On or about February 9, 2019, employees used a Werner brand forty foot extension ladder to gain access and to egress the roof, the ladder was not extended three (3) feet above the upper landing surface and was not secured to prevent accidental displacement, exposing employees to a thirty (30) foot fall hazard. |

Citation text line | 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on February 9, 2019, when employees of Robert E. White II, Inc. are working on the roof of a three story 4:12 pitch, residence without fall protection and are exposed to falls of approximately 30 feet to the ground below. Robert E. White II, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1209382, citation number 1, item number 1 and was affirmed as a final order on 3/15/2017, with respect to a workplace located at 2780 Duffer Road, Sebring, FL 33872 and was assessed a penalty of $2173.00. |
