I have owned my home since XXXX and have never been required to carry flood insurance. On XX/XX/XXXX, I received by mail a letter from RoundPoint Mortgage Servicing advising that my property was now in a Special Flood Hazard Area due to a flood map revision issued by XXXX. The RoundPoint letter dated XX/XX/XXXX said that if proper evidence of acceptable flood insurance was not received within 45 days of the date of the notice, then they would purchase coverage at my expense effective XX/XX/XXXX.
After receiving the notice, I contacted flood agent, XXXX XXXX who advised that they could not back date a new policy to reflect an effective date of XX/XX/XXXX. XXXX XXXX also advised that in Florida, there is a 15 to 30-day waiting period before a new flood insurance policy could go into effect. On XX/XX/XXXX, I purchased the new flood policy for {$490.00} ( annual premium ) and because of the mandatory wait period it did not go into effect until XX/XX/XXXX.
After submitting proof of the new flood policy, I received from RoundPoint Mortgage Servicing a letter that contained 'Evidence of Lender-Placed Flood Insurance ' with coverage dates of XX/XX/XXXX to XX/XX/XXXX, that listed an annual premium of {$3600.00}.
In doing my own calculations for the lender placed flood insurance, the 43 days ( XX/XX/XXXX to XX/XX/XXXX ) of flood insurance will cost me {$430.00}. The same 43 days with my current flood insurance is {$58.00}.
I contacted RoundPoint Mortgage Servicing several times to dispute the lender placed flood insurance and cost. I explained to them numerous times that I could not purchase a new flood policy with a post date of XX/XX/XXXX and there was a mandatory wait period before the policy could go into effect. In response, I was told I owed for the lender placed insurance and the cost would be divided into monthly payments that would be added to my mortgage payment.

A problem ultimately of Roundpoint 's making ( which I won't get into for the purposes here ), Roundpoint attempted an ACH on an account with insufficient funds. They told me that they would not charge me a late fee themselves, but they would pass along any late fee from the checking account holder ( XXXX XXXX Roundpoint has assessed a {$20.00} fee against me, claiming that XXXX has charged them for the ACH bouncing.
I called XXXX, and they told me that they did not charge Roundpoint over this matter ( or any matter ). They also confirmed the ACH third-party did not charge them either. I asked for documentation on this matter, and the best they could offer is the general policy info. Thankfully, it is very clear : On page 1 of the attachment, under the bolded section header " Elimination of Return Deposited Items Fee '' it states : " Were no longer charging a Return Deposited Items fee. '' So, either XXXX is lying or Roundpoint is. Frankly, it seems clear to me that it is Roundpoint.

HMDA Violation My mortgage was transferred or sold to a privately owned Debt Collector. The Terms, Escrow Payments, Interest Rate, Forced Placed Homeowner 's Insurance where all transferred without my knowledge. The Original Mortgage Note was stamped, appears altered and fraudulent. My Original Mortgage was FHA and was somehow converted to A Conventional Mortgage without my consent or my signature. I don't have a Mortgage Loan Servicer, Just A debt Collector that takes my mortgage payment. This Debt collector doesn't have a functional website for homeowners to view payment History, Escrow, File Damage Claims, View Status of Homeowners Insurance Policy etc. They provide the Homeowner with nothing, merely a " Debt collector ''. Who is responsible for servicing this mortgage?

FEMA redrawn the map in my neighborhood and it was determined to be a flood zone. Round Point Mortgage Servicing LLC sent me a letter dated XX/XX/XXXX but which i received XX/XX/XXXX stating that i needed to get flood insurance as per Floor Disaster Protection.
I proceeded to contact my insurance agency and got a flood insurance as per their request. As per the agent and the insurance company, the policy wont become effective for the next 30 days which will be XX/XX/XXXX Roundpoint Mortgage Servicing received the policy information for payment and they proceed with payment which i saw as well because i got an email confirming that an " Escrow payment '' for the amount of the policy was made.
About a week and half later, i received a letter stating that i needed to purchase flood insurance. Although i knew they had paid it, i called the number on the letter and explained to the person that i already purchased the policy and the lady was able to see that i had done so.
However, the lady stated that my insurance policy needed to be backdated to XX/XX/year> which was even prior to them even drafting the letter that they sent to me. I explained to them there was no way to back date the policy and the lady told me they were going to force place their insurance on my behalf XX/XX/year> i received a letter confirming they purchased the insurance even though i had already purchase mine with the intent to charge me a crazy premium being aware of the policy i had purchased.
There are a couple of problems here. 1 ) They are not recognizing my policy and 2 ) they are stating my policy needed to be backdated before i was even notified by them which is not possible. I read only and i know that is nott correct as there is a 45 day window ( see quoted text below coming from XXXX XXXX XXXXXXXX ) from the date i was notified for me to obtain a policy, yet they are choosing to ignore it on purpose.
" Notice and purchase of coverage. If a national bank or Federal savings association, or a servicer acting on behalf of the bank or savings association, determines at any time during the term of a designated loan, that the building or mobile home and any personal property securing the designated loan is not covered by flood insurance or is covered by flood insurance in an amount less than the amount required under XXXX, then the national bank or Federal savings association, or a servicer acting on its behalf, shall notify the borrower that the borrower should obtain flood insurance, at the borrower 's expense, in an amount at least equal to the amount required under XXXX, for the remaining term of the loan. If the borrower fails to obtain flood insurance within 45 days after notification, then the national bank or Federal savings association, or its servicer, shall purchase insurance on the borrower 's behalf. The national bank or Federal savings association, or its servicer, may charge the borrower for the cost of premiums and fees incurred in purchasing the insurance, including premiums or fees incurred for coverage beginning on the date on which flood insurance coverage lapsed or did not provide a sufficient coverage amount. ''

Following our request for a payoff, RoundPoint Mortgage Servicing provided us a Payoff Statement of the subject loan on our house on XX/XX/2022, with a payoff date of on or before XX/XX/2022. On XX/XX/2022, the loan was timely paid in full with a payoff of {$480000.00}.
Despite our requests RoundPoint Mortgage Servicing has failed and/or refused to provide to us or record a Satisfaction or Release of the subject mortgage even though they were paid in full with the full amount requested of {$480000.00}.
We have now been informed that after being paid in full on XX/XX/2022, RoundPoint Mortgage Servicing fraudulently sold or transferred our consumer loan to XXXX Mortgage who is now seeking double payments and damaging our credit. We have demanded a Satisfaction or Release of Mortgage from Freedom Mortgage in addition to RoundPoint while showing the Payoff and Wire Transfer in the amount requested in the Payoff to both lenders with no response.
In fact, after overpaying 7 days of interest and after an insurance escrow refund, XXXX XXXX and XXXX XXXX are owed a refund of {$1600.00}.

Every year Roundpoint sends me a letter stating that they need my property insurance for my condominium including the Condo Master Policy and the Unit Owners Policy. Every year I submit this information through the portal that they request ( XXXX ) and get a confirmation of receipt. However, Roundpoint still ends up sending me multiple notices claiming they have " not received the current property insurance for your Unit ''.
I have attached evidence of receipt of my insurance policies on XX/XX/2022 from XXXX. I also have separately attached : ( a ) the master association policy ; ( b ) the condominium unit policy including that Roundpoint is listed as the mortgagor ( they send proof of insurance to the mortgagor each year for every single insured party as part of their standard processes ) ; and ( c ) the letter they mailed to me dated XX/XX/2022, more than three weeks since XXXX acknowledged receipt of both policies.
I own multiple properties that are part of a condominium association, but Roundpoint is the only servicer that can not figure out how to directly request the master policy from the association, or do basic due diligence to make sure that policies have been submitted via XXXX Separately, my unit insurer, XXXX, directly sends the policy information to Roundpoint as well.
I am not sure if Roundpoint does this to try to put an insurance policy on the property themselves to make more money or what, but given that this is a recurring annual issue it is probably something systematic to other borrowers.

My loan was transferred from XXXX XXXX to this company I'm filing the complaint about, RoundPoint Mortgage Servicing LLC, ending my pervious relationship with XXXX on XX/XX/year>. In a letter from XXXX I was told that XXXX would communicate to me the information needed to make future payments to though XXXX has yet to provide any information. I've tried several times to contact that by phone, at times waiting on hold upwards of XXXX minutes to no avail. Meaning, I was never successful in getting though to any live agent. The one time I was able to get through, the agent asked for my name and as I was giving it, I was disconnected. I've tried communicating with them on their XXXX page through private messaging. I was told to give my phone number, which I did and that they will call me back that same day. But still no call. Unfortunately I have no choice but to have to make payments through XXXX XXXX, as my previous servicer, XXXX will no longer take payments. I should add that I would need a new account number if I wanted to at least make the payment by snail mail, but I don't have that. This information is supposedly going to be provided by XXXX in a letter. I've yet to receive that letter and at this time I'm only XXXX weeks away from having to make XXXX 's mortgage payment. It's taking me decades to get my credit to the exceptional level and this company could ruin that because of their incompetence. I informed the company through their XXXX private message that I'd be filing a complaint here, however it doesn't appear to bother them as the call I was promised never came and right now I'm extremely stressed due to hurricane Milton rapidly approaching.

XXXX XXXX XXXX ( XXXX ) was hired by XXXX XXXX XXXX to inspect the XXXX XXXX, which is located at XXXX XXXX XXXX in XXXX, Florida, XXXX regard to reported damage involved in a homeowners insurance claim. XXXX XXXX XXXX, P.E., Principal Engineer, inspected the structure and site on XX/XX/2022.
During the inspection, XXXX observed that a section of wood joists and subflooring in the family room and kitchen area had been compromised, making those members no longer able to properly support the intended loads. The observed damage is an unsafe condition that poses a danger to the occupants at the residence. XXXX recommends that access to the kitchen and a section of the family room of the residence be restricted until temporary support or permanent repair of the damaged floor framing is completed, which should be performed in the immediate future.

In early XX/XX/XXXX I received by mail a Escrow analysis document advising that I had an escrow shortage of {$1700.00}. I am retired on a fixed income so it's very important to me that I keep my monthly payments at a fixed amount. For me that's {$1000.00} or less. My monthly payment at the time was {$980.00}. Based on the escrow analysis document, and the escrow shortage, my monthly amount was going to increase to {$1200.00}. To avoid this, on XX/XX/XXXX I mailed Roundpoint the
Escrow shortage amount of {$1700.00} with my monthly payment of {$1000.00} ( an extra {$100.00} to principal ) for a total of {$2800.00}. I then receive the next months mortgage statement for XX/XX/XXXX and it shows my monthly payment amount as {$1200.00}? The statement showed that they received my payment but it was not applied correctly. In XXXX I mailed my normal payment of {$1000.00} and attached a letter stating that my statement was wrong and they didn't apply the funds correctly. I asked them to correct ASAP and to contact me if there were any questions or problems. Never heard from Roundpoint.
I then receive the next months mortgage statement for XX/XX/XXXX and it again shows my monthly payment amount as {$1200.00}? The statement showed that they received my XXXX payment. In XXXX I mailed my normal payment of {$1000.00} and again attached a letter stating that my statement was wrong and they need to correct this immediately and to contact me if there were any questions or problems. Never heard from Roundpoint.
I then receive the next months mortgage statement for XX/XX/XXXX and it again shows my monthly payment amount as {$1200.00} and an amount due of {$1400.00}? The statement showed that they received my XXXX payment and they charged me a late fee of {$21.00}? I have never been late with my payment to Roundpoint mortgage. On XX/XX/XXXX, I called Roundpoint at their customer service number of XXXX. I knew immediately that I reached an offshore call center. I asked the representative to please transfer me to someone in the United States as I had a serious problem with my account and I needed this escrow shortage issue resolved with someone who could actually correct this and not just be a conduit. The representative said they had no way of doing that. They could take the information and pass it along??? I asked for a supervisor or someone that I could escalate this with and was told that I could get a supervisor call back??? I grudgingly went ahead and explained the problem. I told them I wish to file a complaint and that I wanted a Roundpoint manager in the United States to get this resolved. I have been waiting to hear back from anyone at Roundpoint and no one has contacted me.
Yesterday I received my new statement for XX/XX/XXXX and it again shows my monthly payment amount as {$1200.00} and an amount due of {$1600.00}? The statement showed that they received my XXXX payment and they charged me a late fee of {$21.00} again? I have never been late with my payment to Roundpoint mortgage.
I have reached my fill and I am done dealing with these idiots at Roundpoint. This is the second time in less than a year that I have had a serious issue with Roundpoint mortgage. They bought out my loan from the previous lender XXXX XXXX. Roundpoint was difficult to deal with on the previous issue which is why I was hesitant calling them. Based on my previous contact I knew I was going to get incompetent, offshore call center people that couldn't do anything but be a conduit and I wanted to speak directly to a Roundpoint manager in the United States. So now I have been charged two months of late fees even though they received my payment well before the due date. This better not have affected my credit rating as I am going to be really XXXX off. I want this corrected immediately, a credit for the late fees and an apology letter from them advising as such. How are they allowed to operate in this manner and treat excellent customers this way? I have done nothing wrong except for having my mortgage bought out by these losers!

This servicer has repeatedly reached out to us stating that they have been unable to confirm our condo 's master association policy. We have sent this policy to them, and so has the association itself. There is no record of this servicer actually reaching out to the association, and now after us ( and the association ) sending the policy, they are now reaching out to us again claiming they have been unable to get the policy. At this point this servicer is either lazy or does not have the capacity to do basic due diligence. I'm not sure if they're trying to do some sort of scam so that they can issue some sort of self-dealing master policy. Regardless of what it is, I am requesting oversight over this situation so that this servicer realizes the basic responsibilities it has for a conventional loan in a common community.
I am attaching proof of the previous emails that were exchanged, how they also have the contact information of the association, the policy that was sent ( which doesn't expire until XXXX of 2022 ) by both us and the association, and how they somehow still sent another request for this same information.

I am writing to formally lodge a complaint against Roundpoint Mortgage Servicing LLC regarding their handling of my mortgage loan ( XXXX XXXXXXXX XXXX XXXX ). I believe that they have engaged in practices that violate several federal and state laws, including the Real Estate Settlement Procedures Act ( RESPA ), the Fair Debt Collection Practices Act ( FDCPA ), and Florida state laws, among others.
Summary of Issues : 1. Failure to Provide Accurate and Timely Information : Roundpoint Mortgage Servicing LLC has failed to provide me with an accurate and timely reinstatement quote despite multiple requests. This failure has caused significant confusion and stress and may indicate a violation of RESPA Section 6.
2. Misapplication of Payments : Payments I made have not been correctly applied to my account, resulting in incorrect balances, improper fees, and a negative escrow balance. This misapplication of payments is a clear violation of both RESPA and the Truth in Lending Act ( TILA ).
3. Inaccurate Escrow Management : My escrow account has been mishandled, with funds going missing, improper charges being applied, and demands for additional payments without proper justification. Roundpoint Mortgage Servicing LLCs actions appear to violate RESPAs requirements for proper escrow handling.
4. Harassing and Misleading Communication : I have received numerous harassing phone calls, misleading information, and threats of foreclosure from Roundpoint Mortgage Servicing LLC. They have repeatedly refused to provide the necessary information about loan modification and reinstatement, which I believe violates the FDCPA and other relevant laws.
5. Denial of Loan Modification and Refusal to Provide Necessary Information : Roundpoint Mortgage Servicing LLC has consistently denied my requests for loan modification without providing a valid reason or the necessary documentation. This denial may be in violation of the CARES Act, CFPB Mortgage Servicing Rules, and other federal regulations.
6. Inaccurate Credit Reporting and Financial Harm : Due to the mismanagement of my account, I have suffered damage to my credit, resulting in higher interest rates on loans, additional financial burdens, and personal stress. This has directly affected my ability to secure financing for essential needs such as transportation and education.

I can not get a human on the phone to talk about my refinance, they changed the refinance term without my approval, no one will help me from Roundpoint mortgage. I have spent 7 days on hold and sent 50 emails.It went from 30 years saving over XXXX a month of my loan to 25 years saving a little over XXXX a month. That makes no sense, I would have never changed from a 15 year loan to 25 to save a mere XXXX dollars a month.

I have sent number emails and I called Round Point Mortgage. I called on XXXX the XXXX XXXX to advised that my loan was not being reported on my credit report at all. The Loan has been active, current and paid as agreed since XX/XX/XXXX. ( FCRA ) Fair Credit Reporting Act of 1970 requires creditors to provided accurate information listed on the report report. An escrow account was created even though I have responded to and included all the info that was needed when the company sent it's original letter which was in XX/XX/XXXX.
My monthly mortgage payment increased from {$1000.00}. to {$1200.00}. per month without my knowledge for the XX/XX/XXXX payment.
After one hour on the phone I was assured the problem was solved and a refund check would be issued within ten business days. This was in the middle of XX/XX/XXXX. I am still waiting for the check.
The mortgage amount taken in XX/XX/XXXX was still {$1200.00}. Calling the company for the third time, on XX/XX/XXXX, I was on the phone for another hour and I hung up in discuss after being left on hold forever. Several hours later, I got in touch with a supervisor who stated she would return my call by the end of the day on XX/XX/XXXX. I sent an email which was not answered by supervisor on Fri. XX/XX/XXXX On XX/XX/XXXX, another email was sent to the supervisor basically saying I was no longer paying the mortgage until I get a solution from the supervisor. She sent an email back to me apologizing profusely and saying she call with a solution as soon as the escrow dept. got back to her. I t is now, XXXX XXXX on XX/XX/XXXX. I was overdue on my mortgage payment just past 30 days. Roundpoint Mortgage reported it to the credit agencies. This was back in XXXX of 2018, I contacted them in regards to having it removed from my report and they stated that it was against the law for them to do so. Please see attached exhibits A also I called XXXX today at XXXXXXXX XXXX and spoke with XXXX to let them know that Im mailing in a mortgage payment. She stated to me that they have not came to a resolution and if I can be on a payment plan for 6 months and pay {$1500.00} dollars in mortgage payments for those 6 months which was ridiculous to me because Im not even 60 days late and my problem isnt making the payments my problem is the fraudulent activities that took place with this mortgage loan. Therefore they are still trying to get me to refinance or put me on a payment plan and I even been getting emails to refinance FHA mortgage loan, they are truly trying to cover up by misrepresenting false address to FHA connection to obtain insurance property claim and using incorrect mortgage note by changing the parcel ID number and using the mortgage note, FRAUD for Profit, on a loan modification agreement dated XX/XX/2014 which I had no knowledge about the loan modification agreement dated XX/XX/2014 on the back page of the Mortgage document.

Round Point Mortgage self-placed flood insurance on my property without proper notification. I received notice that my property is now in a flood zone. I received this notice on XX/XX/XXXX that XXXX rezoned I think from the city. I immediately got the flood coverage on XX/XX/XXXX. I received notice from lender XX/XX/XXXX with the 45 day notice to get flood or they will self-place flood. I emailed proof of flood to Round Point XX/XX/XXXX day of their notice and to my surprise they placed flood insurance on XX/XX/XXXX. Round point refuses to waive the XXXX flood insurance charge for XXXX and XX/XX/XXXX. After talking to XXXX insurance reps the supervisor called me back. She refused to waive the fee. She said notice was mailed to me on XXXX was after they already placed. She claims letter notice was not grace period and I owe the fee. I asked for backup/documentation of where they paid and placed, and she said can't as I will receive an additional XXXX letters with info but can't send sooner or anything else. I believe even though only 2 days of insurance fees I believe this is wrong and unethical.

Please see attachments XXXX XXXX from Round Point Mortgage call me today asking for a copy of the missing payments and the $ XXXXcheck payment he wanted me to send him a copy of what I had. I ask him about the new money of {$21000.00} he did not give me a concrete answer only to keep referring to the missing funds it appears he was very concerned even gave me his personal phone number to call him back with the information he wanted, really sound suspect to me because when I ask him other questions about the loan he just went back to the missing checks situation. I told him he can email me like he did once before because I like to have everything in black and white but he insisted on calling me over the phone.
