Rehearing denied (OD57) ~ Upon the Court's own motion, the Court's June 2, 2021, Order granting Appellee's entitlement to attorney's fees is hereby vacated. Where the entitlement to fees results from a benefit or service to the estate (as opposed to having prevailed on a claim against the estate), the probate court has exclusive jurisdiction. In re Estate of Udell, 501 So. 2d 1286, 1288 (Fla. 4th DCA 1986); see also Geldi v. MacCabe, 243 So. 3d 360 (Fla. 2d DCA 2018). We therefore deny Appellee's Motion as it pertains to attorney's fees, without prejudice to a determination of entitlement by the circuit court.Accordingly, the pro se Motion for Rehearing, as it also pertains to attorney's fees, is denied as moot. After consideration, the pro se Motion for Rehearing or Reconsideration of the Merits is, likewise, denied. LINDSEY, HENDON and BOKOR, JJ., concur.
