OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a. On or about May 14, 2015, on a semi-truck trailer, at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound sound barrier wall construction site, a strap which secured a 15,000 pound concrete sound wall panel to the trailer was removed by an employee before the stability of the load was assured, which resulted in the panel falling from the trailer and fatally crushing the employee. |

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a. On or about May 14, 2015, the employer did not instruct their employees in the recognition and avoidance of unsafe conditions in that on a semi-truck trailer, at the Concrete Impressions of Florida, Inc., Interstate I-295 southbound sound barrier wall construction site in Jacksonville, Florida, a web-strap which secured a 15,000 pound concrete sound wall panel to the trailer was prematurely removed by an employee who did not recognize this as an unsafe condition. The concrete panel fell freely and then struck, trapped and killed the employee. |
