MISCELLANEOUS ORDER (OR999) ~ Appellant’s Response is noted, and is stricken as not responsive to the Court's Order to Show Cause issued on May 25, 2021. Appellant shall show cause, within twenty (20) days from the date of this Order, as to why the appeal should not be dismissed for lack of jurisdiction. The partial judgment reserves jurisdiction to rule on a pending motion and, in essence, to determine the amount of an “additional award of attorney’s fees.” See Yampol v. Turnberry Isle S. Condo. Ass’n, Inc., 250 So. 3d 835, 837 (Fla. 3d DCA 2018) (“An order granting entitlement to attorney’s fees but not determining the amount of fees or costs is a non-final, non-appealable order, and such an order is subject to dismissal for lack of jurisdiction.”) The order on appeal, on its face, does not complete all judicial labor regarding the award of attorney's fees in favor of Appellee and against Appellant. The order expressly states in paragraph 3: With respect to the Court's determination as to an additional award of attorney's fees for the remaining objection “not re FDUPTA against CM" the parties will coordinate a hearing on motion calendar with the Court.Further, paragraph 4 of the order provides: The Court reserves jurisdiction to enforce the terms of this judgment and to further rule on the Motion to Deem Plaintiff’s Objections to Attorney's Fees Waived with respect to the objection “not re FDUPTA against CM". EMAS, C.J., and LOGUE and HENDON, JJ., concur.
