The petition and motion to disqualify make misleading and frivolous arguments. For example, petitioner alleges that the court did not give it permission to respond to respondent’s proposed order. However, the record shows that petitioner filed an objection to the proposed order the day after it was submitted. The court rendered its order 12 days later. The record reflects that the court considered petitioner’s objection as it was addressed in paragraph one of the court’s order. Among other frivolous arguments, petitioner contends that the judge exceeded the scope of rule 2.330(f) because the denial order does not expressly state that the motion is “legally insufficient.” Counsel for petitioner, Agustin Benitez – Florida Bar Number 278130, is hereby cautioned that the filing of false or frivolous pleadings in this Court may result in sanctions and referral to the Florida Bar.
