Order to File Status Report
|
Description |
The Court has reviewed the status report filed by appellee on July 18, 2024, which notes that appellant has made no efforts to set a hearing with the trial court to rule on appellant's multiple statements of evidence or proceedings. Within five days of this order, appellant shall status the Court with his efforts to coordinate and set this hearing. A failure to respond to this order may result in dismissal for failure to prosecute without further notice.

Order
|
Description |
Appellant's first and second motions for enlargement of time to prepare the record and fifth motion for enlargement of time to file combined initial brief are granted in part and denied in part. The trial clerk filed the record on appeal. Therefore, Appellant's motions to enlarge time to prepare the record are denied as moot.
Appellant's fifth motion to enlarge time to file the initial brief is granted. Based on the parties' responses to this Court's order dated November 17, 2023, which include representations that no transcript exists for the trial which took place on December 7, 2022, jurisdiction is relinquished to the trial court for thirty days to rule on Appellant's statements of evidence or proceedings dated July 16, 2023, August 2, 2023, September 15, 2023, November 16, 2023, and February 6, 2024. See Fla. R. App. P. 9.200(b)(5); see also R. 612-15, 650-52, 711-19, 720-21, 733-34. If the trial court can settle and approve Appellant's recollection of what occurred, in whole or in part, then it should enter a statement of evidence or proceedings by the conclusion of the relinquishment period. If it cannot, then it should enter a commensurate order.
Appellant's combined initial brief is due no later than thirty days after the trial court rules on Appellant's multiple statements of evidence or proceedings. The Court notes that Appellant has obtained repeated enlargements, many necessitated by his failure to timely facilitate preparation of the lower court record. Further enlargements of time will be disfavored.
Appellee is ordered to cooperate with Appellant in coordinating a hearing on Appellant's statements of evidence or proceedings so that an extension of this relinquishment period is necessary only in the event of extenuating circumstances for the trial court. Appellee is ordered to status this Court of the parties' efforts to coordinate and set this hearing within seven days of this Order.

Order to File Response
|
Description |
ORD-TO FILE RESPONSE ~ The emergency motion for settlement and approval appears to request that this court operate to settle and approve a statement of evidence pursuant to either Florida Rule of Appellate Procedure 9.200(a)(3) or 9.200(b)(5) as related to a hearing that occurred December 7, 2022. The record on appeal has not yet been transmitted to this court to determine whether operation of either subsection of the rule is appropriate under the circumstances of this case or whether the hearing held that day has been designated for transcription as part of the record on appeal in this case. Regardless, under any circumstance, approvals of stipulated statements where necessary must be accomplished through the lower tribunal and any transmission of such must occur through the clerk of the lower tribunal under the parameters of rule 9.200. Within ten days from the date of this order, appellee shall advise this court whether any pending matters related to an approval of a stipulated statement are before the lower tribunal for resolution under rule 9.200, whether the December 7, 2022, hearing is otherwise available for transcription and inclusion in the record on appeal, and whether any portion of the motion for settlement and approval should be considered as a petition for writ of mandamus to compel the lower tribunal to rule on any pending matters related to the completion of the record and the perfection of this appeal.

Order to Show Cause
|
Description |
ORD-TO SHOW CAUSE ~ Appeal number 23-1127 is brought as an appeal from a nonfinal order pursuant to Florida Rule of Appellate Procedure 9.030(b)(1)(B) and 9.130. Pursuant to Florida Rule of Appellant Procedure 9.130(f), “during the pendency of a review of a nonfinal order, the lower tribunal may proceed with all matters, including trial or final hearing, except that the lower tribunal may not render a final order disposing of the cause pending such review absent leave of the court.” However, appeal number 23-1671 reflects that it is an appeal from a final judgment of foreclosure rendered by the lower tribunal within the same proceedings as those related to the instant nonfinal appeal. Additionally, appeal 23-1838 is an appeal from an order denying a motion for new trial within those proceedings. This court is in receipt of a motion to relinquish jurisdiction in 23-1127 that seeks relinquishment for the purposes of bringing the matter of the trial court’s lack of jurisdiction to render the final judgment to its attention for resolution of that matter and to prevent execution of that judgment. The parties shall, within twenty days from this order show cause why the appeals in 23-1127, 23-1671, and 23-1838 should not be consolidated to be treated as an appeal from the final judgment of foreclosure and related orders. The parties shall specifically address whether the order in 23-1127 is otherwise a nonfinal, nonappealable order and whether the trial court’s final judgment rendered while the appeal in 23-1127 is pending is a nullity. The motion to relinquish is denied without prejudice to the appellant to refile it in 23-1671 in conjunction with its response to the order to show cause. The motion for extension of time to file initial brief is granted for a period of forty-five days from the date of this order.
