We refinanced our mortgage with new day financial in the fall of XXXX. During the loan process we established that our escrow and are taxes would be prepaid so they could pay for our taxes. This is been going on since XXXX of XXXX I call them several times, every few weeks and get transferred to the escalations team. When I talk to them I get empty promises and lip service about when this issue will be resolved Our taxes are due at the end of XX/XX/XXXX as of today XX/XX/XXXX they have not been paid. I do not want to lose my house over their ineptitude and will be forced to pay out of pocket which means I will being twice for these taxes please help

I attempted to file this with the FTC, but they kept kicking me over to you. I do not have a mortgage with them. this is about deceptive advertising. I'm a XXXX XXXX XXXX and would like to file a complaint against the deceptive advertising of NewDay USA mortgage company. They are advertising for a cash-out Refinance, get {$60000.00} cash-out and also reduce your monthly mortgage payment by {$600.00}. This is impossible. Especially with the higher rates, and adding in another XXXX XXXX fee charge. Just a bait and switch tactic The ads run daily on TV and on their website.
It's a sad day when a veteran owned company ( that's what they also advertise ) takes advantage of our XXXX XXXX military and veterans. Their lives are already hard enough without being taken advantage of by a mortgage company. VA foreclosures are high enough without this kind of nonsense. This is just setting up failure!

NewDay USA Issues timeline : 1. Promised to close in about 2 weeks XXXX XXXXBasic numerals to close provided.
2. Up to XX/XX/XXXX many attempts to contact email, voicemails etc ( little response ) 3. Around XX/XX/XXXX after numerous attempts to make contact the Assistant Vice President Loan Origination tells me that the previous employee was fired.
4. Now requests to unfreeze my credit so he can pull a 2nd credit report?
5. Said he was going to handle the issue personally, about a week or two later then requested again my credit be unfrozen ( 3rd time ).
6. At this point I also requested my loan numbers as I had little faith in what was going on and they were going to buy done points ( etc ) I just just wanted the current/simple numbers as my trust in them was going down with every interaction.
7. No response for over a week and on XXXX almost 2 moths later the numbers were approximately 10/12k higher than first quoted.
8. On XXXX ( Friday ) left a message that I should be his first call on Monday to explain the delta between the two quotes. Assistant Vice President Loan Origination 9. OnXX/XX/XXXX he finally got back with me well over a work week. ( Insanely ) I explained to him that I no longer needed his services and already started a new loan with another company. This company was .25 % lower rate and 10k more cost effective ( basically what I was promised ) by them at the beginning. I already have a closing date and completed my appraisal and everything else ( in a week Ill add ).

I was thinking of refinancing my VA mortgage. I called a few brokers and they quoted over the phone and via email some rates. I decided to call XXXX XXXX, I have seen many of their TV ads. I talked to a XXXX XXXX XXXX XXXX over the phone and asked him to quote his rates for a 30 yr fixed. He informed me that he " did not have the rates '' but if he asked me a few questions that he could give me those rates. I informed him of my approximate credit score and told him that all I want is the rates. I told him I did not wany him to run my credit, He told me that if my credit score was as high as I said that running a credit check would not change them. I gave him the info he needed and after he gave me the rate I told him that I was not interested as the rate was 1 point higher than some of the rates I was quoted. Under no circumstances was I interested. 3 days later I received an loan application all filled out with a loan number, as if I was applying for the loan. They did not even have the courtesy to mask my and my wife 's SSN, I then received a phone call from them asking why I withdrew my application! They have sold my info to other companies because I am getting a phone call from other companies almost daily.I was never told nor did I give them permission to fill out an application, I am sure this effects my credit score and history, they had no right to do this, I feel they are taken advantage of veterans.

NewDay USA was the servicer on my loan and did no pay my Home Owner 's Insurance, with XXXX, so it lapsed in XX/XX/XXXX. I was never informed by NewDay or XXXX, even though NewDay contacted me multiple times per week to encourage me to do a cash-out refinance at a higher rate. They sold my loan to XXXX XXXX later that year. XXXX informed me I didn't have insurance which I assumed was a mistake. I contacted the XXXX and they informed me the premium was never paid and it had lapsed. XXXX in the interim forced me into an expensive policy until I got new coverage. XXXX was no longer writing new policies in Florida due to hurricanes. I also had a multi-policy discount with XXXX. I struggled to find new coverage since I live in Florida and also had a lapse of more than 30 days. I ended up having to pay nearly twice as much for a policy and also pay the interim policy which was more than twice as much. No company involved would take responsibility or contacted me. NewDay said they contacted XXXX numerous times, but they didn't respond which I find hard to believe. NewDay said they were on the do-not-call list for XXXX as well and had to work through Fax.
Additionally, I had refinanced with NewDay USA in XXXX. I told them at the time the RE taxes they were going to collect was low since it was new construction in XXXX and they would go up significantly. They insisted it wouldn't go up that year and they were collecting enough. In XXXX I got a letter saying the escrow was nowhere near enough to cover the RE taxes and my payment skyrocketed to collect for the next year and cover the previous year.

I called them to try to straighten out my escrow account and after being transferred XXXX times to no avail. I mistakenly, said the word XXXX. they hung up on me for swearing, which violated my first amendment rights and it has gone downhill from there. They have showed me nothing but incompetence in handling my escrow account. I need some help dealing with these people due to the fact, I think I am dealing with a DEI situation, and I will not tolerate that. I am a XXXX veteran with an XXXX beacon score and will not have my first amendment rights violated by anyone.
I have owned XXXX homes and this is only my second escrow account and I do not feel I should send anyone additional monies that does not have the ability to distribute them correctly. please assist me with this situation before it gets out of hand.

I made a full principal and interest payment on time but did not make any escrow additions since I already just paid XXXX out of pocket for a years insurance partially because they mishandled my escrow account. These are the people that hung up on me while violating my constitutional rights therefore not getting my account straightened out when I tried to speak with them. I tried to call them today and think I got the man that hung up on me before. He is a condescending pompous incompetent and threatened to hang up again saying I called him stupid, which I did not.They recorded the call and so did I. I sent them a couple XXXX for escrow so they have no reason to report to the bureau, that is on top of the XXXX I sent on XXXX. Please give me some assistance in dealing with these peopleASAP.

After getting their letter, in the mail dated XX/XX/year>, I called them on XX/XX/year>, and they told me they could do this without giving me the time I needed. In their letter and to me over the phone, they lied and took out the payment, when I was working with the new mortgage company ( XXXX XXXX ), over the phone on XX/XX/year>. XXXXXXXX XXXX was working with me, and we were waiting for the full transfer on my new account, which would take place on XX/XX/year>.
I have a copy of the New Day USA letter.
By New Day taking out the funds, left my bank account with less money to pay my other bills, and had to pay many {$30.00} NSFs and checks returned to my car insurance and car payment companies. Now I am behind and have fewer funds.

I conta cted New Day USA for a mortgage refinance on my current mortgaged property.
I was then called 1 m inute later by a sales representative named XXXX XXXX who asked me questions to apply for a mortgage loan with them. First, he says " thank you for your service ''. I hate that. After enough questions he asked to do a credit check and asked me for m y SSN. Unfortunately, I gave him my SSN. XXXX said m y credit score w as XXXX . After asking that only then did he ask about my employment situation and since I have n't worked for an employer in 5 months, he could n't qualify me for the loan. I told him I have investment income ( stocks ) from dividends and I have a job starting on XXXX XXXX . But that was not enough. So, I asked him why could n't he have asked that question prior to running a credit repo rt with my SSN? He said " that is not how it works ''. Well, that should n't be how it works and now my credit is negatively affected and have not been approved for a loan. They hurt veterans, not help them.

Complaint What Happened |
I had a VA mortgage with XXXX and decided to refinance my VA loan with New Day USA in XX/XX/XXXX. New Day USA mismanaged the refinance of our mortgage with XXXX. Our property taxes for XXXX were {$2.00}, XXXX. Our proposed property taxes for XXXX are {$2.00}, XXXX. In XX/XX/XXXX New Day USA assessed our property taxes at a little over {$400.00}. This amount was the taxes on the property before a house was built. The correct amount of the property taxes was available to New Day USA through our former mortgage company and also available with the XXXX XXXX XXXX XXXX. As a result New Day USA was not taking out the proper amount to put in our escrow account. The property taxes are due next month in XXXX. Myself and my fiance are on social security and live paycheck to paycheck and do not have any savings to cover the deficit. New Day USA has only {$690.00} in the escrow account so there's a deficit of XXXX, XXXX. New Day USA is making excuses that we had a huge increase on our taxes which is incorrect. There's a potential increase of {$100.00}. So this is clearly a gross mismanagement of our refinance with New Day USA. So a warning to any consumers thinking about doing business with New Day USA I would not!
