Complaint What Happened Im following up on a complaint against XXXX XXXX and Landmark Strategy Group for practices that I believe violate the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ). According to my agreement with XXXX XXXX, all disputes related to my account were to be resolved through arbitration. However, without my consent or any arbitration proceedings, XXXX XXXX sold my loan to a collection agency, Landmark Strategy Group. In their response they admitted they don't own the debt that it was owned by a collection agency. I believe this act constitutes a breach of contract and violates my rights as a consumer. When I became aware of this issue, I contacted XXXX XXXX and expressed my willingness to repay the debt directly to them. Despite my willingness to settle the debt, XXXX XXXX refused to recall the debt that I believe was sold illegally. Furthermore, in the course of this transaction, XXXX XXXX disclosed my personal information to Landmark Strategy Group without my consent. I believe this is a violation of FCRA Section 604 ( a ) ( 3 ) ( F ), which restricts the dissemination of consumer information without a legitimate business need. Following the acquisition of my loan, Landmark Strategy Group has engaged in harassment in an attempt to collect the alleged debt. They have called me multiple times during work hours and even contacted my workplace directly. They have also threatened to report the debt to credit reporting agencies if I didn't pay them. In order to avoid further harassment and potential harm to my credit report, I felt forced to pay Landmark Strategy Group. I believe these actions constitute violations of FDCPA Section 806 ( 5 ), which prohibits causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number ; FDCPA Section 805 ( a ) ( 1 ), which prohibits communication with a consumer in connection with the collection of any debt at the consumer 's place of employment ; and FDCPA Section 807 ( 5 ), which prohibits the threat to take any action that can not legally be taken or that is not intended to be taken. In light of these concerns, I request that the CFPB investigate these issues and take appropriate action to protect my rights as a consumer. I also ask that XXXX XXXX remove this account from my credit report immediately, as I believe it was wrongly sold and reported to the collection agency.

Complaint What Happened On XX/XX/XXXX the following complaint was submitted : I have attempted to dispute the claimed debt owed multiple times directly with the companies and with the credit reporting agencies to no avail. The companies continue to report unverified collection accounts even after I have asked for verification docs, account statements, original agreement copies, and proof of their legal right to even attempt to collect on the alleged debt - all requests have gone unanswered. I have requested this information in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX with no response. According to the collection companies own websites/consumer portals - my information does not link to a record within their files yet they continue to claim and report thousands of dollars as owed to them to the credit reporting agencies. This fraud and their lack of being able to properly verify the debt should mean that the debt is uncollectible and therefore they should cease reporting the incorrect information and promptly remove the reported info linked to my personal info from all credit reporting agencies. Following this complaint, the collection company marked the account as closed with the credit agencies roughly 10 days after the complaint was made. The company stated they would mark the account as disputed. As of XX/XX/XXXX, the collection account has been reopened and shows an active balance due, the record does not state that I have disputed the account either. Further, the company stated they would send me info on the account and that never happened and it has been over 30 days since my original complaint. XXXX & XXXX XXXX XXXX continues to make false claims that a debt is owed when that debt has failed to have been verified. They are committing fraud at this point and the false claims have severely negatively impacted my credit- legally speaking, this is a damage and loss that I have full right to claim against them. Their actions are fraudulent and are construed to be harassment. They have failed multiple times to adequately respond to the dispute ( XXXX ) and they have failed to properly verify the alleged debt in the allotted time offered to them per FDCPA guidelines. Per FDCPA, FTC, FDIC and CFPB guidelines XXXX XXXX XXXX XXXX XXXX is in violation of Federal regulations and State regulations and must be ordered to close the account, remove all negative remarks from any/all credit reporting and end all collection efforts regarding this alleged debt. Prompt action must be taken to resolve this matter.
