ORD-SUA SPONTE ~ Appellant appeals from an order which, in part, finds Appellee entitled to attorney's fees pursuant to section 57.105, Florida Statutes (2021). An order determining the amount of fees is not included in the record, which would generally deprive this court of jurisdiction to consider the merits of the trial court's entitlement order. See, e.g., Kuttas v. Ritter, 879 So. 2d 3, 8 (Fla. 2d DCA 2004). However, in its brief, Appellee notes that, on July 6, 2022, after Appellant filed his notice of appeal, the trial court entered a final judgment determining the amount of attorney's fees. An order setting an amount of fees awarded matures a prior notice of appeal from a judgment awarding fees and vests an appellate court with jurisdiction to decide the appeal. See, e.g., Easley, McCaleb & Stallings, Ltd. v. Gibbons, 667 So. 2d 988, 989 (Fla. 4th DCA 1996). Accordingly, within three days from the date of this order, Appellant shall make arrangements with the clerk of the circuit court to supplement the record with the final judgment awarding attorney's fees, with the supplemental record to be filed in this court within ten days from the date of this order.
