29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about June 25, 2019, in the fabrication area, an employee working as fabricator was exposed to continuous noise levels at 107.7% (90.5 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 435 minute sampling period. Zero exposure was assumed for the 45 minute period not sampled. The employer did not have a continuing and effective hearing conservation program. b) On or about June 25, 2019, in the fabrication area, an employee working as fabricator was exposed to continuous noise levels at 80.85% (88.4 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 444 minute sampling period. Zero exposure was assumed for the 36 minute period not sampled. The employer did not have a continuing and effective hearing conservation program. c) On or about June 25, 2019, in the fabrication area, an employee working as fabricator was exposed to continuous noise levels at 76.62% (88.0 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 447 minute sampling period. Zero exposure was assumed for the 33 minute period not sampled. The employer did not have a continuing and effective hearing conservation program. |
