In accordance with the Fair Credit Reporting Act this creditor has violated my rights my rights under the Fair Credit Reporting Act ( FCRA ). As a consumer, I believe that your organization has violated my rights as stipulated in the FCRA, specifically under 15 USC 1681 Section 604 ( a ) Section 2 and 15 USC 166b.
15 USC 1681 Section 604 ( a ) Section 2 of the FCRA outlines the permissible purposes for obtaining a consumer report, restricting access to an individual 's credit report to those with a legitimate and lawful reason. This provision is in place to ensure that sensitive credit information is only accessible to entities with a valid need, such as creditors, employers, insurers, and landlords. Any unauthorized access or use of my credit report may be deemed a violation of this provision.
15 USC 166b is a significant part of the FCRA and sets out requirements for obtaining and using consumer reports for employment purposes. This section aims to protect the rights of consumers, particularly when it comes to their employment opportunities. It obligates employers to adhere to specific guidelines when requesting and using consumer reports for employment screening purposes. Violations of these guidelines can result in a breach of a consumer 's rights.

Dear Consumer Financial Protection Bureau, I am writing to bring to your attention a matter that I believe to be an inaccurate reporting on my credit report by Nissan Motor Acceptance Corporation/Infiniti Financial Services XXXX NMAC/IFS ) XXXX I am confident that this is an error and wish to formally dispute it, hoping you can assist me in this matter.
The issue pertains to a lease account that I had w
ith NMAC/IFS. Throughout the course of the lease, I consistently made my payments on time, ensuring my financial responsibility was upheld. However, it has come to my attention that NMAC/IFS reported negatively against my credit report, which, given my payment history, I believe to be erroneous. To further complicate matters, NMAC/IFS delayed in closing my lease account by a month, even after I had settled the final bill. This delay, coupled with the inaccurate reporting, is having an unjustly adverse effect on my credit score, which I am earnestly trying to maintain in good standing.
I wish to emphasize that I have always upheld my financial obligations with due diligence, and this can be validated by my payment history. I have receipts and bank statements to demonstrate that I made payments on time, and I am prepared to provide these as evidence if required. Furthermore, the payment for the final bill was made promptly, and I have documentation to verify this too.
The misreporting by NMAC/IFS has caused me undue stress and financial hardship as it directly affects my creditworthiness. I believe this issue may simply be an administrative error or oversight, but its impact is far from trivial.
Given the evident discrepancy, I kindly request that the CFPB intervene and assist in rectifying this issue. The inaccurate information should be removed from my credit report, the account should be marked as closed, and my credit score should be corrected to reflect my actual credit history.

One ( 1 ) year ago ( roughly ) NMAC / Nissan failed to bill my new bank in XXXX of XXXX, after switching the second of two vehicles over from XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Nissan in XXXX of XXXX, Submitted for payments to both banks creating a double-payment ( double autopay ) unbeknownst to me at the time. These affect accounts have never been the same since. We have two vehicles both XXXX XXXX 's on of which generally bills on or around the XXXX of each month for a total sum of {$320.00} and the other, on or around the XXXX of the month, for a total sum of {$320.00}, until the discrepancy at hand. Several checks were bounced and what was not included was the times retried which also assess fees. At this time we are just seeking to make our statements correct by not only adjusting their own fees charged in the amounts of {$20.00} and {$16.00} making it look like they are due at any given time {$350.00}, when that isn't the entire picture. There is interest I am certain that the additional {$36.00} has incurred and we would like that also to be accounted for as well and for this account not to be charged anything more than we would have originally had this issue not happened. Back to the initial root of the problem at hand. The double automatic payment occurred when Nissan submitted and both banks remitted payment in the month of XX/XX/XXXX. XXXX Nissan aka NMAC received # XXXX from XXXX XXXX XXXX -- the new bank on XX/XX/XXXX, and then on XX/XX/XXXX, they also received {$320.00} from the old bank, XXXX XXXX XXXXXXXX as well, causing a double payment. But the did not stop there. for XX/XX/XXXX, they tried to collect again, but from the former bank, XXXX XXXX XXXXXXXX, which already hit with fee both from being presented with payments that could not be covered and from the accounts billed that could not collect from funds depleted from the additional withdrawal. Upon noticing this, XXXX XXXX XXXX agreed to recall their payment that had gone through the previous month on XX/XX/XXXX, once they knew about the XX/XX/XXXX payment having already been taking by the new XXXX XXXXXXXX. When they recalled this payment which should have left everything even/correct except for their next pending payment on XX/XX/XXXX, that had not yet cleared ; the reversing the XX/XX/XXXX payment, then caused the pending XX/XX/XXXX that had not completed its posting for XX/XX/XXXX to be dropped. This also would not have been an issue, had Nissan / NMAC submitted payment to the new XXXX XXXX like they did the month prior ( when they established autopay with the new bank ) ; but when XXXX did not initially receive a request for payment per the autopay set up, so they did not fulfill sending one, which is why we went from having a double payment in XX/XX/XXXX, to having no final payment on record initially for XX/XX/XXXX. This was rectified as soon as we realized there wasn't a payment official for the month of XX/XX/XXXX. But that was not due to our neglect. We had set everything up the same on both accounts, and the account that gets billed the XXXX of each month in the amount of {$320.00} had a smooth transition from the first to the second bank -- unlike with the 2nd vehicle whose payments post the XXXX of each month for the amount of {$320.00}. We had no idea what would happen next, whether or not early on if a payment was coming through to the new bank ; and we had been spending all of our time trying to cover all of the bounced items one their first postings or second postings and those fees were putting us further in the hole.

XX/XX/XXXX I went to XXXX XXXX of XXXX and traded my XXXX XXXX XXXX in for a XXXX XXXX XXXX and and it was financed with nissian motor acceptance Corp and I found out XXXX XXXX my car with my credit union that there was 2 accounts open in my name because of the dealership open 2 accounts I am glad I refinance because I would have never knew about this also I canceled my extended warranty and gap coverage with fedilty warranty services on XX/XX/XXXX and they sent the check to nissian so I called nissian and they said I do not get my refund back in the amount of XXXX because of XXXX XXXX XXXX XXXX open two loans for my one car and nissian motor acceptance said that money went to my second car loan for the same XXXX XXXX kicks that i called the dealership and talked to XXXX in finance and he said he will look into it this i got a call from XXXX and he said he was overnight a check back to nissian motors and i would be refuned the amount of XXXX from nissian motors as of XX/XX/XXXX i check on the account with nissian motors it says i now owe XXXX that for XX/XX/XXXX payment and now XX/XX/XXXX payment this second account was set up in a error i should not be charged for a late payment that was due XX/XX/XXXX is crazy I just wanted to make everyone aware of what happened to me and before you leave the dealership make sure there is not 2 auto loans for the same car you are buying on Tuesday XX/XX/XXXX XXXX called me and said everything should be fixed by Friday XX/XX/XXXX and she would have XXXX to call me that same day and he did not call me back to confirm the amount of my refund would be XXXX when I talk to XXXX on Monday XX/XX/XXXX he said that the he would make a check out in the amount of XXXX and sent it overnight and nissian motor acceptance should get it by Tuesday XX/XX/XXXX I checked today Wednesday XX/XX/XXXX and it says I owe on a XXXX on a account that was open in error if you do the math the amount of XXXX and nissian motor acceptance says I still owe XXXX that means my refund would be less than XXXX I will lose XXXX due to a account open in error XXXX XXXX is saying it was nissian motors acceptance fault not there's

Nissan Motor Acceptance Corporation XXXX XXXX XXXX XXXX, TX XXXX account # XXXX In early XX/XX/XXXX a Nissan Motor Acceptance Corporation representative agreed by phone to allow a lump sum payment to be applied to multiple future monthly installments payment on my auto loan. The lump sum payment was a credit from cancellation of extended warranty service that I had not intended to purchase in the first place. I cancelled the extended warranty shortly after my vehicle purchase.
There were actually two of these payments applied to the principal of my auto loan ( account number above ). One for {$1200.00} on XX/XX/XXXX and another for {$1300.00} on XX/XX/XXXX. I requested that the Nissan representative have the second of these payments applied/posted to regular monthly installment payments for XX/XX/XXXX and XX/XX/XXXX and this was confirmed during that telephone phone call.
Without any communication or notification from Nissan both of these payments/credits of XXXX and XXXX, were applied directly to the principal of the loan rather than what was agreed. Apparently, Nissan either does not have a policy or ability to do what was agreed or chose not to do it for my particular installment loan. I was given no notification, but found out when logging into the customer online portal. I immediately brought the account current as soon as I realized that these principal payments had been made rather than scheduled as installment payments.
My account is showing a 30 day late with all three credit bureaus. I have tried to file disputes with XXXX, XXXX, and XXXX directly, since this his having an adverse effect on my credit and will prevent me from obtaining a mortgage. I have had numerus phone calls with Nissan Motor Acceptance Corporation to rectify this situation and it has not been resolved. I plan on consulting with an attorney and take whatever action is available to me if Nissan refuses to resolve this matter amicably and rectify their mistake/oversight.
