Citation text line 29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Employees performing painting work are not protected from fall hazards by the use of a fall protection system. The employer fails to assure effective protections against falls as required by the standard, as demonstrated on July 28, 2021, when employee is painting from a residential roofs with a 4:12 and 6:12 pitch at Whirlaway Court Lot 4, Saint Johns, Florida, and is exposed to a 11 feet 6 inches fall hazard to the ground in that they are not attached to a personal fall protection system. Jaguar Drywall of Ponte Vedra Beach Inc., was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1510711, citation number 01, item number 001 and was affirmed as a final order on June 18, 2021, with respect to a workplace located at 12046 Kearney Street, Jacksonville, FL 32256.
