Complaint What Happened I got a new car loan with BMW Financial Services in XXXX of XXXX. This car loan was never reported from XX/XX/XXXX until XX/XX/XXXX. They reported this to my credit bureaus over 10 years after the fact and it was false information. I called the company today and was lied to about the communication efforts and notifications that were never recieved by me and was unable to get transferred to someone who could help me. Just kept continuously getting lied to. This car was voluntary surrendered in XXXX over 5 years ago due to a hazard to drive, The car was never in good standing mechanically from the day I purchased it. The car was a HYBRID and was unsafe from the time I bought it. BMW was made aware of the faulty system numerous times and it went back to the XXXX XXXX numerous times. I was then told by my XXXX agent they would buy it out or replace it. On the way home from BMW I was involved in a MAJOR car accident in the BMW which took 8 months to get fixed when they should have totalled it out. When i got the car back from BMW service center it was still unsafe to drive if not worse. When i corresponded with BMW in XXXX for the Voluntary Surrender, it was the last time I had heard anything from them. NO notices in the mail, by email or by phone. They now, After 10 years of opening the account, they decide to report it to my credit reports as a charge off, 30 days past due. I havent heard from BMW Financial since 2017. These dates are way past the Statue of Limitations with the State of Florida. I have since disputed.

Complaint What Happened I filed XXXX XXXX Bankruptcy in XXXX and this account was included. It was removed from my credit report along with other accounts that were discharged. Somehow the negative account was placed back on my credit. On XXXX I reached out to BMW Financials and advised This account was discharged in bankruptcy and was put back on my credit report erronneously. Please remove as it is having and extreme negative affect on my credit. Any consideration is greatly appreciated. As of today, XXXX, I have not received a response and the derogatory account is still listed and damaging my credit report.

Complaint What Happened Upon checking my credit report, I notice an account from BMW Financial Services that I believe is not being reported correctly on my credit report. On XX/XX/2022, I sent them a certified letter informing them that they were reporting inaccurate information on my credit report and requested that they provide me with the information that they used to verify the accuracy of my account. After not hearing from them for more than 45 days, I sent another certified letter on XX/XX/2022, ( See Attached ), again requesting that they provide me with the information they were using to prove the accuracy of my account. I also sent certified letters to the three credit bureaus ( See Attached ), along with my incident report ( See Attached ), asking them to verify or remove the negative report on my credit report that BMW Financial Services were reporting. So far, I have not gotten a response from them either. As you can see, I have been dealing with this situation for several months with no success, so I am writing to you for help me with this matter.

Complaint What Happened I am bringing a matter to your attention in the hope that you will be able to assist me and rectify an injustice by BMW FinanciaXXXX in settling a vehicle lease I recently terminated. I recently lost my vehicle in Hurricane Ian. I leased the car from BMW Financial Services and it had roughly a {$28000.00} balance, according to BMWs website on XX/XX/XXXX. My insurance company, XXXX XXXX, paid the market value of the vehicle on XX/XX/XXXX, amounting to {$40000.00}. The difference between the insurance proceeds and the lease balance was roughly {$12000.00}. BMR Financial Services plans to keep the difference. They believe they are justified, since they own the vehicle. This is a hardship for me ( I am retired ), since I had planned to use the equity to purchase another vehicle. I object to their policy and believe it is unfair for several reasons : XXXX. Lack of disclosure. Had I known, I would have paid off the lease balance in early XXXX, which would have entitled me to the proceeds. This was not disclosed on their website nor was it in the lease contract. XXXX. Usurious. The roughly {$12000.00} profit BMW plans to retain represents approximately a 43 % gain on the lease balance. While a lease is not a loan, and subject to Federal usury laws, nonetheless, it is a financial contract. I believe a 43 % return is inappropriate, and takes advantage of retail customers who individually have little means to battle a large, foreign manufacturer. XXXX. Takes advantage of Hurricane Victims. This policy takes full advantage of Hurricane Ian victims. When I complained to the BMW agent, they mentioned that this policy had specifically been discussed at BMW, and that other customers had also complained to them about this same policy. I take this to mean that they are victimizing numerous customers in the XXXX XXXX area. XXXX. Inadequate alternatives. BMW offered to apply the difference if I leased another BMW from them. However, BMW had no XXXX XXXX vehicles available on the XXXX XXXX and would not be able to source another car until XXXX at the earliest. I need a vehicle sooner than that, so this offer is hollow. Complaint What Happened My car bill is on auto pay. To my knowledge the bill was getting paid every month. It appears that one payment was received by the company but then rejected. I was never informed that the payment was rejected. One payment was overdue for several months but every month a payment was made. The company has not been able to help me in this unfair situation. I cant get a mortage because of the late payments that was reported even though payments were made.

Complaint What Happened I had an electronic payment that didnt go through to BMW financial services and then the company reported me to the credit agencies without notifying me that my payment was late. I advised them that I was never notified that the payment didnt go through. They admitted that they never notified me and advised me that they would consider this but they then proceeded to refuse to help me resolve the issue. BMW financial services is a company that destroys their customers credit and then refuses to help them resolve the problem.

Complaint What Happened BMW Financial is reporting two accounts as derogatory on my credit report. One account is showing I owe {$3300.00} and have never received any invoice for the charges. BMW agreed to remove the derogatory reporting if I paid the balance in full due to not receiving the invoice. I paid this balance on XX/XX/XXXX and it still remains on my credit. BMW is also reporting that there were late payments, which is impossible because I had this account on direct debit. There is a second account with a balance of {$9700.00}, which was also paid and BMW agreed to remove all derogatory reporting. BMW also informed me that this account should not be negatively reporting on my credit as it would not be considered past due until XXXX of XXXX. This account also shows late payments, which both are paid in full and BMW agreed to remove all derogatory reporting to my credit. BMW is charging me {$370.00} for a disposition fee and has agreed to waive it if I lease another BMW. I am unable to lease another vehicle due to the derogatory reporting significantly lowering my credit score. I am currently renting a vehicle due to this situation.BMW Financial also harassed me via telephone while I was out of town due to my mother being terminally ill and ended up passing away in XXXX and XXXX of XXXX.

BMW FINANCIAL ACCOUNT # XXXX has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Account name : # XXXX, Account name : # XXXX, Account name : # XXXX, Account name : # XXXX, has violated my rights. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Complaint What Happened The account is from XX/XX/year> According to the FCRA, XXXX ( a ) ( XXXX ), derogatory accounts such as collections, charge-offs, or accounts listed as bad debt must not remain on a credit report for more than XXXX years. Given that the XXXX was XX/XX/year>, this account is outside the seven-year reporting window and should have been removed from my credit report. This account has been repeatedly reported without proper validation. According to FCRA XXXX ( a ), upon disputing an account, the credit reporting agency is required to investigate and ensure the account is accurate. If the information can not be verified as accurate, the account must be removed promptly. The continued reporting of this erroneous and outdated account violates the provisions of the FCRA and causes undue harm to my credit profile. If this account can not be verified and validated with clear, accurate, and documented proof, it must be deleted immediately to comply with the law.

Complaint What Happened XXXX has been non-compliant with removing the unverified account XXXX XXXX XXXX XXXX which has been deleted by XXXX and XXXX. XXXX and XXXX have both completed their research and determined that XXXX XXXX XXXX was not established by myself but XXXX keeps verifying this accounts. Also, when I called the company they responded that XXXX did not send them all of the verifying evidence to confirm each account is unverified.
