Citation text line OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing their jobs duties. a) On or about March 4, 2024, at the orange groove located at Cambria Road and U.S. Highway 27 in Lake Placid, Florida, employees were exposed to the hazard of high heat from the sun during the performance of their job duties, including manual orange harvesting. The Wet Bulb Globe Temperature (WBGT) ranged from 21.6? to 37.1? (70.9? to 98.7?) while working outdoors performing heavy manual labor and wearing long sleeves, long pants, and a hat. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee on his first day at work, experienced heat-related symptoms such as cramps that led to hospitalization and a diagnosis of dehydration and acute kidney injury during the course of his duties.

On or about 04/22/19 at Lake Thomas Rd. in Lake Wales, Florida, an employee suffered a work-related injury and was hospitalized on 04/23/19. The employer was aware of the in-patient hospitalization on 04/23/19. The employer notified OSHA on 04/26/19 at 10:30 AM of the in-patient hospitalization.
