29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. Employees performing framing work are not being protected from a 10 feet 7 inches, and higher, fall hazard by use of fall protection system. The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on June 27, 2016, when employees of Trinidad Services Corporation were installing 3rd floor joists of residential building D at 11901 Abess Blvd., Jacksonville, Florida 32225 without fall protections and were exposed to fall hazards of 10 feet 7 inches, and higher, above the surrounding ground. AAC Construction Group, Inc., previously committed a repeat violation of this standard on October 6, 2015, with respect to a workplace at 8649 A.C. Skinner Parkway, Jacksonville, FL, which became a final order on November 30, 2015 (Inspection No. 1095060). AAC Construction Group, Inc., previously committed a serious violation of this standard on April 13, 2015, with respect to a workplace at 8200 Jayme Drive, Winter Garden, FL, which became a final order on November 10, 2015 (Inspection No. 1056575). |

Employees performing roofing work on steep-pitched roofs at elevations are not being protected from a 33-foot fall hazard by use of a fall protection system. Pursuant to CFR 1903.9, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from falls (An abatement plan and periodic progress reports may also be required if the abatement period is more than 90 days). AAC Construction Group, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1056575, citation 01, item number 001, issued on August 12, 2015, with respect to a workplace located at 8200 Jayme Drive, Winter Garden, Florida 34787. The final order date was September 10, 2015. |
