter is not before us.Meanwhile, Thaxton countersued DVC for conversion. She alleged DVC improperly retained sales commissions she had earned while still employed there. Thaxton moved for summary judgment—she argued no genuine dispute of material fact existed as to the commissions she was owed and outlined the categories of commissions to which she claimed entitlement. The trial court ultimately entered an order granting in part and denying in part Thaxton’s motion for summary judgment. It concluded Thaxton was entitled to commissions earned before her departure but ruled that factual issues remained on sales closed afterwards.We have an independent duty to assess our jurisdiction. See Medeiros v. Firth, 200 So. 3d 121, 122 (Fla. 5th DCA 2016) (citing Almacenes El Globo De Quito, S.A. v. Dalbeta L.C., 181 So. 3d 559, 560 (Fla. 3d DCA 2015)). Here, we lack jurisdiction for two reasons.First, the trial court’s order does not contain the requisite language of finality. An order that merely grants a motion for summary judgment, without more, is not a final order. See Boyd v. Goff, 828 So. 2d 468, 469 (Fla. 5th DCA 2002). It must contain language that enters judgment. Ball v. Genesis Outsourcing Solutions, LLC, 174 So. 3d 498, 499 (Fla. 3d DCA 2015). To the extent a trial court’s order only grants summary judgment, such order merely establishes an entitlement to judgment, but is not itself a judgment. See Lidsky Vaccaro & Montes, P.A. v. Morejon, 813 So. 2d 146, 149 (Fla. 3d DCA 2002). The trial court’s order merely grants Thaxton’s motion in part, and it does not entitle her to execute on a judgment.Second, even if we could view the order as a judgment, it would be a partial final judgment because it only disposes of part of Thaxton’s conversion claim. Florida Rule of Appellate Procedure 9.110(k) allows for our consideration of partial final judgments in two situations: First, when it disposes of a separate and distinct cause of action not interdependent with other pleaded claims, and second, when it totally disposes of an entire case as to any party. See Fla. R. App. P. 9.110(k). Neither applies here. Instead, the trial court’s order explicitly found a genuine issue of material fact remained as to Thaxton’s only claim. For this reason, we dismiss this appeal as premature. |
