Description DISP-MANDAMUS DY ~ Glenton Gilzean, Jr., petitions us for a writ of mandamus directing the Secretary of State and the Elections Canvassing Commission of the State of Florida to refrain from canvassing or reporting the votes now being cast on the initiative that is Proposed Amendment 3 on the ballot for the general election of November 3, 2020. Either that, he says, or we ought to direct the Elections Canvassing Commission not to certify the election results as to Proposed Amendment 3 when the voting is done. We have jurisdiction. See Art. V, § 3(b)(8), Fla. Const. To be entitled to mandamus relief, "the petitioner must have a clear legal right to the requested relief, the respondent must have an indisputable legal duty to perform the requested action, and the petitioner must have no other adequate remedy available." Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000); see also Pleus v. Crist, 14 So. 3d 941, 945 (Fla. 2009). Because Petitioner has failed to demonstrate any of those things, we deny the Petition. No motion for rehearing, clarification or reinstatement will be entertained by this Court.

The full text of the Attorney General's letter is attached hereto as an exhibit and made a part thereof. On August 23, 2019, the Financial Impact Estimating Conference, in accordance with the provisions of section 100.371(5)(a), Florida Statutes, forwarded to the Office of the Attorney General a financial impact statement on the initiative petition. Section 16.061(3), Florida Statutes, provides for this Honorable Court to review the financial impact statement to determine whether it is in accordance with section 100.371, Florida Statutes. IT IS, THEREFORE, the order of the Court that interested parties must file their responses on or before October 1, 2019 and serve a copy thereof on the Attorney General. Answer briefs must be filed on or before October 16, 2019. Replies must be filed on or before October 28, 2019. Briefs submitted will be available on the Court's public online docket at http://onlinedocketssc.flcourts.org/DocketResults/CaseByYear?CaseNumber=1267 &CaseYear=2019 The Court will make a final determination regarding OA at a later date.
