OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklifts without wearing seat belts. a) For the warehouse, on or about 10/14/2022, the employer exposed employees to crushing hazards in the event of a forklift tip-over or being ejected from the forklift, in that, the wearing of seat belts while operating forklifts was not enforced. Employees and managers were observed to not be wearing forklifts while operating them. |

The employer failed to unload, replace or repair damaged racks. The following racks were damaged: Multiple posts in aisles H95, M301 b) On or about 08/23/2021, and at times prior to, employees were exposed to struck by hazards from racking posts that are missing throughout the entire racking system. |
