29 CFR 1926.102(a)(1): The employer does not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. Employees performing roofing work are not protected from eye injuries while using pneumatic nail guns. The employer failed to assure effective protections against eye and face injuries as required by the standard, as demonstrated on July 26, 2017, when two employees working on a residential roof at 12772 Bentwater Drive, Jacksonville, Florida, were not wearing any eye protection while using pneumatic nail guns, exposing themselves to eye injuries from flying debris or nails. SS Kelly Cooperation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1926.102(a)(1), which was contained in OSHA inspection number 902828, citation number 1, item number 1, and was affirmed as a final order on July 2, 2013, with respect to a workplace located at 12168 Chippenham Court, Jacksonville, FL 32211. |

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. Employees performing roofing work are not protected from fall hazards by the use of a fall protection system. The employer failed to assure effective protection against falls, as required by the standard, as demonstrated on July 26, 2017, when three employees working on the north slope of the roof and two employees using a nail guns to install nails on a residential roof with a 6:12 pitch at 12772 Bentwater Drive, Jacksonville, Florida, were exposed to a 10 feet fall hazard to the ground. None of the five employees were attached to a personal fall protection system. SS Kelly Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1234113, citation number 1, item number 1, and was affirmed as a final order on July 25, 2017, with respect to a workplace located at 10628 Quail Ridge Drive, Ponte Vedra Beach, FL 32004. SS Kelly Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 902828, citation number 1, item number 2, and was affirmed as a final order on July 15, 2013, with respect to a workplace located at 12168 Chippenham Court Jacksonville, FL 32211. |
