On XX/XX/XXXX I was offered a modification from Village Capital. I began to pay the trial modification payments. The trial was to end XXXX, XXXX. I have continued to pay the trial plan. My loan began with Village Capital, transferred to XXXX and transferred back to Village Financial XXXX. Since the trial period ended I have continued to pay the trial payments. I have called multiple times to ask for the agreement in writing as I was paying and had no written agreement in place. They continuously advised that I continue paying and the paperwork would be generated. Today I received a letter stating I have to reinstate over {$15000.00}. I then called and asked for an email where I could sent a research request to figure out where my money had went. I called twice and each time was given a different email address for the request. XXXX and XXXX. Both emails came back undeliverable. At this point, Village Capital will not even tell me what is going on. The email I tried to send is below : o Whom It May Concern, Please accept this as a written request for information. We are concerned about the adherence to the Truth in Lending Act, Fair Debt Collection Practices Act and the Coronavirus Aid Relief and Economic Security Act. If we do not receive the following answers, we will have no choice but to report this to the Consumer Financial Protection Bureau. Please see timeline and questions below : In XXXX, XXXX XXXX XXXX 's file was with Village Capital and he was approved for a loan modification ( please see attached ). Since this approval XXXX XXXX has paid every month the trial payment.
Since the trial plan was offered the servicing of this loan has transferred from Village Capital to XXXX to Village Capital, XXXX. We will need to see where all payments have been applied, which entity collected payment and how the payments have been transferred to each servicer.
XXXX XXXX has now made 8 modification payments ; we still do not have any paperwork with a written agreement. We have requested the agreement multiple times and have been unable to get anything in writing.
Please advise as to the status of the modification documents and a transaction history for this file from XX/XX/XXXX to present day ( XX/XX/XXXX ). We believe enough time has passed with XXXX XXXX making payments based on verbal communication. We look forward to your response within the next 30 days or we will be forced to involve the CFPB. Thank you.
Please help me. Village Capital has been collecting payment for 8 months and is now saying it was not received. They have refused to send me any paperwork for the past 5 months. I have tried to work with Village but they will not give me an accurate email address and ignores my verbal requests.

On XX/XX/2022 my attorney 's office submitted complaint number XXXX on my behalf with a concern about missing payments. My lender responded by stating they will not answer to a third party and gave no indication of where my payments went. I am now filing on my own behalf to get an answer. My lender is not being transparent and I believe is not following Fair Debt Collection Practices, The Truth in Lending Act or the Coronavirus Aid, Recovery and Economic Stability act. I am asking the CFPB to locate my payments and help me get credit for payments made. Also, in their response they gave a phone number to get more information. I called and spoke to XXXX who refused to give any identification and told me to send another email to XXXX. I have already sent an email and received an automated message that I was not in their email list and could not send the email Thank you.

Complaint is against Village capital Investments. I keep getting notices that we are being charged late fees for payments that have in fact been received on time. I have it on automatic Bank payments, I spoke to my bank who said they have proof that they have received every payment on time but the company chooses to wait 10 to 13 days to cash the checks, to be able to keep charging us the late fees. When I have called numerous times to get this issue resolved I keep being hung up on or told to call their legal department without being given the phone number then hung up on.

I have tried to secure a payoff and can not get through email or phone. This payoff the last piece to facilitate a refinance. They continue to state " it takes 7 to 10 bus days while admitting they received the request on the XX/XX/2022. In my opinion a ruse to post more interest charges. I asked to expedite through an XXXX but they left me on hold and told me there's nothing they can do. IF I fail to get this loan I will be in dire financial streights and as noted they are the only ones not cooperating with my request for help.This company has caused me severe escrow problems XXXX. Allegedly supervisor Custer " SERVICE '' " Our policy can not do anything to assist '' per Mtg dept. WILL NOT EVEN AYTEMPT TO XXXX speaks volumes!

We refinanced our VA loan through our same mortgage company, Village Capital & Investments, LLC, and closed on XX/XX/XXXX. We paid {$4100.00} to XXXX XXXX XXXX XXXX in XX/XX/XXXX. Village Capital & Investments, LLC then also paid our taxes from escrow. Village Capital received a refund of {$4100.00} on XX/XX/XXXX & we were advised that we would be refunded the duplicate payment. We received {$3400.00} on XX/XX/XXXX. Village Capital claimed there was an escrow shortage is why we did not receive the full refund, even though we had just closed on this loan. They never clarified why there was a shortage. Our current History of Escrow Account Transactions reflects there was a monthly charge of {$130.00} for Service Fee Paid Amt. that was never explained or authorized by us and not included in the final closing document. There was {$1400.00} transaction on XX/XX/XXXX Partial Settlement on Foreclosed Loan that was never explained. Our loan was refinanced not foreclosed. On XXXX, there was a charge of {$1000.00} for refund amount - this entry was never explained or refunded to us. We never received a copy of the closing documents 3 days in advance of the closing as required by TRID. We have made numerous attempts through phone calls to Village Capital, but our loan officer or any other department will not speak with us. The one time we did get someone to speak with us, she asked us to hold so she could check about the Partial Settlement on Foreclosed Loan, but when she returned to the phone, she stated she was instructed not to answer any further questions from us. She stated someone would call us on the following Monday, but no one has called us yet. We have asked for explanations to our questions through emails to various departments at Village Capital, and no one has responded to our questions to explain where the rest of our {$4100.00} went or why we have these charges as stated above on our escrow account.

On XX/XX/2024 I called to make my payment. The following week on XX/XX/XXXX I called back to ask why the payment has not been taken out of my account. I was informed that the previous representative put my payment in as a savings account. I informed the representative that I indicated checking account and that this is an issue because the account numbers are the same. I called again on XX/XX/XXXX to verify that Village Capital had the correct account information and that they were taking the payment from my checking account not savings because the numbers are the same. I was informed that my payment was attempted out of my savings account again by my bank. I confirmed that the checking account number was correct. The following week I spoke to representatives on XX/XX/XXXX and XXXX. On XX/XX/XXXX they told me the payment is still being processed. I was informed on XX/XX/XXXX that the bank account information was not corrected until XX/XX/XXXX which resulted in my payment not being processed. It is now XX/XX/XXXX, the payment still has not been taken from my account. I called to speak to a supervisor on XX/XX/XXXX, the representative XXXX XXXX XXXX told me to wait on hold for 10 minutes for a supervisor. The representative came back on the line a few minutes later and told me that she needs to hang up and request a call back. Previously I had an issue and it took one week for a supervisor to call me back. I explained this to XXXX and she told me that there is nothing she can do. I have attempted 6 times to make my payment. Village capital charged me late fees and gave a negative statement on my credit report. This issue is the result of negligence from their representatives. It is their duty as a service provider to process my payment in a timely and efficient manner. This has caused me emotional stress because I am trying to make my payment on time with no issues.

On XX/XX/2023, I signed & returned the documents sent to me by Village Capital & Investment XXXX XXXX, in order to proceed with the VA Traditional Modification. I was advised that I was to make the new monthly payments of {$2500.00} beginning XX/XX/2023. I have made two payments and still have not received any final paperwork regarding this modification. Each time that I call, I've been on hold for 1-2.5 hours waiting for assistance. Just this month, I waited foXXXX XXXX hours and XXXX minutes to pay my monthly mortgage. They have a system that says you can " Press XXXX and you will retain your place in line and someone will return your call ''. I used that one time and NO ONE ever called back. Whenever I request a supervisor, I'm told " No supervisor is available, I can put in for you to get a callback ''. Yet, no supervisor ever calls back. I have been told of different timeframes for the completion of the paperwork. I've been told XXXX weeks, XXXX days, and " there is no timeframe '', and " we're waiting for the VA to send the check ''. I need to know JUST HOW LONG THE TRIAL PERIOD IS, WHEN DOES THE TRIAL PERIOD END, AND THE TRIAL PERIOD NEEDS TO END SOON!! I was afraid to NOT sign it and I would have lost my home.
This is horrible. No one, not just veterans, should be subjected to this. Now, I'm afraid that Village Capital & Investment is just waiting to foreclose and take my home.

I have a VA Mortgage with Village Capital & Investments LLC. Loan # XXXX. My husband and myself have been laid off of our jobs due to this corona-virus. I call Village Capital on XX/XX/2020, XX/XX/2020 & XX/XX/2020 and asked to postpone my loan payment for XXXX and maybe XXXX if we are still out of work due to this virus. I was told by Village Capital that I had to pay my mortgage and stay current on my mortgage payments or I world receive late fees.
I have read and seen that with the current issues the world is going through, the Senate passed the bill that would allow borrowers with federally backed loans to request mortgage forbearance for up to 180 days. I am not asking for 180 days. Just a month or two.

In XX/XX/2019 I recieved a notice for the possibility of streamlining my current FHA loan to save money on a monthly basis from Village Capital. I called to inquire and the representative took some basic information and informed me that she would not be able to answer all my specific questions but that a mortgage specialist by the name of XXXX would be contacting me. A day later when XXXX contacted me, I inquired about my concerns and legitimacy of the streamline program and made it expressly clear that I would do research and get back to him if I was even interested in pursuing said streamline loan. After research, I found red flags and of course did NOT want to use their company nor did I ever call back to give any form of " go ahead '' or confirmation that I wanted the process to begin. My omission to call back was clearly not acceptable and I can only assume that after several unanswered calls, XXXX took it upon himself to pull pay off information from my current lender and process my loan. I did not authorize anything. When I recieved closing documents I became very alarmed and called both XXXX and the additional contact numbers that were given in the packet of documents. Nobody answered and I left a very detailed message explaining I NEVER gave permission for even my information to be inquired upon, let alone documents prepared for signing. I even warned them that it was an invasion of consumer privacy and that I would be reporting such information if they did not stop the process immediately. Low and behold yesterday, XX/XX/2019 I got a voicemail from a notary confirming my appointment, at my home, for closing! I was unbelievably upset that Village Capital could even begin to go as far without any acknowledgement to even request for payoff amounts, let alone proceed to closing when I provided them with NO information needed to proceed with any legitimate lending. I immediately cancelled that appointment and explained to the second party notary of said fraudulent company. I feel my privacy is extremely violated and my current and legitimate loan with XXXX XXXX could somehow be in jeopardy of being transferred. I have signed nothing, consented to nothing, and want nothing but for Village Capital and Investment to erase all information they have on me as if I never even called them to inquire.

My home was badly damaged on XXXX, by hurricane Ian , which was declared a disaster area by FEMA.and I had to leave due to a flood, and part of my roof was blown off. FEMA put a tarp on, but advised me to leave due to mold and so dangerous conditions from electrical damage. My mortgage was paid in XXXX XXXX, but in the beginning of XX/XX/2022, I contacted Village Capital numerous times, and left many messages asking for a forbearance plan for a few months, as I couldn't live in the home. Meanwhile, I filled out papers to extend my forbearance, ( I had not received my insurance claim settlement yet ) and sent them to Village Capital. After telling me numerous times they had not received them, I was able to speak to someone who helped me fill out an application on the phone. After receiving another letter via snailmail asking for the same info., ( 3rd time ) I finally received the first 3 month forbearance. VC also has possesion of my homeowners check for 2 months and I need it to put a roof on. I requested it several times, and had to cancel the roofing repair 3 weeks ago because they did not release the check. They have also ruined my credit by reporting I was 4 months delinquent paying the mtg. The roofing co. was going to finance the work until I received the check, but due to the delinquency, they can not. They keep putting delinquent notices taped to my door, and my neighbor had to take them off, as there aremassive burglaries due to vacant homes. I asked I do them not to, but they keep taping them to my door, advertising no one is home. Can you please help me? Thank you so much.

In the past 6 months I have sent my mortgage payment, through my auto checking account on the XXXX of the month. The mortgage co has charged me a late fee on both occasions. The bank, XXXX XXXX shows the payments were sent out on the XXXX of each month but the mortgage co says they were received after the XXXX and charged me a late fee. I can not get my problem resolved and am t5old it is my problem. The bank is sending these payments on time but the mortgage company does nothing to correct the situation. I have no way to find out why these payments a being late with no help from the mortgage co. Also my escrow account is screwed up and they have done nothing to correct it.

I am having a lot of issues with village capital mortgage company they never resolve your issues with what so ever if you request a supervisor they tell you that they will request it and that a supervisor will contact you in 24-48 hrs and they never do there good times are the wrist I have pictures names and employee ID of everyone Ive spoken too Ive been trying to make my payment for about a week now and they keep stating that they are trying to input my wifes bank information in to call the next day we have to stop working and try to get a hold of them the next day and they restate the same thing this mortgage company has very bad reviews everywhere you look them up this mortgage company should be shut down also when you call they transfer you to other departments with even XXXX get hold times me and my wife have been on the line from 1-3 hrs and then they have hung up on us this is ridiculous and we do not know who else we can contact so this problem can be resolved
