Citation text line OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a struck-by hazard: a. On or about January 28, 2021, at the JaxPort Marine Terminal, near berth 35, employees working on the dock were exposed to struck-by hazards while working around moving trucks, vehicles, and other equipment outside of designated routes. RECOMMENDED ABATEMENT: Among other methods, one feasible and acceptable means of abatement would be to: (1) Refining a written �engagement procedure� to address interaction between formen and dockman employees which includes: (a) minimizing the contact to the extent possible while on the berth; (b) notification by the foreman to the superintendent, or designee of the superintendent, that the engagement or interaction is necessary; (c) the establishment of an area removed from the vehicular routes where such engagement may occur; and (2) All dock foremen and superintendents shall be trained on these procedures and all other employees, including dockmen and truck operators shall receive instructions on the engagement procedures at the safety briefing before each operation.

On or about March 31, 2019, at the JAXPORT Marine Terminal, Dock JGIT, Pier 34/35, while conducting cargo loading operations for Motor Vessel Zim Tianjin, an intermodal shipping container was hoisted before all engaged chassis twist locks (to include chassis pin locks) were released, exposing employees to struck-by and crushing hazards. RECOMMENDED ABATEMENT ACTION: Feasible methods to protect employees from struck-by and crushing hazards during container cargo loading operations include, but are not limited to: (1) Developing a written "Pullout Procedure", which includes: (a) the proper process of disengaging containers from a truck chassis or flatbeds with emphasis on the twist-locks and chassis locking pins, when those devices cannot be unlocked by hand; (b) a process that requires the spotter, under the supervision of the superintendent, to communicate with the crane operator via a two-way device when a pull-out procedure will be instituted; (2) All affected employees shall be trained on these procedures, to include, but not limited to: Spotters; Flagmen; Crane Operators, Truck Operators, Stevedoring Superintendents, and all other employees who may be exposed to the hazards associated with this job task.
