Our Complaint is about Amerihome Mortgage company They are holding uncashed checks racking up late charges and penalties.
on XX/XX/XXXX a check for XXXX was sent to Amerihome mortgage along with a check for XXXX monthly payment. They cashed the XXXX check on XX/XX/XXXX and we placed the balance of the Mortgage on XX/XX/XXXX as well. the XXXX made it to our mortgage payment but the XXXX never made it to pay off our partial claim. that check has disappeared and the XXXX dollar payment that we placed never made it to the proper month. it was placed on XXXX payment and not XXXX payment. We called and had then change the XXXX several times and it still has not made the XXXX payment. We are also missing XXXX for XXXX payment and XXXX for XXXX payment aws well. We know they are receiving the checks because the XXXX one was cashed. we need help and dont knwo where to go.

This is a follow-on to complaint XXXX. To re-cap, I was hired for continued government service with my previous employer to work overseas. This hire occurred in XX/XX/XXXX We knew there would be substantial time before I left. We contacted Amerihome Mortgage company OFFICIALLY XX/XX/XXXX to ask for the request paperwork for an assumption of the loan to take my name off the mortgage. We did not receive the document until XXXX XXXX. I have email traffic proving I sent a PDF filled form back to the assumptions email box on XXXX XXXX. On that day, we did call Amerihome to verify it was filled out correctly before sending. The auto response email stated to give 7-10 business days. We did that, but did not hear anything. This prompted my first call on XX/XX/XXXX to find out info. Unfortunately, no-one can talk to assumptions directly so we had to talk to customer service. All they can do is email assumptions. Many calls later and emails to assumptions, no response from assumptions, I even talked to the escalations department who tried. No response. Again, this was just to request the assumptions packet! Finally, XXXX XXXX XXXX emailed us the package on XXXX XXXX, followed with a phone call on XX/XX/XXXX to assist with filling it out. We filled it out and sent it to XXXX on XXXX XXXX. Then, my girlfriend was asked to send a copy of her social security card so assumptions could send to underwriting. It was received on XXXX XXXX. It's disturbing to know that the company 's response from my previous submission happened on XXXX XXXX, but the individual responding did not know the most current info! Currently, there still is a problem. It seems XXXX XXXX may have quit and we do not have a contact anymore. Has the package been sent to underwriting? The length of time this has taken is ridiculous. I am set to leave soon and we still do not know what's going on! Spoke to Escalations again on XX/XX/XXXX, call reference XXXX. No response yet. In the company response on my previous submitted complaint, XXXX XXXX gave her contact info so I called. Of course it went to voicemail, and the name was a different person. Left a message anyway. No return call. This process has added stress to an already stressful situation with my move. With no real ability to talk to anyone about the progress of our submission, we are in the dark. Not a great place to be. Amerihome should be ashamed!

XXXX has marked my payment for XXXX as past due 45 days. I am under the XXXX program since XXXX of 2022 and my mortgage will be paid for 18 months. XXXX was already notified of this and the checks go out every month for payment. I have called and tried to get this escalated with no assistance from customer service. They can not track the payment down and have not helped what so ever. Now my credit report is being flagged for late payments and has gone down XXXX points!

In XXXX of XXXX I lost my husband to XXXX XXXX XXXX. I was very overwhelmed not only by losing my husband but also by switching his military retirement and social security income over to me as a surviving spouse. I utilized the forbearance plan to try to get everything together and have a break from mortgage payments. I was informed that my forbearance was ending and I called Amerihome to explain my situation. I was told that due to the passing of my husband a form would be sent to the VA requesting an extension on my forbearance. I was also told that an extension would be 3 months. I went back to getting everything settled. I then asked for a partial claim from my lender and was told I was denied because it had been too long since my forbearance ended. I then spoke to a foreclosure attorney who agreed to help me. On XX/XX/XXXX they sent a letter to my lender and never received a response. Phone calls were made to my lender requesting a response on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The refused to answer the letter. At this point, we are sending in the letter requesting research that was sent to my lender. They have not responded.

On XX/XX/XXXX I was contacted by XXXX XXXX, a representative of Amerihome, XXXX informed me that to keep my account current I had to pay Amerihome {$130.00} before the end of the month. I informed XXXX XXXX of my medical situation which would cause me to be late on several future payments and that I knew I would be able to catch up on any other mortgage payments by XXXX. On XX/XX/XXXX I sent that payment, see your XXXX Statement. Thank you for making that accommodation and accepting the payment. It should be noted that at the time of XXXX XXXX request, my payments were not late, my account was current. This payment of {$130.00}, was then unapplied. It has never been disclosed to me what it was used for. Amerihomes statements never show it being applied to late fees, escrow or my mortgage balance. It just disappeared.
Please find attached your statement on this account dated XX/XX/XXXX. Please note your further accommodations for XXXX, XXXX, XXXX which I also accepted. Correctly These months payments show on my credit report as paid timely. Though your records show them as being late. In XXXX without any prior notice your company began reporting my status as delinquent or late.
I believe this is violation of the CARES act which states the following : An accommodation includes any payment assistance or relief granted to a consumer who is affected by the COVID-19 pandemic during the period from XX/XX/XXXX, until 120 days after the termination of the COVID-19 national emergency declared by the President on XX/XX/XXXX under the National Emergencies Act.
1 Such an accommodation includes, for example, agreements to defer one or more payments, make a partial payment, forbear any delinquent amounts, or modify a loan or contract.
2 An accommodation includes assistance or relief that is granted voluntarily or pursuant to a statutory or regulatory requirement.
On XX/XX/XXXX, I contacted Amerihome. XXXX XXXX, a representative of Amerihome, informed me to make my account current I had to pay Amerihome {$5600.00} by end of day, XX/XX/XXXX. That payment was credited, however not applied to my account, though the funds as directed were received before the end of day, XX/XX/XXXX. Late fees had not been included in the payment. My credit bureau files ( XXXX, XXXX and XXXX ) were then informed my XX/XX/XXXX payment was 60 days late. This is in violation of Florida State law which requires a creditor wait at least 15 days before reporting a payment late. Florida State Law : 494.00791Prohibited acts. ( 13 ) LATE PAYMENT FEES.
A lender may not charge a late payment fee for a high-cost home loan except as provided in this subsection : ( a ) A late payment fee may not be in excess of 5 percent of the amount of the payment past due.
( b ) A late payment fee may only be assessed for a payment past due for 15 days or more.
Additionally it violates the Code of Federal Regulations which states : 12 CFR 1026.36 ( c ) Servicing practices. For purposes of this paragraph ( c ), the terms servicer and servicing have the same meanings as provided in 12 CFR 1024.2 ( b ).
( 1 ) Payment processing. In connection with a closed-end consumer credit transaction secured by a consumer 's principal dwelling : ( i ) Periodic payments. No servicer shall fail to credit a periodic payment to the consumer 's loan account as of the date of receipt, except when a delay in crediting does not result in any charge to the consumer or in the reporting of negative information to a consumer reporting agency, or except as provided in paragraph ( c ) ( 1 ) ( iii ) of this section. A periodic payment, as used in this paragraph ( c ), is an amount sufficient to cover principal, interest, and escrow ( if applicable ) for a given billing cycle. A payment qualifies as a periodic payment even if it does not include amounts required to cover late fees, other fees, or non-escrow payments a servicer has advanced on a consumer 's behalf.
All telephone contacts by me to AmeriHome were from my cellphone XXXX to their recorded Customer Service number XXXX.
I have attempted to resolve this matter twice with AmeriHome through attached written communication. Each time I have been told they did a thorough investigation, their facts and reporting is accurate, so no change in their reporting will occur.
AmeriHome has taken the position that I did not ask for a forbearance, so I am not entitled to help. I did inform AmeriHome of my medical condition, which started during the COVID19 epidemic and asked for help, someone from AmeriHome gave it to me with late payments at first not being reported as late. This clearly was an accommodation, which does not require that I seek forbearance.
AmeriHome has further violated the above referenced Florida State and Federal Law.
These violations caused me harm by inaccurately reporting to the credit bureaus, causing drops in my credit rating and me to pay more for credit as well as be denied credit.

On XX/XX/2021, the servicing of my mortgage was transferred from XXXX XXXX XXXX ( XXXX XXXX XXXX ), which was sub serviced by XXXX XXXXe XXXX to Amerihome Mortgage Company LLC. On XX/XX/2021, the XX/XX/2021 payment was made to XXXX through a bank draft. The XX/XX/2021 installment was not processed and I went online and made a payment to XXXX, accidentally, on XX/XX/2021. I also made the XX/XX/2021 payment to XXXX on XX/XX/2021. On XX/XX/2021, both payments were returned to me and upon research, I found the mistake as well as why the payments were returned and called XXXX mortgage to make the XXXX and XX/XX/2021 payments on XX/XX/2021. In speaking with the representative, I was assured that the XX/XX/2021 due date would be covered under RESPA. Per RESPA, I have 60 days from the date of servicing that the payments made to the prior servicer will not be considered late. XX/XX/2021, is the XXXX-day post servicing transfer. The XX/XX/2021 payment should not be reported late by the new servicer. XXXX XXXX is reporting the XX/XX/2021 installment in XX/XX/2021 as 30 days past the due date. This is incorrect and needs to be changed. I have made multiple calls to fix the error, I disputed with the CRAs, and I have faxed a letter with my explanation to XXXX with no investigation that fixes the issue. I was told by more than one agent on the phone with XXXX that they have a servicing date of XX/XX/2021, in their system and I suspect this is the reason the credit reporting has not been fixed. Per their " Welcome Letter '' the servicing date began XX/XX/2021, and they must abide by their official correspondence with me. I have missed my opportunity to refinance my mortgage for a better rate now that rates have been going up again. I could have saved thousands, but the error in the reporting has prevented me from going forward with the refi. I have attached the welcome letter and my bank statement proving payments to XXXX, payments returned from XXXX, and then payment to XXXX.

I initially had a mortgage open with AmeriHome Mrtg. At the beginning of my home purchase in XXXX. As of XXXX XXXX my account was transferred to XXXX / XXXX servicer and AmeriHome mortgage was dropped off my credit report. As of a couple months ago AmeriHome mortgage has reappeared on my credit report now making it seem as if I have two mortgages open although I have not been with them nor made a payment to them since XXXX of XXXX. I only have one single family Home and one mortgage. AmeriHome mortgage should not be reporting on my credit. I have been dealing with them all morning today XXXX XXXX and it seems theyre giving me the run around on getting in contact with their claims/ dispute department. Ive tried faxing the claim over and it was unsuccessful, I tried opening the claim online as directed yet Im unable to login although I reset my password and login credentials. Ive called all morning and am being told different directions each time. I tried emailing them directly and as they were going to give me the email The phone call got disconnected. Im just looking to get them to stop reporting to my credit report since Im no longer with them and its inaccurate and effecting my credit.

they said to remove the pmi need reach 65 % my loan is conventional.
they said : Currently your LTV is 69.75 %. Additionally, and your loan is seasoned less than two years. As your loan secures an Investment property and/or Multi-Unit property, the LTV must be at 65.00 % or less to qualify for PMI removal XXXXased on the Original Value of your loan, via paying down the principal balance of your loan.
If you wish to proceed with removal of PMI, you have the following options available : Original Value Removal Option You may pursue PMI cancellation based on the Original Value of the property determined at closing. You can make a pay-down towards the principal balance of your loan to reach the required 65.00 %. As of today, the required amount needed to reach the required 65.00 % for PMI removal is {$32000.00}.

I have communicated with Amerihome regarding my mortgage on numerous occasions since XX/XX/XXXX. I have requested an escrow analysis twice ( XX/XX/XXXX & XX/XX/XXXX ) to ensure my Homestead Exemption was reflected on my account with my new tax rate. I sent the Tax Bill to Amerihome when I requested the first escrow analysis. I have yet to receive the analysis and my XXXX taxes are still being utilized to calculate my XXXX escrow resulting in me paying a mortgage payment that is way higher than it should be. Additionally, I have escrow overage. I'm sure at least a portion of it should be refunded to me.
In addition to my calls, I have emailed Amerihome customer support department twice and also requested to speak with a supervisor several weeks ago. No return contact from either. I called again today and requested that a supervisor contact me regarding the overage I'm being charged in my monthly mortgage payment and the escrow overage that is being held in my account.
My taxes in the amount of {$6600.00} were paid by Amerihome in XX/XX/XXXX yet, they are still using my previous year 's tax rate of {$10000.00} ( which is incorrect ) to calculate my monthly escrow.
My Insurance & Taxes : Homeowners- {$4100.00} Flood- {$1300.00} Taxes - {$6600.00} Total - for {$12000.00} Escrow : Account as of yesterday - $ XXXX Monthly escrow being collected - {$1300.00} per month ( X 12 months =. {$16000.00} ) If you add the money in my escrow account ( {$9300.00} ) to the annual amount Amerihome is collecting ( {$16000.00} by the end of XXXX ) they will have {$25000.00} of my money. If my insurance and taxes are {$12000.00} for the year, why does Amerihome need an additional {$13000.00} of my money?

I contacted my current lender Amerimortgage back on XX/XX/XXXX regarding a FHA streamline refinance. I was dealing with XXXX XXXX. XXXX explained to me that my credit needed to be pulled and a minimum credit score of XXXX was needed. I explained to XXXX per FHA/HUD all FHA streamlines do not need a credit score. He was adamant that they do. However, he pulled my credit and I exceed Amerimortgage requirements. XXXX contacted me a couple days later on XX/XX/XXXX to tell me that he saw that I did a forbearance and that I needed to pay the partial claim out of pocket and that it could not be rolled into the refinance. That is a FHA /HUD requirement. Being that I am in the industry I know that not to be a FACT, just like the credit score requirement for all FHA streamline refinance. So I did my due diligence for XXXX and contacted HUD. HUD also confirmed that when you do a FHA streamline refinance there are 2 different type of streamline programs and one does not require a credit min, and you can definitely refinance your partial claim into a FHA streamline refinance. FHA/HUD also provided me with the article guidance for Amerimortgage. I forwarded the email to the loan officer XXXX XXXX, asked for him to review and follow up with underwriting or whomever needs to review the FHA guidance. I did not hear back from XXXX for 2 days. He responded back to me asking if I extended my forbearance. I was very unclear where that line of question came from since he is with Amerimortgage and he would know that I DID NOT extend my forbearance. My forbearance was from XX/XX/2020 I resumed my mortgage payments back in XX/XX/XXXXXXXX XXXX Amerimortage took several months before they completed my partial claim paperwork. Those are facts and he should be able to see payments have been made. When I answered his question with the same response as I am giving in this complaint and asked for a follow up on the refinance and rolling in the partial claim I have yet to receive a response. I explained to him back on XX/XX/XXXX that I was working with another lender and they were following the FHA/HUD guidance and it appears to me based on his quick uninformed answers there is some type of predatory lending. He was adamant that I am incorrect, and has not responded to my escalation. Amerimortgage has pulled my credit report and are doing nothing for me since they know I qualify for the credit score so now you are attempting me to disqualify my refusing to role in the partial claim and force me to pay thousands of dollars out pocket.! I have also called Amerimortagage since XX/XX/XXXX regarding a copy of my mortgage note. I have been told now 3 times since then a request would be put in and the turn around time is 1 business day. Each time I call to follow up mysteriously the request was closed because someone at Amerimortgage did not put the request in correctly. I called this morning and placed now the 3rd request and was told the turn around time is 1 business day. I continue to explain to the representatives that I needed this document, and I needed it today XX/XX/XXXX. But, yet I am told it will take another 24 hours due to their incompetency twice before.

This is the third complaint I have filed against Amerihome Mortgage.
The two previous complains are : XXXX XXXX A summary of the previous problem : Amerihome mortgage did not renew our insurance policy and let it lapse due to internal error. They did not notice for well over a year when I brought the issue to their attention. After my CFPB complaints, their remedy was to place back insurance on our account at no cost to us ( because we had a gap in insurance history which made us uninsurable ) and to apply new insurance on our home of equal value moving forward. They would find insurance OF EQUAL VALUE to apply to our home, and cover any additional costs over our original premium.
The new problem : Once again, Amerihome Mortgage did not act in good faith. They have been dishonest throughout this entire experience. The new insurance claim that they bought for our home ( which we had no say in ) was not of equal value to our insurance. In fact, they chose to add an optional rider to the policy to make it cheaper for themselves ( because they had to pay any amount over our original policy ). This optional rider makes it so that our insurance does not cover water damage from plumbing or appliance leaks. Our old policy DID cover water damage. This rider is OPTIONAL in my county. Amerihome decided to add it only to save themselves money over our safety.
We were not asked about this rider, nor asked if we wanted it included in our policy. Because of their promises, we thought we were getting the exact same level of insurance we purchased previously.
Well, our AC or Slab now has a leak, and has caused tens of thousands of dollars worth of damage to our floors and baseboards. Because of Amerihome 's decision to skirt the CFPB 's ruling, we are not covered to have any of this damage replaced and must now pay out of pocket for the repairs. We do not have the money to do this, and the mold/bacteria is getting worse every day. It will be MUCH worse after we loose power from Hurricane Dorian and will not have AC to cool the home for an undetermined amount of time. My family will have health issues from this problem.
How many times must Amerihome step on our necks before full reparations are made and they are held accountable?

I was offered a trial plan for the months of XXXX XXXX and XXXX of 2020 and i called in XX/XX/XXXX to schedule my final gruel payment. I originally asked for an extra day to make the payment since my income reduced due to Covid 19 and the rep assured be that i could make my payment on XXXX she explained that technically i had 31 days to make the payment so i believed her and list dated the payment for XXXX and we ended the call. However once the call ended i wasnt too sure i believed her so i borrowed money from a relative and i called back the same fate and moved the payment to XXXX. I called a few times after to confirm my payment was set up and make sure my trial plan Doesnt break and was reassured by multiple reps that my payment processed and my plan was good. Now on today XXXX i see the funds still have not come out of my account so i call AmeriHome and a rep tells me that my payment was never changed from XX/XX/2020 after i called multiple times to confirm it was changed to XXXX and my plan is broken. I asked to speak to a manager multiple times and was told that 1 isnt available and Im trying to not lose my home

My mortgage is serviced through AmeriHome Mortgage. I applied for and was granted a 90 day forbearance under the CARES Act. The forbearance was to start for my XX/XX/2020 payment and extend through XXXX, with the next payment due XX/XX/XXXX. I have attached a copy of the acceptance letter. They then sent me an invoice which was for the XXXX payment. In that invoice, there was a threatening message about being delinquent on my payment and threatening late fees and negative credit reporting. Both of these are against provisions of the CARES Act. I sent AmeriHome an online message stating my concern and unhappiness about how they word invoices and in general, how they treat their customers. The response was an automated message about applying for a forbearance. I have attached both XXXX and XXXX invoices. The acceptance letter and a printout of the online message. I have since paid both of XXXX 's and XXXX 's payments ( {$6000.00} in total ) because of their poorly worded invoices and threatening messages.

We were directly hit by Hurricane Irma in XXXX of 2017. At this time I lost my job due to the hurricane and took advantage of a program that my mortgage company sent me via email to pause my monthly payments for up to 6 months - at no cost and was told several times this would not affect my credit.
I submitted all paperwork more than once and the entire process was beyond stressful and awful.
I am in the process of refinancing my home and have been told that Amerihome Mortgage Company reported that I missed a mortgage payment - I did not at any point miss any payments.
This has impacted my credit score and I am unable to get any kind of loan!

Amerihome Mortgage XXXX/XXXX C/O XXXX XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX, SC XXXX Received a letter dated XX/XX/XXXX that said the amount of flood insurance paid by our condo home owners association was insufficient ( but not by how much ) and that if we didn't amend the master policy or purchase one of our own or they would purchase one for me. I received this letter on XX/XX/XXXX. I called twice to get an explanation ( both calls recorded ) where the customer service rep would not put me in touch with the flood ins department and i was told both times the rep could answer my questions. The first call lasted over 20 minutes and the rep hung up on me and the 2nd call, the rep could not answer my question ( why did we need more insurance? ) and I asked to speak to the supervisor but the supervisor refused to speak to me. On XX/XX/XXXX I faxed ( and sent by certified mail ) a copy of our flood insurance policy and an email from our insurance agent explaining why our coverage was sufficient to meet the Flood Protection Act of 1973, I explained that we were disputing this and would like an explanation.
I got an acknowledgment that the fax was successfully sent, but received no communication from the company acknowledging this. We received another communication on XX/XX/XXXX reiterating the terms of the first letter. I called to try and see if they had received our communication that we were disputing this need for additional insurance, but was told twice that their " system was down ''. I can not express to you the level of frustration we feel as a result from incompetent customer service reps that basically look up information in a reference manual to answer questions they know nothing about and refused to transfer us to the flood loan department and - the first time in my adult life - I was refused the opportunity to speak to a supervisor to get an explanation/clarification of our situation. I strongly ask for any assistance you can give us.

Due to the XXXX XXXX, President Trump indicated that all mortgages would be available for a deferment. We are both furloughed from our job. My wife, XXXX XXXX since XX/XX/XXXX. Me, XXXX XXXX, since XX/XX/XXXX. We live in Florida and have applied for unemployment. Neither of us has received XXXX benefits from Florida as of XX/XX/23.
We filled out the help forms on Amerihome Mortgage 's website, and they have never mailed or emailed either of us a response. We talked to XXXX rep who said we could ask for a forbearance. But, President Trump said there would be deferments. And, when you are not making any money, a forbearance makes no sense.
The Amerihome rep told us we could get a XXXX day forbearance, but then would be responsible for all of the monies owed in the fourth month. Since we have a USDA, federally backed mortgage, Amerihome should be offering us a deferment. We are in a rural area, we are not wealthy, and now we are out of work.
Since we are getting no help from Florida, our money is running out, and we are concerned we will lose our home. Amerihome as been no help, have not responded to our requests for help, and when we pressed the rep for help, he told us to refer to the USDA. We are at a loss now ...
Please help.
