29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Wet Polisher: On or about March 13, 2024, an employee was exposed to noise dose at levels of 125.2 % (equivalent to an 8-hour time weighted average TWA of 91.6 dBA) which is 2.5 times the action level dose of 50% (equivalent to an 8-hour TWA of 85 dBA) while conducting wet polishing on natural and man-made stone. Results were calculated for a 341-minute sampling period. The employer failed to administer a hearing conservation program to affected employees. |

On or about August 23, 2017, in the fabrication area, the employer failed to developed or implemented a hearing conservation program for the protection of the fabricators who worked in the production area wet and dry polishing, grinding and drilling stone countertops. Representative noise dosimetry showed that fabricators were exposed to noise levels 88.2 dBA which exceeded the action level of an 8 hour time weighted average of 85 dBA. b. On or about August 23, 2017, in the fabrication area, the employer failed to developed or implemented a hearing conservation program for the protection of the fabricators who worked in the production area wet and dry polishing, grinding and drilling stone countertops. Representative noise dosimetry showed that fabricators were exposed to noise levels 87.8 dBA which exceeded the action level of an 8 hour time weighted average of 85 dBA. c. On or about August 23, 2017, in the fabrication area, the employer failed to developed or implemented a hearing conservation program for the protection of the fabricators who worked in the production area wet and dry polishing, grinding and drilling stone countertops.
