Aplnt to Obtain Final Order-Per Dobrick ~ The orders appealed are not final and appealable. The December 9, 2016 order merely grants a motion to dismiss/for summary judgment rather than actually dismissing the case or entering judgment. See Dobrick v. Discovery Cruises, Inc., 581 So. 2d 645 (Fla. 4th DCA 1991); Paulino v. BJ’s Wholesale Club, Inc., 106 So. 3d 985, 987 (Fla. 4th DCA 2013) ("an order which merely grants a motion to dismiss, as contrasted with an order dismissing a complaint or an action, is not a final order."); Rust v. Brown, 13 So. 3d 1105, 1107 (Fla. 4th DCA 2009) ("An order merely granting a motion for summary judgment is not a final order because it does not enter judgment for or against a party."). Despite contrary language in the order denying reconsideration, that order is also not final and appealable. Appellant is ORDERED to obtain a final, appealable order within thirty (30) days and file it with this court, or this appeal will be sua sponte dismissed without further notice. See Fla. R. App. P. 9.110(l); further Upon consideration of appellant’s April 20, 2017 response, it is ORDERED that appellee’s April 10, 2017 motion to dismiss is denied as moot.
