Hi, it's XXXX with structured settlement. I see that you haven't returned my message. After speaking to you, it really sounded like you wanted to take care of this on a voluntary basis Since that is not happened I need to submit my final recommendation on your file today as a last resort I just wanted to reach out to you before this escalates to a more serious problem. Please call me back at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Thank you in advance This is an attempt to collect a debt and any information obtained will be used for that purpose And then I called number back and agent got very nasty and didnt even state He was on recorded line. He told me he could do whatever he wanted to do. Then I hung up and He called me back harassing me again and I told him to put me on DNC and He still continues his rudeness. They violated my rights and need to be held accountable for their actions. TCPA and FDCPA have both taken place. I have other VMs if needed from this company.

NOTE : I submitted this complaint to my home state 's regulatory agency : Florida XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX, I receive a call from a debt collector identifying themselves as " Structured Settlement '', but their legal name is Nationwide Capital Services , LLC. I agreed to pay ~ {$300.00} of my {$2900.00} debt balance and my XXXX card was successfully charged for ~ {$300.00} the same day. I agreed to a payment plan, but it was verbal, not in writing. Unfortunately, I could not make another payment of ~ {$300.00} on the next scheduled date, and I called back asking for an alternative arrangement. The arrangement was made, but the phone representative made warnings about " last chance '' on short notice which was unusual for a debt collector, and it gave me a suspicious impression. I did some research. Nationwide Capital Services has no mailing address in Florida, no website, and no e-mail address to send correspondence. They do have a phone number and a XXXX address, but it points to a XXXX XXXX XXXX On or about XX/XX/XXXX, I called " Structured Settlement '' again, but this time, I used an audio recorder and disclosed to the phone representative that I was recording the call. The first phone representative threatened to send my account " to my employer '' and gave a negative reaction when I disclosed I was recording the call, and the rep terminated the call, without providing me the mailing address where I can send Certified First Class Mail. On or about XX/XX/XXXX, I made another phone call to Nationwide Capital Services ( d/b/a " Structured Settlement '' ), and it was a different phone representative, who demonstrated good conduct and professionalism. However, I still have serious concerns about the Nationwide Capital Services organization. I have good reason to believe this debt collection organization is non-compliant with state and federal statutes, or at the very least, failing to follow industry best practices.
SUMMARY OF ISSUES : * NO ACTIVE LICENSE with Florida XXXX XXXX XXXX XXXX XXXX Nationwide Capital Services had a license in the past, but it was expired as of XX/XX/XXXX ( license # XXXX ) * Nationwide Capital Services does NOT have its Florida registration listed in XXXX, which suggests it's probably not authorized to perform debt collection activity in Florida? ( see : XXXX : XXXX ) * Nationwide Capital Services does NOT have a mailing address in Florida, but a registered agent is specified ( see XXXX, XXXX # XXXX ) * I witnessed unprofessional conduct from Nationwide Capital Services call center staff.
* More specifically, a Nationwide Capital Services phone representative made a veiled threat about sending my debt " to my employer '', implying accelerated garnishment, even though I'm making an effort to pay. I have the impression they may be using psychological pressure tactics? ( I think this falls under Florida State Statues 559.72 ( 9 ), not sure about the Federal code/regulation ) * Is it possible to have my debt account transferred to another collection agency that is more reputable, professional, and licensed in the state of Florida?
* The original creditor was XXXX XXXX, which is a tribal pay-day lender based in South Dakota XXXX XXXX XXXX XXXX XXXX XXXX
