FSC-OPINION: Accordingly, we remand this matter to the Commission for further proceedings consistent with our decision, including, if the Commission shall determine that the settlement agreement is in the public interest and fixes fair, just, and reasonable rates in light of the statutory factors, a consideration of the parties' main disagreements reflected in the record. From the order we have, we cannot conclude that the Commission exercised its discretion in accordance with the standards that the Legislature has provided. See Int'l Truck & Engine Corp. v. Cap. Truck, Inc., 872 So. 2d 372, 374 (Fla. 1st DCA 2004) ("An agency action that is arbitrary stands outside the range of discretion delegated to the agency for purposes of review under section 120.68."); § 120.68(7)(e) (allowing for remand when an agency's exercise of discretion, among other things, was "[o]utside the range of discretion delegated to the agency by law" or "[o]therwise in violation of a constitutional or statutory provision"). Subject to any statutory requirements, the form of the proceedings on remand will be up to the Commission, including the decision whether to allow the parties to present additional evidence. It is so ordered.

ORDER-BRIEF SUPPLEMENTATION ~ On September 27, 2022, the Public Service Commission filed its Revised Final Order PSC-2021-0059A-S-EI. The parties are directed to serve supplemental briefs addressing the Revised Final Order, and whether Duke Energy Florida's Clean Energy Connection Program is "fair and reasonable" and does not give "any undue or unreasonable preference or advantage" to any person. § 366.03, Fla. Stat.Petitioner's supplemental initial brief shall be served on or before December 7, 2022. Respondent's supplemental answer brief shall be served 30 days after service of petitioner's supplemental initial brief. The supplemental initial brief and supplemental answer brief shall not exceed 6,500 words. Motions to file enlarged briefs will not be entertained by the Court.

ORDER-OTHER SUBSTANTIVE ~ [...] The order under review is inadequate to an extent that prevents us from deciding the central issue that we have identified. To be clear, we express no position now on the merits of LULAC's challenge. But we believe it is necessary to remand this case and afford the Commission an opportunity to enter a revised final order that adequately explains the agency's findings and reasoning. See § 120.68(6)(a)(1), Fla. Stat. (a reviewing court may "remand the case for further agency proceedings"). Subject to any requirements imposed by law, the form of the proceedings on remand will be up to the Commission, including the decision whether to allow the parties to present additional evidence.It is so ordered.
