Description MISCELLANEOUS ORDER ~ In its April 3 response, the State conceded that the petitioner has established grounds for this court to grant her petition for writ of prohibition. However, the parties are hereby advised that section 397.6811, Florida Statutes, was amended in 2016 to allow a petition for involuntary assessment and stabilization to be filed by only one adult who has direct personal knowledge of the respondent’s substance abuse impairment, rather than three such adults, as is cited in the petitioner’s petition. See § 397.6811(1), Fla. Stat. (2017); ch. 2016-241, § 31, at 45, Laws of Fla. Accordingly, the State shall amend its response within five days to address the constitutional issues raised in the petition. The petitioner may serve a reply within five days after service of the amended response. As was previously ordered, the petitioner shall promptly notify the court should she be taken into custody during the pendency of this proceeding.
