On Tuesday, XX/XX/2019, I received a phone call from my Connecticut property manager relating to me what he termed a very odd occurrence.He continued to tell me that an individual representing himself to be an attorney was calling to inquire into an alleged debt owed his client, one XXXX XXXX XXXX XXXX , which company had just completed the installation of an elevator in one of my commercial properties in XXXX , CT.Said elevator installation, was much delayed to the tune of almost a year, due entirely to the late ordering of the same by the vendor.There are other issues pending against the elevator installer but for the sake of this complaint, my proprty manager relayed to the alleged attorney the real and true story and that the alleged debt had been paid in full and fully documented and that his client had obviously not been forthright with him and finally {$8000.00} in violative serve contract charges and approximately {$39000.00} in back rent loss due to non performance was owed back to me as contracting party and owner of the subject property.My property manager then proceeded to inquire of the alleged attorney that he should contact Attorney XXXX directly as principal and my property manager was told that that would not be necessary.Upon cessation of the phone call in question, my property manager, XXXX XXXX , relayed to me the conversation and the phone number of the attorney as he was perplexed that it was a XXXX XXXX Florida phone number and area code.When I tried that same number on a few occassions that day, I only procurred a busy signal.On the morning of Wedesday, XX/XX/2019, I called the main number of the entity in question which turns out to be not an attorney, certainly not a Connecticut licensed attorney, but instead JMS Associates Inc , ,a self represented " aggressive '' debt collection agency.I inquired of the receptionist who answered as to who handles the XXXX XXXX account as I as the principal through my property manager, received a phone call from an attorney the day before concerning this matter.After a brief delay, a young man answered the phone and immediately started in by saying by happenstance he had the subject contract in his hand.When I inquired as to who the attorney was that contacted my property manager the day before, he immediately got belligerent, called me in essence a liar and that " You, ( meaning I ) had nothing.As the discussion obviously deteriorated with this most unprofessional tenor, I simply said the full and final payment is well documented and to the contrary sundry sums are owed me and I ended the conversation.This individual then proceeded to call my number several times until finally I picked up with " You are on a recorded line ... can I help you '' and the individual then proceeded to continue his disparaging, wholly unprofessional and belligerent tirade at which time I again hung up.when the individual kept calling the number again, I was forced to simply block and delete at which time I was so disgusted I contacted your distinguished agency and was told that this is the quickest option for me to initiate a complaint.As a Connecticut XXXX XXXX for well over thirty years and also familiar with fair debt collection practices and the State and Federal statues that regulate it, I have never ever been exposed to this level of unprofessional and unlawful vitriol and misconduct.My intention is to ensure that no member of the consuming public be exposed to this malconduct in the future by this entity or any of it's agents, servants and/or employees.Supporting documentation will be attached as a pdf file which was also faxed to the same bsuiness entity after the expiration of the events afore described.Very Truly Yours, XXXX XXXX XXXX XXXX .

A man named XXXX has been harassing me for the past week. The first call I received from him at my office was on XX/XX/year>. His initial message, transcribed by my phone answering service, stated : " Caller advised he is representing XXXX XXXX XXXX XXXX and is calling regarding unpaid invoices. He is requesting a call back from XXXX XXXX within an hour ; caller has threatened to file a lawsuit if he does not receive a call back within that time frame. '' I returned his call that same day to inquire about the issue. He claimed to be the head of the litigation department and threatened to file suit against me. When I asked if he understood the details of the business relationship between XXXX XXXX and myself, he stated that he did not care and insisted I had to pay or he would proceed with legal action. I requested that he send me the invoices so I could clarify the situation. He emailed me invoices I was already familiar with, to which I responded with an explanation of each invoice and previous communications with XXXX XXXX, demonstrating that they were not due as he alleged. I even offered to pay certain invoices, although this was not the agreement I had with XXXX XXXX. However, he ignored my offer and continued to call both my office and personal phone multiple times, harassing me, disrespecting my employees, misrepresenting my character to them and representatives of my phone answering service, and threatening to file suit.
I sent him an email requesting that he cease all communications with me, but he has not complied. Instead, he has continued to send me emails, clearly violating the Fair Debt Collection Practices Act ( FDCPA ) and the Florida Consumer Collection Practices Act ( FCCPA ).
Specifically, under the FDCPA, he is violating 15 U.S.C. 1692c ( c ), which states : " if a consumer notifies a debt collector in writing... that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt. '' There are XXXX exceptions outlined in the statute that do not apply in this case. I requested that he stop communicating with me on XX/XX/year>, at XXXX XXXX ( see email ). However, he contacted me again on the same day at XXXX XXXX and XXXX XXXX, and again on XX/XX/year>, at XXXX XXXX ( see emails ).
Furthermore, under the FCCPA, he is violating Fla. Stat. 559.72 ( 5 ), which prohibits a collection agency from : disclose [ ing ] to a person other than the debtor... information affecting the debtors reputation, whether or not for creditworthiness, with knowledge or reason to know that the other person does not have a legitimate business need for the information. XXXX XXXX has contacted several of my employees and representatives, disclosing that I owe the amounts he claims without acknowledging the legitimate dispute regarding them, which has affected my reputation.
Fla. Stat. 559.72 ( 6 ) further prohibits the disclosure of information concerning a debt known to be reasonably disputed by the debtor without disclosing that fact. XXXX XXXX has informed my employees about the alleged debt without mentioning that I have disputed it and provided proof of the legitimate dispute.
Additionally, Fla. Stat. 559.72 ( 7 ) prohibits : willfully communicat [ ing ] with the debtor... with such frequency as can reasonably be expected to harass the debtor. XXXX XXXX has repeatedly called me and my office, and emailed me constantly over the last XXXX days. I have recorded XXXX calls to my office and at least XXXX emails to myself. His frequent communications have not only been harassing but have also included derogatory language, including a voice message in which he called me a " deadbeat. '' Fla. Stat. 559.72 ( 8 ) also prohibits us [ ing ]... vulgar, or willfully abusive language in communicating with the debtor. XXXX XXXX has used vulgar and abusive language during several calls to my office and myself. As mentioned, he left a voice message calling me a deadbeat and implying that I have no money.
Finally, Fla. Stat. 559.72 ( 10 ) prohibits us [ ing ] a communication that simulates in any manner legal or judicial process or that gives the appearance of being an attorney at law when it is not. In his communications, XXXX XXXX has claimed to be the head of the legal department and has implied that he is either an attorney or authorized to file suit immediately. In his initial message to me via my phone answering service, he stated that I had an hour to call him back or he would file suit within that time frame.
This conduct also violates Fla. Stat. 559.72 ( 12 ), which prohibits orally communicat [ ing ] with a debtor in a manner that gives the false impression or appearance that such person is or is associated with an attorney.
In summary, XXXX XXXX 's actions have not only constituted harassment but have also violated multiple provisions of both the FDCPA and the FCCPA. His continued communication after my request for cessation, the use of derogatory language, and the misrepresentation of his authority raise serious legal concerns. He should be held accountable.

I am a former business owner and owe a balance to XXXX XXXX XXXX They referred my account to a collection agency, and the collectors name is XXXX XXXX from JMS associates. I have been communicating with him and advised him that I wanted to verify the amount owed with the original debtor. Today I received a text message from XXXX XXXX that states I just spoke with XXXX XXXX at XXXX XXXXXXXX. There were no payments made on this account since the check bounced. The balance is {$1200.00}. At this point I have been very patient but its either you agree to the payment plan and start paying {$310.00} a month or I will make a call to the XXXX XXXX XXXX XXXX and get them involved. The choice is yours. XXXX XXXX violated my consumer rights by threatening to call law-enforcement if I didnt start paying the amount he stated in his text message. The above information was copied right from the text message I received. He didnt even give me a chance to reach out to the original debtor and verify the balance owed. This is horrible business practices and violates the fair credit reporting act by threatening a consumer. Something needs to be done to stop these collection agencies from making threats.

XXXX XXXX from JMS Associates ( XXXX ) XXXX called our office asking for XXXX XXXX who is an old associate of this company. The gentleman advised that it was impertinent he speak with XXXX this instant regarding a financing settlement in their office and pushed and used aggressive speech and tactics to try to get me to give away XXXX contact info. I advised him that XXXX no longer worked in this office and he rudely replied again in an aggressive tone that this is the number XXXX provided, as if I was lying about XXXX no longer being affiliated with us and demanding to get his contact info. Once again I said to him that he was calling an office line and that XXXX no longer worked here but that I would take his info and give XXXX the message. We hung up. The next day the same guy calls me with the same tone, I reminded him XXXX no longer worked here but that I did him the favor of giving him his info for him already and that he was not to call this office anymore. He began yelling at me telling me I did no favor for him and that he had every right to call and that I had no idea what I was talking about and proceeded to harass and use aggression and yell at me with rude behavior until I finally hung up. This is a violation of section XXXX which constitutes a {$1500.00} fine. This man # XXXX should not be discussing someone elses debt with me over the phone and telling me about XXXX settlement and I am not the debtor nor is he allowed to use those tactics with the debtor. He also did not identify himself as a debt collector when calling. He said he was a law office calling about a financing settlement. When I look online it is clear this office is a debt collector.

Today starting around XXXX we started getting calls from XXXX XXXX XXXX XXXX . Our bartender answered the phone told this man the owners and managers where not available at this time and if he would give her is name and number she would give it to us when we arrived. He would not just give her his name he was sarcastic and wanted all of her information. She is an employee and this was unnecessary on its own. She gave it to him and after continuing to ask her questions and her telling him she could not help and was very busy, rudely gave her his name and case # XXXX . As soon as I arrived ( manager ) I called him and started by relaying how inappropriate his conversation was and if he needed something to put it in writing to us. He was extremely aggressive and intended on pushing buttons so I told him to just give me the debt information which he never did. I told him not to call and he not only kept calling but calling and threatening to take myself, the owners and bartender to court. Calling me uneducated trash and trying to get my personal information which he has not rights to. I finally called the police they came in and tried to call he would not come to the phone. The police left ( luckily only as far as his car ) and XXXX called again and I had to go to the car and get the officer to come in and handle him. The entire time we waited for the Police to come back in " he was on the phone with his boss '' this man tied up my business line and proceeded to push all of my buttons. He threatened my employer, my staff and my self and I do have plenty of customers that listened to it as he did it.. The officer told him if he had a concern to put it in writing and stop calling us. I was only able to get the name of his company by looking up the phone number on XXXX .
